Thank you for you 10 July 1997 letter. In response to your question about the 401
Certification process, the following clarification may help. The U.S. Army Corps of Engineers
has 1) the authority to define waters and wetlands, 2) to determine whether a 404 permit (and
therefore a 401 Certification) is needed and 3) what type of permit (ie. individual vs.
Nationwide). Therefore since the Corps has decided that jurisdictional waters are not present in
the channel, neither 404 Permit nor a 401 Certification are needed.
I have discussed the overall process with Mooresville Regional Office staff and, the
Asheville Field Office of the Corps and we have agreed that there is no purpose in DWQ staff
conducting a preapplication site visit unless either the Corps has visited the site to determine
jurisdictional waters or the Corps representative is also present. I hope this clarifies our
preapplication process.

On June 28, 1997, Samar Bou-Ghazale with the Division of Water Quality, Mooresville Regional
Office, inspected a proposed project at Martin Marietta's Matthews Quarry. The inspection was
55\^?. made upon my request. This project will require the relocation of a stormwater channel, which
( c passes through our property. In my opinion, this channel does not meet the requirements or
definition of a stream as outlined in the New Wetland Rules: Supplemental information Field
location of streams, ditches and ponding, (see attached), and should not require 401 certification
from your Division. This determination is based on the field inspection with Samar and the
following conditions:
• Limited drainage area of 27 acres
• Not indicated as a blue or purple line on USGS
• Only experiences flow in direct response to rainfall
• Easily drains within 48 hours after each rainfall event
• Receives little or no continual flow from any other sources
• No algae present within the channel
Samar indicated that in order to receive official agreement with this determination, a completed
application would be required for submittal. Samar also indicated that the channel should be
exempt from the regulations of the DWQ. I have completed the attached Preconstruction
Notification Form for your review. By copy of this letter, I have also sent the required
information to the U.S. Corp of Engineers. Mr. Steve Chapin, with the Corp recently inspected
the project and indicated that this section of channel would not impact any wetlands.

This letter.is to request official approval from your Division for Martin Marietta to relocate the
stormwater channel. Also, I would request clarification on when notification of proposed projects
should be made with the DWQ. I will provide any information necessary but do not wish to
submit "exempt" proposals. I'm sure your workload is plentiful, as is mine, and additional
paperwork on both our parts is time consuming.

New Wetland Rules: Supplemental information

1. Streams
The wetland rules refer to the protection "...of the mean
high water line or normal water level of any perennial or
intermittent water body as shown by the most recently published
version of the United States Geological Survey 1:24,000 (7.5
minute) scale topographical map or other site-specific data" (15A
NCP_C 2H .0506 (c) (2)) . Therefore DrivQ staff believe that
stormwater channels are to be excluded. Stormwater channels are
defined as those that only carry water during and immediately
after (defined as within 48 hours) of a stc-m (defined as less
than or equal to a 10 year, 24 hour stor_n). The tern stormwater
channel is synonymous with the term "ephemeral strea_n". The term
"ephemeral s..ream" is defined. (American Geological Institute.
1992. DictionGrl of Geological Terms. Dolphin Books, Doubleday
and Co., New York) as a stream or portion cf a stream which floe
only in direct response to precipitation. It receives little or
no water from springs and no long-continued supply from melting
snow or other sources. Its channel is at all times above the
water table. DTNQ does not use the tern "ephemeral stream" due to
confusion with the more widespread use in NC of the term
"ephemeral wetland".
D6vQ will often need to determine where an intermittent
channel starts and where the stormwater channel ends. The
following is a list of field parameters which we have found to be
often indicative of the hydraulic status of a stream channel
across the state. P_ channel from a permanent or intermittent
spring will often be considered an intermittent or permanent
stream due to the downstream flow contributed by the spring.
This decision can often only be made after walking upstream and
downstream of the point in contention. Field staff must document
in writing the presence or absence of the conditions if the issue
appears to be contentious to the applicant.

DwQ staff are authorized to use these parameters to make
the determination of storrwater channels versus intermittent
streams. If questions arise, other DWQ Regional or Central
Office staff should be consulted in order to reach a consensus.
The attached form should be used to help document the rationale
for this decision. At this time, no numerical manipulation of
these data is appropriate. The determination should be made
based on the overall weiaht of the field evidence as noted above.
If the applicant or consultant disagrees with this determination,
monitoring wells or modelina (or less likely to be accurate) may
be used to demonstrate that the flow is stormwater driven rather
intermittent usina the numerical criteria cited above.
II. Ditches and canals
These features present a special problem with the new rules
since a wide variety of canal and ditch sizes are depicted on the
USGS maps. An additional complication is often the U.S. Army
Corps of Engineers does not consider them to be waters of the
U.S. if they are constructed through high ground. If a 404
Permit is not required, then 401 Certifications are also not
needed.
For the purpose of the minimization portion of the rules
lA "nick point" is the point along a stream channel where
the gradient changes abruptly. It often.rese*_nbles a small,
intermittent waterfall. It is also often associated with the
local ground water table.

amended, 1982) (O.S. 74-46 through 74-68 15 NCAC 5).
The applicant proposes to extend the l0-year pit limit to the ultimate pit limit and
to construct a new drainage channel, greater than 1,000 feet long, to divert water from
one drainage to arlUtller. The new channel and the intermittent stream to which it drains
lie near the ultimate pit limit and will eventually need to be moved further north when the
pit reaches that area. The area receives runoff from heavily developed Independence
Blvd. Both intermittent streams, which will eventually be excavated, flow to beards

2. Mitigate for unavoidable wetland impacts through wetland restoration or creation.

restoration at a ratio of 2:1 (restored:destroyed). The area adjacent to Beards
Creek at the lower end of the intermittent stream that will receive the diverted
water should be considered as a mitigation site.
3. Stabilize banks of the intermittent stream receiving diverted water by planting
trees and shrubs. Tag alder, black willow, river birch, and sycamore are
recommended for planting at the edge of the banks. A mixture of willow oak,
swamp chestnut oak and black gum is recommended for the remaining buffer.
4, Maintain or establish a minimum 100-foot undisturbed, forested buffer adjacent to
any pervnniul strourn. A minimiun 35-foot forested buffer should be maintained ,
or established along intermittent streams. To enhance wildlife habitat values, a
50-foot forested buffer is recommended adiacent to wetlands.
5. Implement and strictly maintain an appropriate, state approved erosion and
scditncntation control plan. One scdunnut basin observed at the base of the berm
near Beards Creak needed to be cleaned out.
6. Ike-establish vegetation in disturbed areas as soon as possible.
7. Design storntwater ponds to uvitt the runoff from the adjacent urbanized areas as
well as the mine area.
8, Route sufficient water to remaining wetlands and mitigation sites to maintain
hydrology. Energy should be dissipated to prevent scouring of wetland areas.
