Preston Howard, Jr., P.E., Director December 8, 1997 Mecklenburg County DWQProject #970912 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Mr. Andrew Burg Mecklenburg County Engineering 700 North Tryon St. Charlotte, NC 28202 Dear Mr. Burg: You have our approval, in accordance with the attached conditions and those listed below, to stabilize the streambank along in 12000 feet of waters for the purpose of stabilizing the streambank along McAlpine Creek from near Olde Plantation Road bridge to near NC 51 bridge, as you described in your application dated October 22, 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3102. This certification allows you to use Nationwide Permit Number 13 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this protect (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. DWQ shall be copied on all monitoring data collected for this project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. In accordance with regulatory requirements, we are submitting herewith an application for a Nationwide Permit 13 Streambank Alteration for your review and approval. Specifically, this application includes a completed joint form, a project map, and a set of project construction plans. Andrew Burg, with MCSWS, will be forwarding to you, via E-mail, digital photographs of another recently completed project by the County. This illustrates the use of methods that will be applied on this project (Little Sugar Creek at North Davidson Street). As with other similar projects recently completed by MCSWS, the McAlpine Creek Project will require a mix of different construction techniques, as shown on the enclosed plans and cross sections that have been reduced to 8 ''/2"x 11." Note that many of the reaches of this creek will be improved through the use of "soft" solutions--laid back slopes with erosion control blankets and stabilized with various plantings. The use of seeded mixes, live staking, and planting of tree saplings, each of varying species, will be used. Specific planting criteria for grass seed, buffers, bushes, live stakes, and hardwood trees have been developed, and will be further defined subsequently to the next field walk. In areas where "hard" improvements are required (near bridges, to save mature trees; channel bends; and at the toe of bank), limited amounts of NCDOT Class 1 riprap will be used. Grading will include a balanced design of both cut and fill sections. Details on planting information will be in the project construction documents. Erosion control will be used in all construction zones, per state requirements. The creation of habitat enhancements for fish and aquatic life similar to those used on MCSWS's Little Sugar Creek at Huntingtowne Farms Park Project is also proposed. After stabilizing the streambanks, efforts will be directed toward creating riffle pools, varying low flow channel geometry, placing boulder clusters, etc., per the enclosed plans. k: pHYneck4ncelpinelpermitslpermit-1.doc P.O.
