I/we would like to request of the Department of the
Army a Nationwide 26 Permit to construct a four acre
irrigation pond. The purpose for the pond will be to
irrigate tobacco and corn crops. The Natural Resources
Conservation Service and the Moore Soil and Water
Conservation District have determined that approximately
2.12 acres of wetland will be impacted by this project.
They have also provided me/us with information concerning
my/our specific site. The information is as follows:
1) TOPOGRAPHIC MAPS of the area: (see attached)
2) COUNTY ROAD MAP for location: (see attached)
3) SOILS MAP: (see attached)
4) WETLANDS IMPACTED by this project: 2.12 acres
5) SOIL TYPE(S): (576) Vaucluse and (811) Bibb

7) WATERSHED AREA: Approximately 35 acres
I/we understand that a Nationwide Permit, if
granted, will be invalid if impacts to any Federally
threatened or endangered species will occur as a result of
this work. I understand that species of this nature have
been identified in Moore County.

CAROLINA DEPARTMENT OF ENVIRONMENT, HEALTH AND NATURAL
RESOURCES and the U.S. FISH AND WILDLIFE SERVICE of my

On 22 April 1997 the Division of Water Quality (DWQ) was notified by receipt of your
application regarding your plan to fill 2.12 acres of wetlands for the purpose of
constructing an irrigation pond in Moore County. Approval from DWQ is required to
disturb these wetlands. The enclosed application needs to be completed and returned to us
with 7 copies of the application, supporting maps and documentation. In particular as
described in 15A NCAC 2B .0502, we will require you to locate all streams and ponds on
the property. Please show these on maps of suitable scale (for instance 1"=100 feet) so we
can begin to determine your projects' compliance with 15A NCAC 2H.0500.
Your stated purpose of the wetland impact is to create pond for farm irrigation. If
impacts to wetlands (i.e., flooding and fill) exceed one acre, then compensatory mitigation
will be required (15ANCAC 2H.0506(h)). Mitigation may be carried out by the Wetland
Restoration Program for wetland impacts if sufficient justification to demonstrate that this
pond is required to support agricultural production. This justification must be provided by
either the District Conservationist for the Natural Resources Conservation Service or a
qualified private individual with accompanying calculations and must be sent to DWQ in
order to support this decision.

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Monroe:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material
in 2.12 acres of wetlands or waters for the purpose of constructing an agricultural irrigation pond near the
intersection of SR 1278, SR 1143 and SR 1275, as you described in your application dated 22 April 1997. After
reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number
3108. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of
Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project
including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless
otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified
below. If you change your project, you must notify us and you may be required to send us a new application. If
total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions
listed in the attached certification and any additional conditions listed below. According to DWQ policy, wetland
mitigation will be done by the Wetland Restoration Program (4.24 acres, riparian wetlands, river basin code
030610).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O.
Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask
for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.
