PROJECT D S EIPTI - The project site. is located at 1706 Lumina Avenue in Wrightsville Beach, New Hanover. The site is adjacent to the Atlantic Ocean and has an existing bulkhead along the shoreline. The site was impacted by the Hurricanes of 1996 and especially by Hurricane Fran. The result of the storm was that the building was damaged to an extent. greater than 50% of the value so that it is necessary to replace it with a new structure rather than repairing what was existing. At present the remains of all existing construction has been demolished and removed from the site. The existing site grade is approximately 8.5' MSL. This project is located within flood insurance rate map zones V-13. and A-10': It appears that the structure will be inside the A-10 zone. There is an existing bulkhead on the property which was slightly damaged by Fran but which has been repaired. This feature is used to determine the setback distance on the property.. This site is: within" the ongoing U S Army Corps of Engineers Wrightsville Beach Hurricane Protection Project and has been renourished several times since the 1980's. There is "a regional public access site located just north of the site and a high-rise condominium unit located along the southern property line. The existing site had been issued State permit # 135-94 in late 1994 in order to carry out maintenance of the then existing structures and the expansion of a portion of the commercial (office and restaurant). aspect of the operation. The parking lot was. also enlarged. The current setback for structures located on this property in excess of 5000 square feet is 120' based on the LTAAER of 2'/year for this site. The landward measurement of this setback begins at the face of the existing bulkhead.. This area is classified as Developed in the Wrightsville Beach Land Use Plan. A Sedimentation/Erosion Control plan from the NC Division of Land Quality is required and has been applied for as well. as a Stormwater Certification from the NC Division of Water Quality. The waters of the Atlantic Ocean are classified as SB by the Division of Water Quality. The applicant is proposing to replace the former structure with a. high-rise building which will have a total of 196 guest rooms; enclosed parking; and Level 3 which will include the main lobby, restaurant, banquet and `meeting spaces, administrative offices and facilities for food services and housekeeping. As a part of the' site preparation the existing damage building has been removed-from the property..: Addition-fill material will be` used to raise the elevation of the street side of the site to an undetermined elevation in excess of 13' MSL. The multipurpose portion of the structure will be located on the fill area. _ Access to the primary parking area will be by means of ramps. There will be approximately 33 spaces located along the north, west ans south property lines. The guest room tower is proposed to be located landward of the 120' setback as measured from the face of the existing bulkhead. The height of the structure is shown as 91.28 feet which is less than the 96 feet allowance by local ordinance. Inside the setback the applicant is proposing to locate a swimming pool and two Jacuzzi tubs. These features will be surrounded by concrete aprons as required by local health laws and will be interconnected by wooden decks and walkways. Several landscaped areas will also be interspersed within the area. As part of the beach access the applicant is proposing to utilize two PVC, Inc (Holiday Inn Sunspree Resort) Page 3 gazebos located at either end of the ocean shoreline of the property. These will connect to walkways which will cross the existing bulkhead which the applicant is proposing to cover over with -a sand berm that t will blend in to the Corps of Engineers renourishment project beach profile. (See sheet 6 of 7). 10. ANTICIPATED IMPACTS - The Town of Wrightsville Beach informed this office on June 3, 1997 that the proposed project must obtain a Conditional Use Permit before the project can be considered to be in compliance with the Town's zoning regulations. The recently adopted density standards by the Town for the project site do not support the increase in density which the proposed project requests. The project failed to obtain approval during a public hearing meeting held on June 12, 1997. No matter what the final disposition of the zoning issue takes the Land Use Plan still 'contains the concern regarding increased density. The area within the setback as now proposed is covered to the extent necessary to provide recreational access to that portion of the property. This area was originally covered by building and paved parking with very little undeveloped buffer. Submitted by: C. The new structure will be set back 120' from the first line of vegetation.. The site will be filled generally to elevation 12.00 MSL. This level of the project will be utilized for parking and a swimming pool. The entrance to the hotel will be at level 2 elevation 22.00 MSL accessed by vehicular ramp. The motor lobby is at this level with elevator and stair access to level 3 main lobby but the balance of the area within the building footprint at level 2 is utilized for parking and mechanical equipment. Level 3 - elevation 32.00 MSL contains the main lobby, restaurant, banquet and meeting spaces, administrative offices, and facilities for food service and housekeeping. All commercial spaces are at level 3. Levels 4 through 9 are guest room floors. The hotel is designed to serve 196 rooms. The first guest room floor is, at elevation 47.00 MSL. Water and sewer service will be provided by the Town of Wrightsville Beach from existing mains in the North Lumina - Highway 74 frontage. Access to this hotel will be from North Lumina Avenue - US Highway 74. Service access will be from the Wrightsville Beach public access and parking lot that adjoins the north boundary of this site. This site is in Wrightsville Beach Zoning District IV. The project complies with all requirements of the Zoning Ordinance and the North Carolina Building Code. This site has been occupied by a hotel since 1970. There are no "404" wetlands present. The rules of the Coastal Resources Commission require that you receive an AEC Hazard Notice and acknowledge that notice in writing before a permit for development can be issued. The Commission's rules on building standards, oceanfront setbacks and dune alteration are designed to minimize,but not eliminate, property loss from hazards. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual ocean erosion rate for the area where your property is located is 2 feet per year. The rate was established by careful analysis of aerial photographs of the coastline taken over the past 50 years. Studies also indicate that the shoreline could move as much as 300 feet landward in a major storm. The flood waters in a major storm are predicted to be about F -,7 feet deep in this area. Preferred oceanfront protection measures are beach nourishment and relocation of threatened structures. Hard erosion control structures such as bulkheads, seawalls, revetinents, groins, jetties and breakwaters are prohibited. Temporary devices, including sand bags, may be allowed under certain conditions. This structure shall be relocated or dismantled within two years of becoming imminently threatened. The applicant must acknowledge this information and requirements by signing this notice in the below space. Without the proper signature, the application will not be complete. Permits issued for development in th is area expire on December 31 of the third year following the year in which the permit was issued. Shortly before work begins on the project site, the Local Permit Officer will determine the veget4tionline and setback distance at your site. If the property has seen little change and the proposed development can still meet the setback require_ncnt, the LPO will inform you that you may begin work. It is impor- tant that you check with the LPO before the permit expires for official approval to continue the work after the permit has expired. Generally, if foundation pilings have been placed and substantial progress is continuing, permit renewal may not be necessary. If substantial progress has not been made, the permit must be renewed and a new setback line established. It is unlawful to continue work after permit expiration without this approval. Natural forces of water and wind collide with tons of force, even on calm days. Man-made structures cannot be guaranteed to survive the force of a hurricane. Long-term erosion (or barrier island migration) may take from two to ten feet of the beach each year and, sooner or later, will threaten oceanfront struc- tures. These are the facts of life for oceanfront property owners. The Coastal Resources Commission (CRC) has adopted rules for building along the oceanfront. The rules are in- tended to avoid an unreasonable risk to life and property and to limit public and private losses from storms and long-term erosion. These rules lessen but do not eliminate the element of risk in oceanfront development. As you consider building along the oceanfront, the CRC wants you to understand the rules and the risks. With this knowledge you can make a more informed decision about where and how to build in the coastal area. The Rules When you build along the oceanfront, coastal manage- ment rules require that the structure be sited to fit safely into the beach environment. Structures along the oceanfront must be behind the frontal dune, landward of the crest of the primary dune and set back from the first line of natural stable vegetation a dis- tance equal to 30 times the annual erosion rate (a minimum of 60 feet). If the erosion rate is greater than 3.5 feet/year, the setback is 30 times the erosion rate plus 105 feet. The Reasons The beachfront is an ever-changing landform. The beach and the dunes are natural "shock absorbers", taking the beatings of the winds and waves and protecting the inland areas. By setting back 30 or 60 times the annual long-term erosion rate, you have a good chance of enjoying the full life of the structure. At first, it seems very inviting to build your dream house as dose to the beach as possible, but in five years you could find the dream has become a nightmare as high tides and storm tides threaten your investment. The Exception The Coastal Resources Commission recognized that these rules, initially passed in June of 1979, might prove a hardship for some property owners. Therefore, they estab- lished an exce,3tion for lots which cannot meet the setback requirement. The exception allows buildings infront of the setback line if the following conditions apply: (1) the lot must have been platted as of June 1, 1979, and not capable of being enlarged by combining with adjoining land under the same ownership, (2) development must be as far back on the property as possible and in no case less than 60 feet landward of the vegetation line, (3) no development can take place on the frontal dune (4) special construction standards on piling depth and square footage must be met and (5) all other CA_VIA, state and local regulations must be met. The exception is not available in the Inlet Hazard Area. COASTAL MANAGEMENT In accordance with the earlier taped telephone message that I left on your voice mail, this correspondence represents the Town of Wrightsville Beach's response to the proposed Major CAMA Permit Application filed on the behalf of the Holiday Inn Sunspree Resort by Mr. Robert Sawyer of BMS Architects, PC. As an adjacent property owner we have received written notification of the permit application and a request that we return the form to you indicating no objection to the project. We cannot honor that request. The Town of Wrightsville B each must object to the issuance of the CAMA Major Permit until such time as the issue regarding the conformity of the project to the Town's Zoning Ordinance has been resolved. We raise this objection because the applicant's description of the project (as provided to us) indicates that the project is compliant with local zoning regulations. For this particular type of project, a Conditional Use Permit must be issued by the Wrightsville Beach Board of Aldermen before the project maybe considered to be compliant with the zoning regulations. A Conditional Use Permit for this project has not yet been issued. A request for the requisite permit is scheduled for consideration at a public hearing on June 12, 1997. The plan, as originally and currently proposed, is not in compliance with the newly adopted density standards for the zoning district in which the property is located. You should also note that even if the proposed development plans are revised to conform with the density standards, the revisions will be subjected to the same Conditional Use Permit review process as the original plans and that there are no guarantees that any revisions intended to address the density issue will be sufficient to obtain the requisite permit. Until a Town issued Conditional Use Permit is obtained by the applicant, the project cannot be considered to be in compliance with the Town's Zoning. Ordinance. We have another concern relating to the density of the proposed development. We have previously requested that the applicant provide us with an accurate survey depicting the current mean high water mark Our concernis that some of the property set forth in the deed for the site lies below the mean high water mark thereby negating its utility for determination of area available for development and, subsequently, density calcuiations. We have requested this information and are awaiting their response. Based upon these considerations, the Town of Wrightsville Beach must object to the issuance of the requested Major CAMA Permit for the Holiday Inn Sunspree Resort.
