Dear Sirs:
You have our approval, in accordance with the attached conditions, to place fill material in 0.33 acres of
wetlands or waters for the purpose of constructing an apartment complex as you described in your application
dated October 20, 1997. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3108. This Certification allows you to use Nationwide Permit Number
26 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

channel. The purpose of the fill is for general site development and construction of a
required detention facility. A small excavated pond which was determined to be non-
jurisdictional will also be removed. The wetlands are associated with the upper shallow
area of the deteriorating pond and seepage. The small channels not subject to the 500 If
NWP #26 limitation did not exhibit important characteristics such as persistent pools
and/or saturated channel bottom; macro-invertebrates; reduced soils; algae; hydrophytic
vegetation in or adjacent to the channel; or signs of wildlife utilizing the stream; and
manifested limited sandy channel substrate. Impacts to intermittent tributaries is 145
linear feet. Total impacts to jurisdictional waters utilizing NWP #26 is ±0.33 acre.
The majority of the site is moderately sloped to a well defined stream that begins close to
the property line. The soils according to MRCS Soil Survey on site are made up of Cecil
sandy clay loam (CeB2, CeD2) and Helena sandy loam (HeB). Although Hydric
inclusions can occur within the Helena soils none were found and this was verified by the
USACE on 8/20/97. The vegetation is primarily mixed hardwoods in early and secondary
succession. Areas in former agricultural fields include old field succession and very
dense scrub/shrub overgrowth.

The developer will require strict adherence to an approved Sediment and Erosion Control
Plan. and I have informed my client that a preconstruction application to the USACE will
be required if the development area changes and impacts of 1/3 acre to wetlands and/or
over 150 if to streams required.
Best Management Practices will also be employed to minimize impacts to Jurisdictional
Waters. These will include:
a) Siltation Barriers; Sediment Traps and Diversion Ditches
b) Barricades to define construction limits to sensitive sites and to protect trees
c) Preconstruction meetings as required.
d) Vehicular access will be restricted to specific areas to avoid disturbance to
adjacent wetlands and natural areas to be preserved
e) Methods to prevent short term impacts will be inspected regularly and maintained
during construction of the project.
f) Wetlands to be preserved will be clearly marked prior to construction to prevent
accidental damage to wetlands. The contractors will be held responsible for unauthorized
wetland damage not permitted according to plans and specifications. Preconstruction
meetings shall be held if necessary with representatives of the USACE and the NCDWQ.
g) Short term construction impacts, primarily stream sedimentation will affect
aquatic habitat, however this will be minimized to the extent practicable to promote rapid
recovery.
h) Project construction will strictly adhere to an approved Sedimentation and
Erosion Control Plan. Best Management Practices will include utilizing siltation trapping
ponds and other erosion control structures where appropriate. Impacts from hazardous
materials and other toxins to fish and aquatic life such as fuels will be avoided by not
permitting staging areas to be located near surface waters.
i) As required by the 401 Water Quality Certification conditions, measures will be
taken to prevent "live" or fresh concrete from coming into contact with waters until the
concrete has hardened.

Leonard S. Rindner, Environmental Planning Consultant, on behalf of his client, Mr.
Robert Dienst, Dienst Enterprises; Inc., is requesting a letter of concurrence from the North
Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army
Corps of Engineers. The NCWRC has reviewed information provided by the applicant. These
comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C.
466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C.
661-667d).
Based on the information provided by the applicant we have no objection to the project as
proposed provided that any mitigation required for impacts to wetlands and or surface waters be
coordinated with the DEM and the USACOE.

Dear Mr. Dienst-
On September 19, 1997 the Division of Water Quality (DWQ) was notified by receipt of
a letter from your consultant (Mr. Len Rindner) regarding your plan to fill streams and
wetlands for the purpose of constructing a multi-family development in Mecklenburg
County. Approval from DWQ is required to disturb more than 150 linear feet of streams
under either Nationwide Permit 14 or 26 irregardless of whether the Corps of Engineers
consider them as "subject to the 500 linear foot limitation" for permitting purposes. The
enclosed application needs to be completed and returned to us with 7 copies of the
application, supporting maps and documentation. In particular as described in 15A NCAC
2B .0502, we will require you to locate all streams and ponds on the property. Please show
these on maps of suitable scale (for instance 1 "=100 feet) so we can begin to determine your
projects' compliance with 15A NCAC 2H .0500.

On behalf of Mr. Robert B. Dienst, Dienst Enterprises, Inc., I am requesting, confirmation
of eligibility t utilize N_U# 26 andWP# 14 to-impact +0.31 acres of wetlands, and
USACE on 8/11/97) and 15 If of intermittent stream sOject to the 500' limitation
(+2.. Acre) a nel. The purpose of the fill is for general site development and
construction of a required detention facility. A small excavated pond which was
determined to be non-jurisdictional will also be removed. The wetlands are associated
with the upper shallow area of the deteriorating pond and seepage. The small channels
not subject to the 500 if NWP #26 limitation did not exhibit important characteristics
such as persistent pools and/or saturated channel bottom; macro-invertebrates; reduced
soils; algae; hydrophytic vegetation in or adjacent to the channel; or signs of wildlife
utilizing the stream; and manifested limited sandy channel substrate. Impacts to
intermittent tributaries is 145 linear feet. Total impacts to jurisdictional waters utilizing
NWP #26 is ±0.32 acre. Impacts to surface waters utilizing NWP #14 for the road
crossing is ±0.01 acre.
The majority of the site is moderately sloped to a well defined stream that begins close to
the property line. The soils according to NRCS Soil Survey on site are made up of Cecil
sandy clay loam (CeB2, CeD2) and Helena sandy loam (HeB). Although Hydric
inclusions can occur within the Helena soils none were found and this was verified by the
USACE on 8/20/97. The vegetation is primarily mixed hardwoods in early and secondary
succession. Areas in former agricultural fields include old field succession and very
dense scrub/shrub overgrowth.

The developer will require strict adherence to an approved Sediment and Erosion Control
Plan and 1 have informed my client that a preconstruction application to the USACE and
