surveyed. The surveyed wetland lines must be verified by our staff before the Corps will make a final
iurisdictionaI determination on vour nronerty_
• Because of the size of your property and our present workload, our identification and delineation of your
wetlands cannot be accomplished in a timely manner. You may wish to employ a consultant to obtain a
more timely delineation of the wetlands. Once your consultant has flagged a wetland line on the property,
Corps staff will review it, and, if it is accurate, we strongly recommend that you have the line surveyed for
final approval by the Corps. The Corps will not make a final jurisdictional determination on your property
without an approved survey.
• The wetlands on your lot have been delineated, and the limits of Corps jurisdiction have been explained
to you. Unless there is a change in the law or our published regulations, this determination may be relied
upon for a period not to exceed three years from the date of this notification.
• There are no wetlands present on the above described property which are subject to the permit
requirements of Section 404 of the Clean Water Act (33 USC 1344). Unless there is a change in the law
or our published regulations, this determination may be relied upon for a period not to exceed three years
from the date of this notification.
• The project is located in one of the 20 Coastal Counties. You should contact the nearest State Office of
Coastal Management to determine their requirements.
Placement of dredged or fill material in wetlands on this property without a Department of the Army
permit is in most cases a violation of Section 301 of the Clean Water Act (33 USC 1311). A permit is
not required for work on the property restricted entirely to existing high ground. If you have any
questions regarding the Corps of Engineers regulatory program, please contact

ADDITIONAL
You have our approval, in accordance with the attached conditions and those
listed below, to impact 350 feet of streams for the purpose of constructing a
warehouse/distribution facility at Metromont Industrial Park, as you described in
your application dated July 8, 1997. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number
3108. This certification allows you to use Nationwide Permit Number 26 when it is
issued by the Corps of Engineers. In addition, you should get any other federal,
state or local permits before you go ahead with your project including (but not
limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and
Water Supply Watershed regulations. This approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the
General Certification. This Certification replaces one issued on August 19,1997.
This approval is only valid for the purpose and design that you described in
your application except as modified below. If you change your project, you must
notify us and you may be required to send us a new application. If total wetland
fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7).
For this approval to be valid, you must follow the conditions listed in the attached
certification and any additional conditions listed below.
1. Deed restrictions, conservation easements or similar mechanisms shall be placed

You have our approval, in accordance with the attached conditions and those listed below, to impact
350 feet of streams for the purpose of constructing a warehouse/distribution facility at Metromont
Industrial Park, as you described in your application dated 8 July 1997. After reviewing your application,
we have decided that this fill is covered by General Water Quality Certification Number 3108. This
certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers.
In addition, you should get any other federal, state or local permits before you go ahead with your project
including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and
Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA
permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except
as modified below. If you change your project, you must notify us and you may be required to send us a
new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be
valid, you must follow the conditions listed in the attached certification and any additional conditions listed
below.

Dear Mr. Lund:
On behalf of The Keith Corporation of Charlotte, enclosed please find a completed Joint Form with
accompanying figures for a Nationwide Permit #26 in the above referenced matter. The Keith Corporation has
retained Law Engineering and Environmental Services, Inc. (LAW) to provide wetlands and permitting services
for this project. The project area is located in Mecklenburg County, just north of the Charlotte city limits. The
site location is presented on Figure 1. The proposed project will impact more than 150 linear feet of an above-
the-headwaters stream located on the subject site. This pre-construction notification (PCN) is being provided in
accordance with the Wilmington District's regional conditions for Nationwide Permit #26.
The project consists of the construction of a warehouse/distribution facility on an approximate 11.5-acre site in
the Metromont Industrial Park. The proposed project will include a single-story 60,000 square-foot building,
including an estimated 8,000 square feet of office space, loading docks, parking for 41 automobiles, and a
proposed future parking area. In order to achieve the project goals, the facility must include a graveled outdoor
storage yard of 3 acres (Note: outdoor storage will be provided for `clean' product and materials, e.g., piping,
etc.). The facility will front Metromont Industrial Boulevard. Access for tractor trailers will be provided from
the southeast comer of the site via Metromont Industrial Boulevard as well as from Metromont Parkway. The
proposed project will provide economic benefits and employment opportunities to Mecklenburg County.
The southem-third of the subject site is separated from the proposed building by Dixon Branch (East). This
above-the-headwaters stream flows west across the site for a distance of approximately 850 feet. The stream
enters the southeastern corner of the site from three existing reinforced concrete pipes (RCP's). Two of these
RCP's route storm water from facilities on the opposite side of Metromont Industrial Boulevard, while the third
RCP transmits the flow of the upper reaches of the branch. Dixon Branch (East) is a Class C stream from its
source to its confluence with Long Creek. The confluence with Long Creek is located approximately 1,000 feet
northwest of the subject site.

The operations at the proposed facility, notably the critical need to move product from the outdoor storage yard
into the rear (southwest end) of the building, as well as the proposed grading plan, will result in the relocation of
approximately 350 linear feet of Dixon Branch (East). These unavoidable impacts will include the piping of
approximately 250 linear feet of the stream in order to provide tractor trailer access to the storage yard and to
accommodate grading of the site. The remaining approximately 100 linear feet of stream disturbance will occur
downstream of the proposed pipe. This portion of the relocation will connect the piped portion of the stream
with the existing channel.
Efforts to minimize impacts. to the stream included a redesign of the site plan. The Original Site Plan called for
proposed frontage along Metromont Parkway (Figure 3). This site plan would have resulted in approximately
450 linear feet of disturbance to Dixon Branch (East), including an estimated 300 linear feet of piping and 150
linear feet of relocation. In both the original and proposed site plans, the Metromont Industrial Boulevard
access driveway was relocated to the north, thereby avoiding potential disturbance to the first 200+ linear feet of
stream. All efforts have been made in the proposed site plan to position the building as far north on the site, and
away from the stream, as possible. The loading docks must be positioned along the north side of the building in
order to allow product to effectively pass through the building from the southwest corner and outdoor storage
yard to the docking area. The proposed site plan depicted on Figure 2 represents the absolute minimum
requirements for stream disturbance while still achieving the operational goals of the facility.
Opportunities for on-site mitigation to compensate for the project's anticipated stream disturbance are limited.
The existing stream corridor is deeply incised and heavily wooded. The existing stream channel varies in width
from 4 to 12 feet, typically 8 feet on average, across the bed of the stream, with a substrate characterized by rock
and sand. The applicant considered the installation of in-stream aquatic habitat improvement structures, e.g.,
boulder clusters, vortex rock weirs, deflectors, etc., and other mitigation measures, to compensate for project
impacts. However, the short term impacts to the stream associated with attempts to gain access to the
undisturbed stream channel for the purposes of installing these measures will likely outweigh the long term
benefits. As a result, and in an effort to expedite PCN processing and maintain critical project schedules, the
applicant desires to utilize the N.C. Wetland Restoration Program as compensatory mitigation for this project.
The applicant is prepared to immediately issue a check payable to the Wetland Restoration Fund (WRF) in the Qk•
amount of $125 per linear foot or $25,000 to compensate for the 200 linear feet of stream above the 150 linear
foot PCN threshold.
Wetland delineation's were performed on the subject property by LAW's Jeffrey M. Holland and Stacie L.
Edwards on June 18, 1997. No jurisdictional wetland areas occur on the subject property. Jurisdictional limits
of waters of the U.S. include the bed and bank of Dixon Branch (East). The limits of these jurisdictional areas

are presented on the topographic survey presented on Figure 4. Mr. Steve Chapin of your office issued a
"Notification of Jurisdictional Determination" on June 25, 1997, concurring with LAW's findings (copy
attached).
A storm water management plan has been included as part of the project. In an effort to greatly reduce run-off
from the proposed development, the outdoor storage yard will be pervious, i.e., graveled. A storm water
detention basin is currently proposed along the western edge of the property in order to meet Mecklenburg
County storm water requirements. Any questions concerning Mecklenburg County's storm water requirements

Pursuant to the conditions of the Section 401 General Certification (GC) for projects eligible for NWP 926,
seven copies of this PCN have been forwarded to Mr. John Domey and the Division of Water Quality for their
written concurrence. All nationwide and regional conditions for NWP #26 will be met by The Keith
Corporation's design and adhered to by their contractors.
