I am writing in response to your letter dated August 19, 1997 and addressed to Mark
Simpson of Advanced Building Technologies. According to the letter and your conversation
with Charlie Hollis earlier today, you need a site plan showing all streams and ponds as well.as
the proposed stormwater detention pond. I have enclosed a Site Plan showing those items. The
0.54 acres of wetlands need to be filled to make the site feasible for the proposed storm drainage
structures (shown on the Site Plan) and future buildings (not yet finalized). Please contact me if
you need any additional information.

DWQ Project #970682
On 1 August 1997 the Division of Water Quality (DWQ) was notified by receipt of
your application regarding your plan to fill 0.54 acres of wetlands for the purpose of
developing a residential/commercial site in Wilmington at US 421. Approval from DWQ is
required to disturb these wetlands. We received 7 copies of the application. However a
site plan was not included which would show why the wetlands need to be filled.
Similarly a stormwater pond will likely be needed for this project and it is unclear whether
this has been provided for in the site plan. In particular as described in 15A NCAC 2B
.0502, we will require you to locate all streams and ponds on the property. Please show
these on maps of suitable scale (for instance 1"=100 feet) so we can begin to determine
your projects' compliance with 15A NCAC 2H.0500.

Dear Mr. Simpson:
.The Division of Water Quality has reviewed your plans for the discharge of fill material into 0.54
acres of waters and/or wetlands located at U.S. 421 and Monkey Junction in New Hanover County for the
development of a commercial site. Based on this review, we have identified significant uses, which would
be removed by this project. These uses are water storage, and pollutant removal. Furthermore, insufficient
evidence is present in our files to conclude that your project must be built as planned in waters and/or
wetlands in accordance with 15A NCAC 2H.0506. Therefore, we are moving toward denial of your 401
Certification as required by 15A NCAC 2H.0507(e). Until we receive additional information, we are
requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of
Coastal Management place your project on administrative hold.
As was discussed by Mr. Eric Beek of my staff and by your engineer Mr. Mark Arcuri in a
10/15/97 phone conversation, new plats for phase III of this project are in the process of being submitted to
DWQ. After these new plats are received DWQ will be able to complete the 401 review. If we do not hear
from you in two weeks, we will assume that you no longer want to pursue this project and we will consider

4. The tract will be limited to the amount of built upon area indicated on page 3 of this permit, and per
approved plans.
5. Deed restrictions must be recorded prior to the sale of any outparcel or future area shown on the approved
plans to ensure that future owners are made aware of the built-upon area limitations. The following
statement must be recorded prior to the sale:
"TO erasure continued compliance with the NCDivision of Water Quality Stormwater Management
permit Regulations, 15A NCAC 2H.1000, the future area as shown on the approved plans for
phases 11 and IU is limited to a total of 43,385 square feet of built upon area, inclusive of that
portion of the right-of-way between the front lot line and the edge of the pavement, structures,
pavement, walkways of brick, stone, slate, but not including wood decking or the water surface
of swimming pools."

6. The permittee is responsible for verifying that the proposed built upon area does not exceed the allowable
built-upon area.
7. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership:
d. Redesign or addition to the approved amount of built upon area.
C. Rirftr subdivision of the project area.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
In addition, the Director may determine that other revisions to the project should require a modification
to the permit.
8. The Director may notify the permittee when the permitted site does not meet one or more of the minim=
requirements of the permit. Within the time frame specified, in the notice, the permittee shall submit a
written time schedule to the Director for modifyi the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director that the changes have been
made.

II. SCHEDULE OF COMPLIANCE

1. The permittee will comply with the following schedule for construction and maintenance of the stormwater
management system:
a. The stormwater management system shall be constructed in it's entirety, vegetated and operational
for it's intended use prior to the construction of any built upon surface except roads.
b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will
be repaired immediately .
c. All connections Kato the stormwater system from future areas/outpareels shall be made such that
short-circuiting of the system does not occur.
2. The permittee shall at all times provide the operations and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency. The approved Operation and Maintenance plan must
be followed in its entirety and maintenance roust or= at the scheduled intervals including, but not limited
to:
a. Semiannual scheduled inspections (every 6 montbs).
b. Sediment removal.
c. Mowing and revegetation of side slopes.
d. immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f, Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
g. Access to the outlet structure must be available at all times.
3. Records of maintenance activities must be kept and made available upon request to authorized personnel
of DWQ. The records will indicate the date, activity, name of person performing the work and what
actions were taken.
4. This permit shall become voidable unless the facilities are ooostructed in accordance with the conditions
of this permit, the approved plans and specifications, and other supporting data.
5. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation
of this pex nittod facility, a certification must be ne=ivcd from an appropriate designer for the system
installed certifying that the permitted facility has been installed in accordance with this permit, the
approved plans and specifications, and other supporting documentation. Any deviations from the
approved plans and specifications moist be noted on the Certification.
6. A copy of the recorded deed restrictions roust be submitted to the DWQ within 30 days of the date of the
recording. The recorded copy must be signed by the pet-inittee, dated, stamped with the deed book number
and page, and bear the stamp of the-Register of Deeds.
7. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a
minimum of ten years from the date of the completion of const motion.

8, Prior to the We of any portion of the property, an access/maintenance easement to the stormwater
facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted
by the sale of said portion of the property.
M. GENERAL CONDI'k`IONS
1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or
there is a name change of the Permittee, a formal permit request must be submitted to the Division of
Water Quality accompanied by an application fee, documentation from the parties involved, and other
supporting materials as may be appropriate. The approval of this request will be considered on its merits
and may or may not be approved.
2. Failure to abide by the conditions and .limitations contained in this pmt may subject the Permittee to
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute
143-215.6A to 143-215.60.
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes,
rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and
federal) which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions,
the Permiare shall take immediate corrective action, Including those as may be required by this Division,
such as the consttuctlon of additional or replacement stormwater management systems.
5. The permittee grants DERNR Staff permission to enter the property for the purpose of inspecting all
components of the permitted stormwater management facility.
4. The permit may be modified, revoked and reissued or terminated. for cause. The filing of a request for
a permit modification, revocation and =Issuance or termination does not stay any permit condition.

APPROVAL of 401 Water Quality Certification

Dear Mr. Simpson:
You have our approval, in accordance with the attached conditions, to place fill material in 0.54 acres of
wetlands or waters for the purpose of constructing a commercial development at US 421 at Monkey Junction,
as you described in your revised application dated August 26, 1997. After reviewing your application, we
have decided that this fill is covered by General Water Quality Certification Number 3108. This Certification
allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. In addition, you
should get any other federal, state or local permits before you go ahead with your project including (but not
limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed
regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless
otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed
in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
