Preston Howard, Jr., P.E., Director October 27, 1997 Mecklenburg County DWQ Project # 970799 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDMONS Mr. Stephen Hoots Childress Klein Properties 2800 One First Union Center Charlotte, NC 28202 Dear Mr. Hoots: You have our approval, in accordance with the attached conditions and those listed below, to - place fill material in 0.04 acres of wetlands and 600 feet of streams for the purpose of constructing a commercial development at Brookwood Development, as you described Vol application dated September 17, 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3106 This certification allows you to use Nationwide Permit Number 18 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notices, conservation easements or similar mechanisms shall be placed in all lots with remaining jurisdictional wetlands and waters to restrict future wetland and/or water impact. These mechanisms shall be put in placb within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. An additional condition is that a final, written stormwater plan including a wet detention basin must be approved by DWQ before wetland (or stream) impacts occur. (cc: Ray Cox) If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Although I agree that this behavior is reprehensible, I don't think we can justify denial on those grounds. They plan to do stormwater pond - any other conditions to impose? Any other thoughts? The project as proposed impacts less than 0.04 acres of wetlands and less than 600 linear feet of intern ittent to dry channel. Pre-construction notification is required because of our use of NW 18. The proposed activity is located within Mecklenburg County and is within lands owned by Childress Klein Development. The attached site plans and USGS topo quad showtbe location of the project. impacts to wetlands, including area represented by channds, on the site totals 0.04 acres. Wetlands proposed to be impacted are wetlands associated with the bottom of an interrniitc ut channel. Wetland duality is minimal. The dmmel is c ausitdered to be intermittent as it was field observed with no flow and the Low Flow Characteristics of Stream in North Carolina states that a drainage areas of less than I square mile, in this region, generally have a low-flow statistical value of zero. Drainage areas for this channel i s less than I square mile (640 acres). The project has previously authorized impacts ':ril 1989: SACS SAW26-89-23 Broolcwaod) totaling 3.8 acres. Neither S&EC, Inc. or the Co conversations with Steve Lund) can account for the large acreage of prior approved impacts; we suspect the acreage was a gross aaggeration. The attached information represents all correspondence that the developer has maintained. The purpose of utilizing the NW 18 is to avoid some of the review complications of having a permit with impacts under NW 26 exuding 3.0 acres. The use of either NW 26 or NW 18 would require notification to NC DWQ.
