You have our approval, in accordance with the attached conditions, to place fill material in 0.09 acres of
wetlands or waters for the purpose of developing the Forest Green Subdivision at Idlewood Road near
Lailwood Circle as you described in your application dated August 14, 1997. After reviewing your
application, we have decided that this fill is covered by General Water Quality Certification Number 3108.
This Certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of
Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your
project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and
Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA
permit expires unless otherwise specked in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed
in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

am a Civil Engineer in Charlotte and am designing a residential subdivision in
Charlotte for SeayBros Associates. The tract of land acquired has been developed on
the downstream and back side as residential subdivisions and the tract on the
upstream side is planned for multifamily. These two tracts have not been developed to
date because of the difficulty of access and the rough terrain. In consulting with Steve
Lund of the Asheville office Army Corps of Engineers, he advised me to pull back the
headwall (HW#1) to the Right-of Way so that I could minimize the effect of the fill in the
subdivision. Typically I would back the lots to the creek area and leave all but the
culvert/street crossing in its natural condition but with the site configuration the way it
is, we can not get access to the whole site without piping some of the creek. The site is
in Charlotte on one of the major roads (Idlewild Road) so the land is pricey thereby
necessitating the extra lots to offset the cost of the land. We are requesting the NW
permit #26 for the fill and piping of the existing creek. Steve requested that I send you
the following: an USGS map of the area, a 1"= 200' City Topo showing the drainage
area, an 8 1/2" x 11" copy of the drainage area from the design plans and a copy of the
drainage sheet from the design plans and the completed pre-construction notification.
realize you do not need the 24"x 36" plan sheet for your files but I felt it might be helpful
initially. You can throw it away when you are through.
