PROJECT SUMMARY: The applicants propose to develop a subdivision consisting of 10 single-family residential lots, on a 23 acre tract within the existing Landfall development. The proposal includes a community pier and docking facility, consisting of 10 boat slips. Landfall Associates Horseshoe Lake Page 2 9. PROTECT DESCRIPTION The project site is a 23 acre tract within an existing development known as Landfall. Landfall is an ongoing large-scale project, which includes golf courses, both single-family and multi-family residential, and commercial development. Landfall is located on the mainland side of the Atlantic Intracoastal Waterway (AIWW), near Wrightsville Beach, north of Eastwood Road and east of Military Cutoff. The proposed project, Landfall II, Block 46, is located within the tract at the end of Pembroke Jones Drive. The site consists of an island-like area of highground surrounded by the existing, U- shaped, Horseshoe Lake. A new wooden bridge over the southern arm of the lake, accesses the area. There are narrow dams at both ends of the lake, adjacent to the AIWW, and a spillway pipe through the southern dam discharges to the AIWW. The elevation of the property rises sharply from the AIWW to 14-18 feet mean sea level. The tract is wooded, primarily Live Oaks, and the underbrush has been cleared and mowed. Adjacent to the AIWW shoreline there is a border of coastal wetlands, approximately 250 feet wide. This marsh border is predominantly smooth cordgrass S artina alterniflora). Other high coastal marsh plants intermix into the vegetation at the transition to highground. Species observed include: cattails T ha, spp.), saw grass (Caldium jamaicense), spike grass istichlis icata , sea oxeye (Borrichia frutescens), salt meadow grass (Spartina patens), and shrubs, marsh elder (Iva frutescens), and grounsel-bush (Baccharus halimifoli a). The AIWW is approximately 600 feet wide in the project area. It is classified as SA by the NC Division of Water Quality, and is CLOSED to the harvest of shellfish. The area is not a designated primary nursery area (PNA) by the NC Division of Marine Fisheries. The applicants propose to develop a subdivision, consisting of ten single-family residential lots. Lots 1-7 would be located on the island, oriented around a cul-de-sac accessed from the existing bridge. Lots 8, 9, and 10, would be annexed into Block 46 from an existing section of Landfall I, at the end of Harborway Place which is located adjacent to the north side of Horseshoe Lake. The lots average 103,000 square feet, including a conservation and pedestrian access easements which extend into the adjacent lake and along the shoreline of the AIWW. The,highground area of each lot averages 51,000 square feet. The applicants propose a common pier and boat docking facility for the subdivision. The fixed pier would extend into the AIWW from the northern dam area of the lake. It would be 335 feet long and 6 feet wide. At the end of the pier there would be a fixed platform, 66 feet by 30 feet, consisting of a gazebo (30 ft. X 30 ft.), and an open deck (36 ft. X 30 ft). Waterward of the fixed platform and parallel to the waterway, would be a floating dock, 190 feet long and 6 feet wide. Five finger docks 32 feet long and 6 feet wide would create 10 boat slips. Each slip would include a boadift. Six mooring pilings would complete the docking facilities. The applicants propose to dredge a basin around the docking facility, 230 feet long, 150 feet wide, and 4.5 feet deep at mean low water (see sheet 2). The work would be completed by hydraulic dredging, and the excavated material would be placed in a diked area on Lots 8, 9, and 10. This area is currently being used as a spoil disposal are in conjunction with ongoing dredging work in Horseshoe and other inland lakes. 10. ANTICIPATED IMPACTS The proposed pier and docking structure would incorporate 9200 square feet of Estaurine and Public Trust Waters. During the construction of the pier, there would be some trampling of marsh vegetation r Landfall Associates Horseshoe Lake Page 3 along the alignment of the walkway and some short-term turbidity associated with the installation of pilings. The pier walkway would shade approximately. 2010 square feet of coastal wetlands. The proposed dredging activity would disturb approximately 31,500 square feet of shallow water bottom. There would be some short-term turbidity associated with the dredging activity, and approximately 3,500 cubic yards of spoil material would generated from the open water basin excavation. This material would be deposited over a 156,400 square feet (3.6 acres) highground disposal site (Lots 8, 9, & 10). As these lots will subsequently be developed, the applicants have no designated area for future maintenance of the boat basin. The installation of the proposed utility extensions and cul-de-sac would disturb approximately 14,700 square feet of highground area. Additional soil disturbance and creation of impervious surface area would occur with the subsequent construction of single-family houses, by individual lot owners. Submitted by: E.F. The platform will consist of a 30' x 30' covered gazebo and a 36' x 30' open deck. A 20' long by 8' wide hinged ramp will connect the fixed structures to the floating platforms. The floating structure will consist of a 190' long x 8' wide platform parallel to the waterway with five 32' long x 6' wide finger docks. Each slip will have four pilings to support the boat lifts. The plans call for the installation of approximately 5,900 feet of a-inch and 2,190 feet of 4-inch water mains, valves, hydrants and other appurtenances along Harborway Place, Planters Row, Sun Runner Drive, Deer Island Lane, Sandwedge Place, Pelican Reach Place and Spotted Hawk Court to provide to Landfill Subdivision II, Blocks 4, 18, 24, 27 and 28 with 62 lots. These plans and specifications are approved under Division of Environmental Health serial number 96-10939, dated February 15, 1996. Public water system rules require that a registered professional engineer verify that construction has been completed in accordance with these approved plans and specifications. In order to complete the approval of this water main extension, please furnish us a copy of the engineer's verification affixed with his/her professional engineering seal immediately upon completion of construction. Customer connections shall not be made until the construction verification letter is received by this office. One copy of the "Application for Approval..." is enclosed together with one copy of the plans and specifications bearing the Division of Environmental Health stamp of approval. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2. The facilities must be properly maintained and operated at all times. 4. The sewage and wastewater collected by this system shall be treated in the City of Wilmington's M'Kean. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 11. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Pernnittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement wastewater collection facilities. 12. Noncompliance Notification: The Permittee shall report by telephone to the Wilmington Regional Office, telephone number (910) 395-3900, as soon as possible, but in no case more than 24 hours or on the next working day, following the occurrence or first knowledge of the occurrence of either of the following: a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate wastewater transport, such as mechanical or electrical failures of pumps, line blockage or breakage, etc.; or b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. Persons reporting such occurrences by telephone shall also file a written report in letter form within 15 days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. 13. This permit shall become voidable unless the agreement between the New Hanover County Water and Sewer District and the City of Wilmington for the collection and final treatment of. wastewater is in full force and effect. 14. PROJECT SITIVIMARY: The applicants propose to develop a subdivision consisting of 10 single-family residential lots, on a 23 acre tract within the existing Landfall development. The proposal includes a ,community pier and docking facility, consisting of 10 boat slips. r Landfall Associates Horseshoe Lake Page 2 9. PROTECT DESCRIPTION The project site is a 23 acre tract within an existing development known as landfall. Landfall is an ongoing large-scale project, which includes golf courses, both -single-family and multi family residential, and commercial development. Landfall is located on the mainland side of the Atlantic Intracoastal Waterway (AIWW), near Wrightsville Beach, north of Eastwood Road and east of Military Cutoff. The proposed project, Landfall II, Block 46, is located within the tract at the end of Pembroke Jones Drive. The site consists of an island-like area of highground surrounded by the existing, U- shaped, Horseshoe Lake. A new wooden bridge over the southern arm of the lake, accesses the area. There are narrow dams at both ends of the lake, adjacent to the AIWW, and a spillway pipe through the southern dam discharges to the AIWW. The elevation of the property rises sharply from the A.IWW to 14-18 feet mean sea level. The tract is wooded, primarily Live. Oaks, and the underbrush has been cleared and mowed. Adjacent to the AIWW shoreline there is a border of coastal. wetlands, approximately 250 feet wide. This marsh border is predominantly' smooth cordgrass S artina alterniflora). Other high coastal marsh plants intermix into the vegetation at the transition to highground. Species observed include: cattails (pTha, spp.), saw grass (Caldium jamazcene), spike grass istichlis icata , sea oxeye (Borrichia frutescens), salt meadow grass (Spartina patens), and shrubs, marsh elder (Iva frutescens), and grounsel-bush (Bacchants halimifolia). The AIWW is approximately 600 feet wide in the project area. It is classified as.SA by the NC Division of Water Quality, and is CLOSED to the harvest of shellfish. The area is not a designated primary nursery area (PNA) by the NC Division of Marine Fisheries. The applicants propose to develop a subdivision, consisting of ten single-family residential lots. Lots 1-7 would be located on the island, oriented around a cul-de-sac accessed from the existing bridge. Lots 8, 9, and 10, would be annexed into Block 46 from an existing section of Landfall I, at the end of Harborway Place which is located adjacent to the north side of Horseshoe Lake. The lots average 103,000 square feet, including a conservation and pedestrian access easements which extend into the adjacent lake and along the shoreline of the AIWW. Thejhighground area of each lot averages 51,000 square feet. The applicants propose a common pier and boat docking facility for the subdivision. The fixed pier would extend into the AIWW from the northern dam area of the lake. It would be 335 feet long and 6 feet wide. At the end of the pier there would be a fixed platform,- 66 feet by 30 feet, consisting of a gazebo (30 ft. X 30 ft.), and an open deck (36 ft. X 30 ft). Waterward of the fixed platform and parallel to the waterway, would be a floating dock, 190 feet long and 6 feet wide. Five finger docks 32 feet long and 6 feet wide would create 10 boat slips. Each slip would include a boatlift. Six mooring pilings would complete the docking facilities. The applicants propose to dredge a basin around the docking facility, 230 feet long, 150 feet wide, and 4.5 feet deep-at mean low water (see sheet 2). The work would be completed by hydraulic dredging, and the excavated material would be placed in a diked area on Lots 8, 9, and 10. This area is currently being used as a spoil disposal are in conjunction with ongoing dredging work in Horseshoe and other inland lakes. lfl. ANTICIPATEDE"FACTS The proposed pier and docking structure would incorporate 9200 square feet of Estaurine and Public Trust Waters. During the construction of the pier, there would be some trampling of marsh vegetation Landfall Associates Horseshoe Lake Page 3 along the alignment of the walkway and some short-term turbidity associated with the installation of pilings. The pier walkway would shade approximately. 2010 square feet of coastal wetlands. The proposed dredging activity would disturb approximately 31,500 square feet of shallow water bottom. There would be some short-term turbidity associated with the dredging activity, and approximately 3,500 cubic yards of spoil material would generated from the open water basin excavation. This material would be deposited over a 156,400 square feet (3.6 acres) highground disposal site (Lots 8, 9, & 10). As these lots will subsequently be developed, the applicants have no designated area for future maintenance of the boat basin. The installation of the proposed utility extensions and cul-de-sac would disturb approximately 14,700 square feet of highground area. Upon completion of construction, prior to issuance of a Certificate of occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 8. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of the recording. The recorded copy must be signed by the permittee, dated, stamped with the deed book number and page, and bear the stamp of the Register of Deeds. 9. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. M. GENERAL CONDITIONS 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request form must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6(a) to 143-215.6(c). 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. The County Commissioners FIND AS A FACT that all of the specific requirements set forth in Section 72-37 of the County Zoning Ordinance WILL be satisfied if the property is developed in accordance with the plans submitted to the County Commissioners. 2. It is the County Commissioners' CONCLUSION that the proposed use DOES satisfy the first general requirement listed in the Ordinance; namely that the use will not materially endanger the public health or safety if located where proposed and developed according to the plan as submitted and approved. In support of this conclusion, the Commissioners make the following FINDINGS OF FACT: A The facility does not require water and sewer service, though it is fairly common to provide water service to wash down boats and equipment. B. The site is located in the Seagate Volunteer Fire Department District. C. Pedestrian access is available from the adjacent subdivision. D. The pier and docks are sited such that interference to navigation along the waterway is avoided. 3. It is the County Commissioners' CONCLUSION that the proposed use DOES satisfy the second general requirement listed in the Ordinance; namely that the use meets all required conditions and specifications. In support of this conclusion, the Commissioners make the following FINDINGS OF FACT: A Community boating facilities are permitted by special use permit in the R-20 Residential District. The site is zoned R-20. B. The right to use the facility will be conferred by an access easement appurtenant to each lot of the residential development. (NOTE: Approval of a preliminary plan for a ten (10) subdivision adjacent to the facility is pending-three of the lots have already been recorded. C. Instead of providing a separate off-street parking lot, the applicant proposes that parking be provided at each individual residence. A total of ten parking spaces is required. D. A CAMA permit will not be issued for construction if it is determined that the project will have significant impacts on water quality, shellfish grounds or conservation resources. In support of this conclusion, the Commissioners make the following FINDINGS OF FACT: A. The Land Use Plan prohibits general development in conservation resources areas such as salt marshes. However, the Plan encourages water dependent uses, including piers, ramps, and boating access provided important natural resources are not severely impacted. B. The establishment of these types of facilities is common all along the Intracoastal Waterway. 6. Therefore, because the County Commissioners conclude that all of the general and specific conditions precedent to the issuance of a SPECIAL USE PERMIT HAVE been satisfied, IT IS ORDERED that-the application for the issuance of a SPECIAL USE PERMIT BE GRANTED, subject to the following conditions: A That the applicant shall fully comply with all of the specific requirements stated in the Ordinance for the proposed use, as well as any additional conditions hereinafter stated.
