You have our approval, in accordance with the attached conditions, to place fill material in 0.15 acres of
wetlands or waters for the purpose of developing a residential subdivision at Shae's Landing, as you described
in your application dated 14 January 1997. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification. In addition, you should get any other federal, state or local
permits before you go ahead with your project. Also this approval will expire when the accompanying 404 or
CAMA permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

9. PROJECT DESCRIPTION
Homeco Construction Inc. is currently working to construct a 31-lot residential subdivision off of
Highway 50 in Surf City, Pender County. A vicinity map is shown on the site plan. The applicants
propose detached homes with community water access. The site is located on Topsail Sound across the
street from the ocean. The applicants also own a very narrow strip from Highway 50 to the beach on
the ocean side. There was an existing dune crossover on this strip that was damaged during Hurricane
Fran. A 3' wide beach crossover will be repaired or replaced as part of this project. This will offer
beach access to the residents of the proposed Shae's Landing Subdivision as well as some existing
homes nearby. The proposed beach accessway and the entrance road to the subdivision are located
within the 255' Ocean Hazard Area Of Environmental Concern. The docks and boatramp are located
within Estuarine Waters and Public Trust area. The proposed entrance road to the boat ramp and a
couple of the proposed homes are located within the Estuarine Shoreline Area of Environmental
Concern.
The tract being developed for this subdivision is a 17-acre tract covered with maritime forest and marsh.
Some federal wetlands exist on the site and the applicant plans to fill approximately 6750 square feet
to allow for a road crossing and houses on lots 15 and 16. No coastal marsh should be directly
impacted by this project. Lots 10-15 have access to the water, either a man-made canal or Topsail
Sound. These lots are eligible to apply for a permit for a private pier and dock. The mixed coastal
marsh separating the highground from the waters of Topsail Sound is over 300' wide plus the width of
federal wetlands on lots 10, 11, 13 and 14. The site plan illustrates the marsh and wetlands clearly.
The man-made canal is approximately 60' wide and has an average depth of 3.7' at mid-tide. This
information is based upon soundings taken by John L. Pierce Surveying. No dredging or alteration of
this canal is planned at this time. The applicants do propose a community boatramp, 12' wide by 35'
long near the terminus of the canal. A very small amount of area will be filled or excavated as
necessary to install the concrete ramp. No wetlands or marsh are located where the boatramp is to go.
Two community docks, 6' wide by 20' long, are proposed. A dock would be located on either side of
the proposed boatramp. No boat slips are proposed in conjunction with these structures. The docks
and ramp are to be located within a recreation easement which will be commonly owned, providing
water access to the entire subdivision.
Approximately 1.4 acres of land disturbance will occur with the installation of the streets and utilities.
An additional 3 acres of disturbance could occur with the building of the homes and associated
driveways, etc. If issued, the Major CAMA Permit will cover the home construction as well as the
streets, utility work, crossover, boatramp and docks. The subdivision will be served by water and
sewer from the Town of Surf City.
The waters surrounding this property are classified as SA by the Division of Water Quality. This
project is immediately south of waters officially designated as Primary Nursery Area by the Division
of Marine Fisheries. However, the potential for waters surrounding the project area to be functioning
as nursery is good (according to fisheries staff). The area is open to the taking of shellfish. The Surf
City Land Use Plan as classified the uplands as Developed Maritime Forest with the marsh areas being
classified as Conservation.

Shae's Landing has been reviewed by Water Quality for stormwater concerns. The Stormwater
Management Permit was issued on October 8, 1996 and limits each of the 31 lots to a maximum
impervious coverage of 1,960 square feet. Filling in or piping of any vegetative ditch or swale
associated with the development except for average driveway crossings, is prohibited by the stormwater
permit.
10. ANTICIPATED IMPACTS
The development as-proposed will have negative impacts on 6750 square feet of federal wetlands and
could cause indirect impacts to surrounding wetlands. Temporary turbidity will likely result from the
installation of the boatramp and docks. Approximately 1000 square feet of public trust waters will be
taken up by the docks and ramp. No negative impacts to navigation are expected.
About 240 square feet of muddy bottom will be disturbed for the installation of the boatramp.
Approximately 4 acres of high ground will be graded or otherwise disturbed during this development.
Natural maritime forest vegetation and trees will be stripped which will remove cover and food formerly
available for wildlife. Removal of the vegetation will also result in more vulnerability for erosion from
wind and water. If extensive boating is pursued by the residents of this subdivision, water quality and
the shellfish resource could be negatively affected over a period of time.

Enclosed is the application of Homeco Construction, Inc. for Department
of the Army authorization and a State Water Quality Certification to place
fill in 6,750 square feet of wetlands for the construction of houses, 200
square feet of shallow bottom for the construction of a boat ramp, and cover
approximately 240 square feet of open water with two small piers, on and
adjacent to Topsail Sound, on Highway 50 (South Shore Drive) at the proposed
Shae's Landing subdivision, in Surf City, Pender..>dounty, North Carolina. Your
receipt of this letter verifies your acceptance of a valid request for
certification in accordance with Section 325.2(b)(ii) of our administrative
regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by March 24, 1997, the District Engineer will deem that
waiver has occurred.

The Division of Coastal Management hereby acknowledges receipt of your application for State approval
for development of Shae's Landing located off of Highway 50 in Surf City. It was received on
December 27, 1996, and appears to be adequate for processing at this time. The projected deadline for
making a decision is March 11, 1997. An additional 75-day review period is provided by law when
such time is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter
will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
proposed development. You should post this notice at a conspicuous point along your property where
it can be observed Highway 50. Some examples would be: Nailing the notice card to a telephone pole
or stake along the road right-of-way. Failure to post this notice could result in an incomplete
application.
A field report has been prepared and is in the process of being circulated to the various state and federal
review agencies for their comments. If additional information is required based on this review, the
agencies may contact you directly.
