PROJECT SUMMARY: Applicant proposes to replace the 3000' bulkhead that stabilizes the Inlet Watch Marina. r4 Inlet Watch Yacht Club Page 2 9. PROJECT DESCRIPTION 3/06/97 The project site is a commercial marina with wet slips and dry stack, occupying 18.52 acres of land that averages 6' above mean sea level. The tract lies adjacent to Masonboro Sound opposite Carolina Beach Inlet. Access is by way of US 421 in New Hanover County, to Paoli Court north of the Snow's Cut bridge. The marina was excavated from high ground, with the exception of the access channel, and is stabilized with a 3000' bulkhead on all sides. A special use permit exists for the project from New Hanover County. The site is serviced by municipal sewer and a private well. The project site is classified as Conservation/Resource Protection in the New Hanover County Land Use Plan. The Division of Marine Fisheries has designated the waters of Masonboro Sound as Primary Nursery Area, and the area is closed to the taking of shellfish for consumption. The Division of Water Quality has classified the waters as SA-ORW. The ORW designation ceases immediately south of the project site. The applicant proposes to replace the 3000' bulkhead. Approximately 641' of this is to be replaced in place, with the other 2359 replaced 2' from the existing. The existing wall is buckling at the base, and - consequently, the new wall will be located an average of 4.5' to 6' from the existing wall at the top of the structures. However, at the base, where the fill will occur, the separation is approximately 2'. With the exception of the southeastern most section of the bulkhead, there is no marsh adjacent to the structure. This section is proposed to be replaced in place. The proposal is to construct the bulkhead with reinforced plastic material, and place approximately 600 to 800 cubic yards of backfill obtained from a high ground source. 10. ANTICIPATED IMPACTS The project as proposed will require the filling of approximately 4718 square feet of shallow bottom area located within an artificially created basin. Construction will disturb approximately 12000 square feet of high ground. An increase in turbidity will occur during construction. Submitted by: T. Preston Howard, Jr., P.E., Director APPROVAL of 401 Water Quality Certification Inlet Watch Yacht Club 801 Paoli Court Wilmington, NC 28409 Dear Sirs: 1410?EHNR March 26, 1997 New Hanover County WQC 401 Project #970220 You have our approval, in accordance with the attached conditions, to place till material in 4718 square feet of wetlands for the purpose of replacing a bulkhead at Inlet Watch Yacht Club, as you described in your application dated 14 March 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROMCT DESCRYPTION 3/06197 The project site is a commercial marina with wet slips and dry stack, occupying 18.52 acres of land that averages 6' above mean sea level. The tract lies adjacent to Masonboro Sound opposite Carolina Beach Inlet. A=ss is by way of US 421 in Ncw Hanover County, to Paoli Court north of the Snow's Cut bridge. The marina was excavated from hilt ground, with the exception of the access channel, and is stabilized with a 3000' bulkhead on all sides. A special use permit exists for the project from New Hanover County. The site is serviced by municipal sewer and a private well. The project site is classified as Conservation/Resource Protection in the New Hanover County Land Use Plan_ The Division of Marine fisheries has designated the waters of Masonboro Sound as Primary Nursery Area, and the arcs is closcd to the taking of shellfish for consumption. The Division of Water Quality has classified the waters as SA-ORW. The ORW designation ceases immediately south of the project site. The applioant proposes to replace the 3000' bulkhead. Approximately 641' of this is to be replaced in place, with the other 2359 replaced 2' from the existing. The existing wall is buckling at the base, and consequently, the new wall will be located an average of 4.5' to 6' from the existing wall at the top of tht struaurm. Howcvcr, at the base, where tlae fill will occur, the separation is approximately 2'. With the exception of the southeastern most section of the bulkhead, there is no marsh adjacent to the structure. This section is proposed to be replaced in place. The proposal is to construct the bulkhead with reinforced plastic material, and place approximately 600 to 800 cubic yards of back ill obtained from a high ground source. 10. ANTICIPATED IaVIPACTS The project as proposed will require the filling of approximately 4718 square feet of shallow bottorn area located within an artificially created basin. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter.
