Preston Howard, Jr., P.E., Director September 30, 1997 Mecklenburg County DWQ Project # 970755 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Mr. Steve McLeod North 77 Business Park, UC 19701-D NC Hwy 73 West Devidson,North Carolina 28036 Dear Mr. McLeod: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.32 acres of wetlands or waters for the purpose of constructing a business park (North 77 Business Park) at Bailey Road and Old Statesville Road as you described in your revised application dated September 19, 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108 This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non- Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 211 .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed restrictions, conservation easements or similar mechanisms shall be placed in all lots with remaining jurisdictional wetlands and waters to restrict future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Applicant shall provide a copy of this Certification to each buyer of a building lot to inform them that any additional stream or wetland impact will require construction of a stormwater pond for that lot. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. The total area of Jurisdictional Waters on the site is ± 4.04 acres based on a wetland delineation and USAGE verification on March 11, 1996. As depicted on the attached plan the developer has made a strong effort to avoid and minimize impacts to jurisdictional waters including wetlands and streams. The two road crossings are currently existing and were conducted at bank to bank locations. One location utilized NWr #14. Since NWP #14 can be utilized only once on a project over the same tr?-i uary, NWP # 26 was utilized for the other. The developer will maintain the hydrology to the wetlands to the extent possible with the stormwater drainage system on the project. The majority of the site is moderately sloped to a well defined stream. The soils according to NRCS Soil Survey on site are made up of Cecil sandy clay loam (CeB2, CeD2), Helena sandy loam (HeB), Enon sandy loam (EnB), and Monacan soils (Mo) in the floodplain like areas. Hydric inclusions occur within the Helena soils from a high seasonal water table, springs, and seeps. The vegetation is primarily mixed hardwoods in early and secondary succession. Much of the area has been recently clearcut. Areas in former agricultural fields include old field succession and very dense scrub/shrub overgrowth. Large areas of the woodlands were also impacted by Hurricane Hugo. i The developer will require strict adherence to an approved Sediment and Erosion Control Plan and I have informed my client that a preconstruction application to the USACE and the NCDWQ will be required if the development area changes and impacts of 1/3 acre to wetlands and/or over 1501f to streams required.
