8. PROJECT SUNMARY: The applicant proposes to recover saw-logs from the bottom of the
Northeast Cape Fear and possibly other rivers in order to utilize them in a speciality wood product
enterprise.

9. PROJECT DF,SCRrPTiON - The applicant proposes to recover saw-timber logs that have sunk
to the bottom of the Northeast Cape Fear River in various locations within the river. Most of
these sites are associated with historic saw mill locations which are no longer in operation.
According to the applicant there are several sites where these log resources can be found. The
logs are situated above or slightly imbedded within the bottom substrate. The applicant has
received a permit from the NC Department of Cultural Resources approving the activity. As a
requirement of the permit the applicant must provide information pertaining to the location of
areas containing sufficient quantities of logs to support a recovery operation. The logs will be
located and mapped by means of remote sensing equipment consisting of side scan sonar and GPS
technology. Upon locating the logs will be recovered by means of wrapped chain or by the
utilization of an orange peel grapple mounted on a barge. The logs will be taken to a high ground
site and off loaded and then milled into lumber.
10. ANTICIPATED PACTS - The applicant has indicated that the initial phase of the proposed
project will consist primarily of the recovery of logs that are now at or above the bottom of the
river. Ultimately the recovery activity may also include logs that are partially or totally covered
by bottom sediment. The mechanical removal of the initial logs appears to be borderline as to
whether it can be defined as development. We have exercised our authority to consider the
potential aspects of the proposal on coastal resources, in that the action has the possibility of
negative impacts through the elimination of bottom habitat as well as the generation of turbidities
and the release of sediment into the water column. Our experience with other activities of this
magnitude indicate that any disturbance will have a short term duration and will cause limited
localized disruptions. We have also advised the applicant that any future expansion of the
proposed recovery method will need to be reviewed prior to initiation of the change in operation.

The subject applicant is T. Vance Chamberlin. He proposes to
initially recover saw logs from the N.E. Cape Fear River which
are "now at or above the bottom of the river," and that
"ultimately the recovery activity may also include logs that are
partially or totally covered by bottom sediment." We are
concerned about the loss of bottom habitat by removal of not only
the desired saw logs but also by the potential removal of non-saw
(i.e. naturally deposited) logs. It seems likely that many of the
targeted saw logs could be confused with these similar NATURALLY
occurring logs. What assurance can he provide that he will not
remove ALL desirable logs encountered and not just limit his
recovery efforts to saw timber logs? If all the desirable logs
are removed from this area, whether they are saw timber or not,
it seems likely that an unacceptable loss of bottom habitat would
result. Also, in the application the estimated area to be
disturbed is listed as "potentially several acres". The applicant
needs to be more specific because if the recovery of saw timber
logs covers several miles of river then this office would object
to the project as proposed. Therefore the applicant needs to
provide a better estimate of the actual area to be disturbed.
In addition, this office would recommend a provision requiring
all recovered logs which are obviously not saw timber logs (e.g.
those which have limbs/branches) must be returned to the bottom.
