PROTECT DESCRIPTION The project site is located at 719 Canal Drive, in Carolina Beach, NC, in New Hanover County. The property is an undeveloped residential lot on the east side of Carolina Beach Yacht Basin. The lot is 50 feet wide and approximately 100 feet deep from Canal Drive. The highground is cleared and maintained as a lawn. There is an old pier in the northwest corner of the lot, and an unimproved boat launching area in the southwest corner. There is also a subsurface drainpipe on the property which discharges stormwater from the street into the basin. Along the west side of the lot, adjacent to the water, there is a border of coastal wetlands, approximately 60 feet wide. The waterward side of the wetlands consists of smooth cordgrass (Spartina alterniflora). Proceeding landward, the vegetation transitions to high coastal marsh, consisting of sea oxeye (Borrichia frutescens), salt meadow grass (Spartina patens ), marsh elder (Iva frutescens), and grounsel-bush (Baccharus halimifolia). The landward limits of the wetlands have been delineated by State and federal field staff as shown on the attached project drawing. The waterfront of the adjacent residential property to the south is stabilized by an existing bulkhead. There is an unimproved street right-of-way on the north side of the lot, on which, there is a lift station for the Town's sewer system. The elevation of the lot is 3 1h - 4 feet mean sea level. The Carolina Beach Yacht Basin is approximately 545 feet wide in the project area. It is classified as SB by the NC Division of Water Quality, and is CLOSED to the harvest of shellfish. The basin is not a designated primary nursery area (PNA) by the NC Division of Marine Fisheries. The applicant proposes to construct a bulkhead along the west side of the property and backfill the lot to raise the elevation to that of adjacent property. The proposed bulkhead placement is to continue the alignment of the wall from the adjacent property, or approximately 72 feet from the street right-of-way. The applicant proposes to remove the old pier from the property and construct a new one. The pier would extend from the northwest corner of the lot, 58 feet long and 6 feet wide. It would terminate with a 13 feet by 13 feet L-head platform. An L-shaped floating dock would be constructed to the south of the pier, one section parallel to the shoreline, 24 feet long and 8 feet wide. The other section would be 20 feet long and 6 feet wide, and would create a central access dock between 5 mooring pilings that would allow mooring for two boats. The applicant proposes to excavate the mooring area (30 feet X 35 feet) to a depth of -6 feet at mean low water. This excavation would be completed by a barge mounted mechanical excavator. The excavated material would be placed on the lot and subsequently used as part of the backfill behind the new bulkhead. 10. ANTICIPATED IMPACTS The construction of the pier L-head and floating docks would incorporate 481 square feet of Estaurine Waters and Public Trust Area. The proposed boat basin excavation would disturb 1050iquare feet of shallow water bottom, and create approximately 100 cubic yards of spoil material. The proposed bulkhead alignment would incorporate 131 square feet of marginally active coastal and "404 type" wetlands, consisting of Snartina an tens, Iva frutescens, and Baccharis halimifolia. The placement of fill material on the lot, landward of the proposed bulkhead, would disturb a highground area of 3850 square feet. Lattner 11901 Aspenwald Dr. Raleigh NC 27614 Date: Saturday, March 29, 1997 Subject: Permit request for 719 Canal Dr. Carolina Beach, North Carolina PROJECT DESCRIPTION Currently - 719 canal is an unimproved vacant lot OVERVIEW The desired end result of this project is: To have an L shaped f Zoating dock with two boat slips, average depth of 6' at ML W, raised platform which connects to the dock with a 6' wide walkway connecting the platform to the new bulkhead, 50' bulkhead to protect the wetlands, lot raised 18" to reduce erosion. PLAN Dre in Dredging will be accomplished by utilizing hydraulic clam shell situated on a 100' barge. Excavated material will be deposited first on the barge. The dredging would extend current 6'MLW depth to a 30'x35' adjoining area. This additional "basin" would allow construction of 2 slips with an average depth of 6' at MLW. Spoils Deposit The spoils resulting from dredging will be deposited on the lot at 719 Canal Drive, Carolina Beach, North Carolina. The spoils will be initially deposited on the contractors barge. Upon completion of the dredging, the contractor will utilize a 40'ramp to allow transition of the spoilsfrom the barge to the lot. The ramp will span from the barge to an existing "boat ramp" through the grass. This existing ramp is and opening through the grass which exits due to its repeated use by the previous owner to launch boats. This opening is primarily sand and does not contain marsh grass. A skip loader will load on the barge, move down the ramp from the barge and access high ground via the boat ramp. Spoils will be deposited on high ground in the manner and will cause minimal wear and tear on the designate wet lands. Bulkhead After spoils have been deposited on the high ground. a bulkhead will be constructed. This bulkhead will run north and south across the 50' width of the property. The bulkhead will be built in a position to "continue" the bulkhead already in existence on the southern adjoining lot owned by Mr. and Mrs. John Lawing. The bulkhead construction will provide, in conjunction with the aforementioned bulkhead to the south and the bulkhead in existence on the city of Carolina Beach property on the north, an effective barrier to erosion and runoff. Fill Upon completion of the bulkhead the spoils previously deposited will be spread on the high ground behind the bulkhead evenly. This fill is necessary to raise the elevation of the lot to an approximate level with the adjoining lots on the south and north sides. This lots lower elevation and lack of bulkhead exaggerates high tide and heavy rain runoff. Construction of the bulkhead and back- fill will provide a deterrent to further erosion. Structure A structure to provide two boat slips will be constructed From the bulkhead, a walkway 6' wide constructed of pressure treated lumber will run to a 13'x13' platform. This platform also constructed of pressure treated lumber will begin at MLW and extend out 13' over the water. An L shaped f loating dock will be constructed of treated lumber and molded floats. These floats are constructed of a plastic material which will not deteriorate andare impervious to the elements. The dock will consist of an 8'x24' main dock. running parallel to the shoreline and a f finger dock 6'x20'. All hardware is specially treated for the marine environment and the docks will be connected to each other via pin and ear arrangement to allow articulation. Pilings will be placed at the south end of the main dock, the west end of the f finger itock and on the east side of the main dock in a direct line with the piling at the end of the f finger. Access to the floating dock will be via a ramp from the south side of the platform. Pilings As stated, 3 pilings will be installed as part of the f loating dock. In addition, mooring pilings will be installed, These mooring pilings will consist of a piling at the juncture of the north lot line and the headline and a piling at the intersection of the north lot line and a line drawn perpendicular to this line drawn from the piling at the end of the finger dock. A piling at the intersection of the headline and a line drawn perpendicular and intersecting the piling at the west end of the f finger dock. On the south side a piling at page 2 4% the intersection of the headline and the south lot line and a piling at the intersection of the south lot line and a line drawn perpendicular and intersecting the piling at the west end of the finger dock. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447.
