You have our approval, in accordance with the attached conditions, to place fill material in waters for the
purpose of constructing a force main sewer project at NC 150, as you described in your application dated 21
July 1997. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 3101. This Certification allows you to use Nationwide Permit Number 12
when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Dear Ms. Colsun:
Thank you for your January 20, 1997, letter requesting U.S. Fish and Wildlife Service (Service)
comments on the request for an easement from Duke Power Company for an effluent discharge line
into Lake Norman in Iredell County. This is the report of the Service and the Department of the
Interior and is submitted in accordance with provisions of the Fish and Wildlife Coordination Act
(48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and Section 7 of the Endangered Species Act of
1973, as amended (16 U.S.C. 1531-1543).
Based on our initial review, the proposed action may impact fish and wildlife resources. However,
because of staffing limitations, we have elected not to conduct a field inspection of the project and
no further action is anticipated. If, prior to Duke Power's permit issuance, further information
becomes available which affects our position, we will forward supplemental comments to you.
Under no condition should this response be construed as a "no objection" report.

SUBJECT: Proposal to discharge wastewater treatment plant effluent into Lake Norman, Iredell
County
Dear Mr. Colson:
This correspondence responds to a request by you for our comments regarding your company's
plans to install an wastewater effluent discharge line into Lake Norman. According to your letter dated
20 January 1997, Mid South Water Systems, Inc. is in the process of requesting an easement from Duke
Power Company. The wastewater treatment plant, which will be located on NC 150, will be an initial
capacity of 0.1 million gallons per day and will serve both residential and commercial facilities along NC
150. An NPDES permit from the North Carolina Division of Water Quality has already been obtained.
The North Carolina Wildlife Resources Commission is authorized to comment and make
recommendations which relate to the impacts of this project on fish and wildlife through the Federal
License of Water Resource Project Act (Federal Power Act-16 U.S.C. 79 la et seq.), and the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d).
We have no objection to this proposal, provided the following condition is met:
The U.S. Army Corps of Engineers should be contacted to determine if a 404 permit for work in
waters is required for this project. Contact is Mr. Steve Chapin at 704/271-4014.

The Division has reviewed the proposed project for potential impacts to State Parks and
Recreation Areas, Wild and Scenic Rivers, Dedicated State Nature Preserves, Registered
Natural Heritage Areas, and Priority Natural Heritage Areas. No such sites are likely to be
affected. According to the Natural Heritage Program database, no federal or state-listed
species of plants or animals have been recorded from the vicinity of the project site. Thank

The Iredell County Health Department has received your request for permitting
information and other comments regarding the proposed 0.1 MGD WWTP to be located near the
NC Hwy 150 Bridge in Iredell County.
I am enclosing a copy of Chapter 14 WASTEWATER of the Iredell County Code. All
sections of this chapter of the Code would apply to this construction proposal and are in addition
to applicable state permit requirements. Note especially the Sec. 14-31 requirement that monthly
monitoring reports be supplied to the county health department once the plant becomes
operational.
