PROJECT DESCRIPTION 3/04/97 Old Chimney is a single family residential development of approximately 50 acres, ranging from 5' to 25' above sea level in elevation. The subdivision is located off of US 421 in New Hanover County, off of Chimney Lane, south of Pickett Rock and north of Snow's Cut. The property abuts Myrtle Grove Sound. The development is served by a community package treatment plant, and some septic tanks. Property owners have their own wells. There is an open water community marina for the use of the residents. A bulkhead stabilizes the shoreline around the north and west sides of the basin. The waters of Masonboro Sound are classified as SA-ORW by the Division of Water Quality. The ORW management strategy for Masonboro Sound states that there can be no new or expanded marinas within these waters. The Division of Marine Fisheries has designated the area as Primary Nursery, and has closed the area to the taking of shellfish for consumption. The project area is classified as Conservation in the New Hanover County Land Use Plan. Masonboro Sound is approximately 800' across at the project-site. The applicants wish to replace the marina structures to the same dimensions and configuration as the original. This structure was destroyed during Hurricane Fran. This structure had a footprint of 360' x 55', and, according to the application supplied 47 slips. According to the 1990 application, this same facility supplied 49 slips. The difference lies in how the slips are counted within the fingers. The applicant qualifies to rebuild the structure as it was before the hurricane under a standard Exemption Permit. The typical boat length in this facility is 23', with the maximum length of 36'. There is no available pumpout facility, and there are two signs reflecting a "closed head" policy. The bulkhead on the southwest side has no return wall, and is consequently, eroding into the basin at a rapid rate. The applicants propose to excavate the existing marina basin and access channel. The access channel is approximately 180' x 30', with current soundings of approximately -2.5' mean low water; the basin is approximately 400' x 160', with current soundings of approximately -3' mean low water. The excavation of both of these areas to -6' mean low water would require the removal of approximately 8000 cubic yards of very sandy material. Soundings in the connecting waters are -6' mean low water, and greater within the AIWW. The excavation is proposed to be accomplished hydraulically. The proposal is to pump the spoil material to the north end of the US Army Corps of Engineers spoil island across from the project site at channel marker #153. Authorization for the use of this site is on file. This spoil island is in the same area as the one used previously for this project, however, the spoil material is to be removed from an area closed to the taking of shellfish, and the waters around the spoil island are open to shellfishing. The spoil area currently has a dike wall around it, and is approximately 550' x 250' in size. The applicants propose an intake at the northern tip of the island, approximately 350 from the effluent pipe. The effluent will be carried to the mean low water contour. The spoil area has 8' dike walls, with a proposed 6' settling basin, providing the capacity for approximately 30,556 cubic yard of material. The intended use of the marina will not change under this proposal. 10. ANTICIPATED IMPACTS The project as proposed will displace approximately 69,400 square feet of previously excavated bottom area. Approximately 137,500 square feet of high ground within an existing spoil area will be disturbed for spoil placement. The marina system will incorporate approximately 19,800 square feet of open water, which was previously, incorporated by this project. Turbidity impacts can be expected during excavation. Because this re-build does not represent a new or expanded marina, it is not prohibited by the ORW designation. The spoil placement will require a temporary closure of the shellfish waters around the area effected by the effluent. Approval of the project will resume the operation of a marina that does not have a pumpout facility available. Submitted by: T. The spoil material generated from the maintenance of the boat basin will be pumped hydraulically from these closed waters to an existing diked disposal area across the AIWW from the project site. The discharge from this disposal site is located in waters that are open to the harvesting of shellfish. As with past projects of this type, the waters around the discharge pipe from the disposal area will probably require a temporary closure to shellfish harvesting during the dredging event. Bridges Old Chimney Homeowners Association 114 Chimney Lane Wilmington, NC 28409 Dear Mr. Bridges: OW IV4 ?EHNFi March 24, 1997 New Hanover County WQC 401 Project #970170 You have our approval, in accordance with the attached conditions, to dredge 69,400 square feet of wetlands or waters for the purpose of dredging an existing marina at Chimney Lane off of US 421 in New Hanover County, as you described in your application dated 7 March 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. You shall coordinate the discharge from the diked disposal basin with the shellfish Sanitation Section of the N.C. Division of Environmental Health with respect to a temporary closure of shellfish harvesting. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specked in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.
