Dear Mr. Blanchard
You have our approval, in accordance with the attached conditions, to place fill material in 9.52 acres of
wetlands or waters for the purpose of constructing a sewer line along Motts Creek at Mott Creek, as you
described in your application dated October 2, 1997. After reviewing your application, we have decided that
this fill is covered by General Water Quality Certification Number 3101 This Certification allows you to use
Nationwide Permit Number 12 when it is issued by the Corps of Engineers. In addition, you should get any
other federal, state or local permits before you go ahead with your project including (but not lint}' .

Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specii'
in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed
in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Re: Proposed land clearing of wetlands

On 16 June 1997 the Division of Water Quality (DWQ) was notified by receipt of your
letter and maps regarding your plan to fill wetlands for the purpose of constructing a sewer
line along Motts Creek in New Hanover County. Approval from DWQ is required to
disturb these wetlands since you propose not to construct anti-seep collars. The enclosed
application needs to be completed and returned to us with 7 copies of the application,
supporting maps and documentation. In particular as described in 15A NCAC 2B .0502,
we will require you to locate all streams and ponds on the property. Please show these on
maps of suitable scale (for instance 1" =100 feet) so we can begin to determine your
projects' compliance with 15A NCAC 2H.0500. Until this information is received, this
application is incomplete and our processing time will not start. We agree that in this case
anti-seep collars are not necessary due to the depth of the sewer line and its location along
Molts Creek.

The enclosed information is provided to facilitate a wetland delineation
within the affected 30-foot wide construction area and pump station site of the
Mott Creek Sewer project. Upon successful certification of the wetland areas, the
County request to construct this project as described under the authority of
General Permit No. 198100049.
Wetland delineation activities were performed only in areas where
construction activities will occur, unless the entire easement was a wetland (see
attached drawings). In that case, no line was set.
Description of Work
A. Lift Station:
The proposed lift station will be located on the east side of River Road on
the south end of the existing Mott Creek Bridge. This site consist of a 1.15 acre
site with wetlands located adjacent to Mott Creek, and in the existing ditch along
River Road. Temporary impacts to this area will consist of excavation adequate to
bury pipeline and construct a manhole structure.

The force main leaving this site will be located below Mott Creek and will
be placed using subaqueous drilling technologies. The pit for the termination of
the drilling operation on the north side of the bridge will be in the River Road
right-of-way, between the toe of the approachment and the existing wooded area.
This area is currently a man-made drainage ditch that meets criteria for a tidal
wetland. This area would be restored to its original elevation. The presence of an
existing optic cable in this area also makes it impossible to move up the
embankment to the upland area.
Bids were originally received for an option to place the pipe crossing Mott
Creek on bents above the Creek surface. This method is no longer being
considered as part of this permit request. This cross will be made by boring under
Mott Creek.
B. River Road Force Main:
This portion of the project consist of a 12-inch force main located entirely
within the existing River Road right-of-way located to the east of the edge of
pavement. This line will require a 30-foot wide work area and will cross through
seven (7) small individual non-tidal wetland areas. These areas will be regraded
to existing grade levels after installation.
C. Mott Creek Gravity Sewer:
This portion of the project runs from the Mott Creek Lift Station site
generally to the east to the Marquis Hill Subdivision. The location currently
shown has been selected to serve the maximum number of existing and proposed
residential units along the Mott Creek Tributary. Construction of this sanitary
sewer will allow numerous residential units, currently being served by aging
septic field systems, to be connected to a County treatment facility with resulting
potential increases in surface and groundwater quality. This should result in
improvements in water quality in Mott Creek and the Cape Fear River.
This pipe will cross a tributary of Mott Creek on the south bank area. The
pipe also crosses Mott Creek twice in the upper reaches where the channel is
much smaller. These crossings will be done by excavating open trenches and
backfilling the existing grades.

On 16 June 1997 the Division of Water Quality (DWQ) was notified by receipt of your
letter and maps regarding your plan to fill wetlands for the purpose of constructing a sewer
line along Motts Creek in New Hanover County. Approval from DWQ is required to
disturb these wetlands since you propose not to construct anti-seep collars. The enclosed
application needs to be completed and returned to us with 7 copies of the application,
supporting maps and documentation. In particular as described in 15A NCAC 2B .0502,
we will require you to locate all streams and ponds on the property. Please show these on
maps of suitable scale (for instance 1" =100 feet) so we can begin to determine your
projects' compliance with 15A NCAC 2H.0500. Until this information is received, this
application is incomplete and our processing time will not start. We agree that in this case
anti-seep collars are not necessary due to the depth of the sewer line and its location along
Motts Creek.

The enclosed drawings show the potential wetland impacts for this project. It is
our understanding that this type activity is currently being covered by Regional General
Permit 49 while deliberations continue on NWP-12.
In an effort to expedite the permit process and minimize project expense, the
County is assuming that the entire gravity sewer portion of this project relating to Motts
Creek will be located in wetlands. The force main along River Road will cross several
small wetland pockets. The pump station is located entirely in upland areas.
The 12-inch force main will cross Motts Creek either aerially on bents or
subaqueously, depending on proposed cost during the bid process. The 24-inch gravity
sewer will make three subaqueous crossings of Motts Creek.
We have also contacted NCDEHNR Water Quality, USCOE, and CAMA authorities
and the U.S. Coast Guard for their approvals. It is our understanding that an individual
401 Water Quality certification will not be required as long as we agreed to all general
conditions of the RP-49. CAMA will require a general permit and the Coast Guard will
preview for compliance with their pre-approved permit.
NCDEHNR - Water Quality Section response has suggested that anti-seep collars
could be required every 150 feet through wetland areas. While the County is prepared to
meet necessary permit conditions, it is our opinion that anti-seep collars would provide no
significant benefits in wetland protection on this project.
The 12-inch force main is designed to follow the natural contours with 4-feet of
cover over the pipe. As a result, the pipe actually dips downward as it enters the wetland
bays and then turns upward upon exiting (see profile sheets). This results in the bay
areas remaining low points along the pipe run. The gravel bedding under the pipe could
actually be responsible for bringing additional groundwater into the bays from both
directions.

The 24-inch gravity sewer basically follows the Motts Creek basin. The lower
portions of the Creek are under tidal influence resulting in most of the trench area being
inundated twice a day at high tide. The inverts of this pipe are also such that we would
anticipate the entire pipe bedding area being well below the groundwater elevation
resulting in no head pressure and no wetlands drainage potential.
It is also worth noting that Motts Creek is a major stormwater drainage area for
New Hanover County. This water body is routinely maintained (especially) in the upper
portions of the watershed to enhance the removal of stormwater in a timely manner.
Placing a pipe in a trench parallel to Motts Creek will not effect its ability to remove
stormwater or the adjoining wetlands to continue to provide water quality benefits.
The cost to add approximately 60 anti-seep collars on this project is anticipated to
cost between $24,000 and $30,000 additional dollars.
We welcome the regulatory agencies comments on this subject.
