Dear Mr. Daniels:
You have our approval. in accordance with the attached conditions, to place fill material in 0.001 acres
of wetlands or waters for the purpose of developing a residential tract at Swan Point Road near Sneads Ferry,
as you described in your application dated 14 February 1997. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3112.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification. In addition, you should get any other federal, state or local
permits before you go ahead with your project. Also this approval will expire when the accompanying 404 or
CAMA permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

residential lots with 3 houses, a barn, a boatramp, pier, dock, boathouse and uncovered boat lift.

9. PROJECT DESCRIPTION
Mr. Charles Daniels owns a 30-acre undeveloped tract of land located off of Swan Point Road in Sneads
Ferry. The only man-made feature on the tract is a family cemetery. Most of the site has recently been
cleared and graded prior to any approvals being obtained. This resulted in a violation of the permit
requirement of the Coastal Area Management Act. The Restoration Agreement required that Mr.
Daniels obtain a CAMA Permit prior to continuing with the proposed development.
The tract of land borders the New River and Traps Bay. It is located North of Swan Point Marina and
has an average high ground elevation of 15' above sea level. Approximately 900 linear feet of shoreline
borders navigable waters of the New River while another 1000+ linear feet of shoreline borders coastal
wetlands and/or very shallow waters of an embayment. The shoreline along the New River supports
narrow bands of Spartina alterniflora (smooth cord grass marsh), Spartina patens, and Juncus
roemerianus. The shoreline bordering the small embayment, headed South near Swan Point Marina,
has larger, more continuous stands of coastal marsh vegetation. The waters of the New River near this
location have been classified as SA by the Division of Water Quality. The adjacent water is open to
the taking of shellfish. The waters around Sneads Ferry have a long and rich history as a significant
shellfish resource. Many local people make a living as fishermen.
The Daniels property has been evaluated by the U.S. Army Corps Of Engineers and the federal
wetlands have been delineated by Mr. Mickey Sugg of their field staff. There is one area, about one-
half acre of wetlands shown on the site map. These wetlands should remain undisturbed. Some federal
wetlands may border the water, landward of the coastal marsh fringe. These wetlands are not readily
apparent on the site plan.
The tract is littered with shell midden, one indicator that there may be some archeological significance
to the area. An initial site visit has been performed by Mark Mathis of the Archeology Branch.
Mr. Daniels proposes to subdivide this tract into three lots. He is planning three single-family homes,
a barn, a paved road and water amenities. The three houses will be more than 50' from mean high
water. The proposed development on this tract will not approach the 30% impervious surface limitation
within the Estuarine Shoreline Area of Environmental Concern. A 15' wide by 50' long boatramp is
proposed. Less than 20' of this 50' ramp will extend below mean high water, as is in keeping with
Section 7H.1300 of the regulations. A 12"by 28' boathouse, a 25' by 12' uncovered lift, a 12' by 24'
dock and an 40' by 6' long pier are also proposed, as shown on the plans. The pier and boathouse
structure will extend approximately 52' waterward of mean high water. The pier length is being
severely limited by a very narrow navigation channel and a shallow sandbar located between the high
ground property and the Intracoastal Waterway. The proposed pier and other structures meet the
Division's requirements for the 15' setback off of the adjacent riparian corridor lines and also meet the
1/3 maximum distance across the waterbody. These proposed amenities will be private, for the use of
Mr. Daniels and his family.
Soil material along the shoreline down to the coastal wetland line has been disturbed and re-seeded.
There are no plans at this time for any additional stabilization measures along the shoreline. A retaining
wall structure is planned and will extend waterward on either side of the proposed boatramp.
No dredging is being proposed as a part of this project.

10. ANTICIPATED IMPACTS
This project has already presented a sedimentation hazard. It was 25 acres disturbed/graded along the
water with no erosion control measures in place. However, the measures have been installed and the
perimeter was seeded. Almost all of the trees on the tract were either damaged/blown over by Hurricane
Fran or were subsequently removed during the grading and clearing operation. This leaves the soil bare
to wind and water erosion. There will likely be increased turbidity in the New River from construction
of the boatramp, pier, dock and boathouse. Approximately 1100 square feet of public trust waters will
be shaded by these proposed structures. An estimated 5' by 10' of Spartina patens coastal wetlands will
be filled during installation of the boatramp. 15' by 50' of previously-disturbed wetland area will also
be filled for the boatramp.
