PROJECT SUMMARY: The applicant proposes to construct a bulkhead aligned at or above the mean high water contour which will incorporate high marsh and also to construct a pier with gazebo to the existing man-made channel. John Coble Page 2 9. PROJECT DESCRIPTION - The project is a single family lot measuring approximately 100 feet wide which has an existing single family structure. The shoreline of the property has experienced sheet erosion which has allowed for the encroachment of high marsh species landward of the mean high water contour (mhw). This area is vegetated by Sparana patens and a few scattered stems of Distichlis spicata. The mhw contour has a typical border of Spartina alterniflora which varies from 30' to 43' in width. There is an existing man-made canal located just waterward of the shoreline. This feature measures approximately 60' wide. There is an existing bulkhead to the south of the project site on the adjacent property. There is a stacked concrete revetment located on the property to the north of the project site. The applicant proposes to construct a bulkhead aligned above the mhw contour along the shoreline of the property. In addition, he proposes to install a pier with a gazebo and ;:bating dock to reach the channel. The bulkhead will be approximately 100' long with an 81' return, The alignment will be above the mhw contour but will involve CAMA wetlands/Corps "404" wetlands. The pier is shown as 65' long by 6' wide. It will connect to a 16'x 16' gazebo to which will be attached a ramp connecting to a 6'x 18' floating dock. 10. ANTICIPATED IMPACTS - In order to prevent the possibility of blockage of the channel the applicant indicated during the on-site meeting that he would prefer to pull the gazebo landward of the proposed location in order that the floating dock is aligned as close to the near channel edge as possible. The wetlands associated with the proposed project have developed over time due to ongoing sheet erosion along the applicants shoreline. The applicant has recently acquired this property and desires to stabilize it before further erosion occurs and the wetlands become more significant. There appears to be only limited interaction of the wetland area with the estuarine system at and beloe the mhw contour. Approximately 800 sf of high transitional marsh will be consumed by the proposed bulkhead but it does not appear to represent a significant impact on existing coastal resources. Oxford Street Wrightsville Beach, NC 28480 Dear Mr. Coble: AT4 C) FE F=1 May 7, 1997 New Hanover County WQC 401 Project #970305 You have our approval, in accordance with the attached conditions, to place fill material in 0.02 acres of wetlands or waters for the purpose of constructing a bulkhead at your lot at the end of Trails End Rd. near Whiskey Creek, as you described in your application dated 4 April 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.
