Dear Mr. Richards:
You have our approval, in accordance with the attached conditions, to place fill material in 0.096 acres of
or waters for the purpose of improving a stream channel to alleviate flooding at Olde Savannah Road area, as
you described in your application dated September 26, 1997. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3108. This Certification allows
you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. In addition, you
should get any other federal, state or local permits before you go ahead with your project including (but not
limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed
regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless
otherwise specified in the General Certification. This 401 replaces the one issued on October 21, 1997.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed
in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Enclosed are seven (7) copies of a completed Pre-Construction Notification Application for a
Nationwide Permit 13 and Section 401 water quality certification. This application is submitted in
response to your letter dated September 9, 1997. After receipt of your letter, we contacted your
office and talked with Mr. Eric Galamb regarding our original submittal. Mr. Galamb reviewed the
project file and we discussed the following:
• The original application using the "Joint Form" was not acceptable.
• No application form was included with your letter of September 9, 1997. Our office did not
receive the Pre-Construction Notification Application package until September 23, 1997.
• Most of the original submittal package was acceptable for review. Mr. Galamb requested
seven (7) additional copies of the cover letter, narrative, and site photos. These are enclosed
with this submittal.
• To expedite the review process, Mr. Galamb suggested proceeding with an on-site review
by Mr. Mike Parker of the Mooresville Regional Office.
In addition, we have previously sent you copies of the notifications to the U.S. Army Corps of
Engineers, the U.S. Fish and Wildlife Service, and the State Historic Preservation Office. Attached
is the response from the State Historic Preservation Office.

The property owner, Ms. Olga Hafley, at 6914 Olde Savannah Road has experienced house flooding
three times in the past 18 months. Floodwaters were approximately 12 inches deep in her house
during recent heavy rains. Ms. Hafley is completing repairs to her house from the last flood, and
desperately wants to avoid any repeat occurrences. She contacts the City and us during every heavy
rain and she is desperate for flood relief. We request that you please expedite review and approval
of this project. Please contact Sandra Hayes or me if you need additional information regarding this
application or submittal in order to complete the notification process as soon as possible.

Olde Savannah Road Storm Water Maintenance Improvement Project
Narrative
The City of Charlotte Storm Water Services Maintenance Repair Program investigates complaints
made by property owners who have suffered property damage or loss as a result of storm drainage
systems not functioning correctly. USInfrastructure (USI) is a consultant to the City and has
investigated complaints regarding the subject area. Storm Water Services received the first
complaint at 6914 Olde Savannah Road on 9/11/95. Since the initial date, at least five more
complaints have been filed by one or more property owners to report severe flood damage.
A summary of the problems along this area are as follows:
1. The existing channel and pipe system through the subject properties drains
approximately 100 acres. Two large ponds that were previously upstream have been
filled for commercial and residential development. Therefore, the existing channel
receives a substantial amount of storm water with very little attenuation provided
upstream. The existing channel dimensions ate inadequate.
2. The existing channel upstream of Olde Savannah Road has become silted in from
development upstream.
3. The existing culvert at 6914 Olde Savannah Road is a 42" RCP. The finished floor
elevation of the house at this address is lower than the road and lower than the top
of the existing 42" RCP.
4. The existing 42" RCP is significantly undersized with house flooding occurring
during the 10-year storm event. House flooding has occurred twice in the last 11
months.
5. The existing channel downstream of Olde Savannah Road has silted in and lost
definition. Storm water ponds in the rear and side yards of 6839 and 6845 Old
Savannah Road.

6. The proposed culverts are extended 91 fe t upstream from the existing culvert end.
This extension is required to move tie 'inlet control condition to a point where it can
be controlled without flooding the house.
7. Bio-engineering_techniques for channel stabilization were considered but not selected
for the following reasons:
The existing channels pass through sideyards and backyards in close
proximity to existing homes. The higher Manning's n values of a
bioengineered solution vs. riprap channels would require larger channel

sections and take away even more of the property owners' yards than the
current design. In addition, the "overgrown" appearance -of a mature
bioengineered channel may not be acceptable to the property owners.
• Proposed Channel C along the northeastern boundary of 6914 Olde Savannah
Road is a storm water channel (flows only during storm events) and drains
a small watershed. Therefore, it is not subject to any mitigation
requirements.
• The existing channel upstream of Olde Savannah Road is mostly grass-lined
with erosion and siltation present. It has minimal tree cover. Therefore, we
do not believe the channel will be adversely impacted by the proposed
improvements.
• No aquatic life has been observed within these channels during numerous site
visits.
• The additional design and specialized construction cost for bioengineered
channel stabilization do not seem warranted for this project because of its
rather limited scope and impact.
The property owner at 6914 Olde Savannah Road (upstream) has experienced three house flooding
events within the past two years. The proposed improvements were designed to eliminate the house,
street, and yard flooding that occurs with almost each heavy rainfall. The attached pictures were
taken after the significant rainfall event that occurred in Charlotte on July 23, 1997.

and photos of this project for your review.
In addition, one (1) copy of the application has been sent to the U. S. Army Corps of Engineers, one (1) copy
has been sent to the U.S. Fish and Wildlife Service, and one (1) copy has been sent to the State Historic
Preservation Office (transmittal letters are attached).
The City of Charlotte Storm Water Maintenance Repair Program has received numerous complaints in the
area regarding the house and yard flooding which occurs during heavy rainfall events. The property owner
at 6914 Olde Savannah Road has experienced house flooding three times in the past two years. Floodwaters
were approximately 12 inches deep in her house during recent heavy rains. Your assistance in reviewing

Narrative
The City of Charlotte Storm Water Services Maintenance Repair Program investigates complaints
made by property owners who have suffered property damage or loss as a result of storm drainage
systems not functioning correctly. USInfrastructure (USI) is a consultant to the City and has
investigated complaints regarding the subject area. Storm Water Services received the first
complaint at 6914 Olde Savannah Road on 9/11/95. Since the initial date, at least five more
complaints have been filed by one or more property owners to report severe flood damage.
A summary of the problems along this area are as follows:
1. The existing channel and pipe system through the subject properties drains
approximately 100 acres. Two large ponds that were previously upstream have been
filled for commercial and residential development. Therefore, the existing channel
receives a substantial amount of storm water with very little attenuation provided
upstream. The existing channel dimensions are inadequate.
2. The existing channel upstream of Olde Savannah Road has become silted in from
development upstream.
3. The existing culvert at 6914 Olde Savannah Road is a 42" RCP. The finished floor
elevation of the house at this address is lower than the road and lower than the top
of the existing 42" RCP.
4. The existing 42" RCP is significantly undersized with house flooding occurring
during the 10-year storm event. House flooding has occurred twice in the last 11
months.
5. The existing channel downstream of Olde Savannah Road has silted in and lost
definition. Storm water ponds in the rear and side yards of 6839 and 6845 Old
Savannah Road.
6. The proposed culverts are extended 91 feet upstream from the existing culvert end.
This extension is required to move the inlet control condition to a point where it can
be controlled without flooding the house.
7. Bio-engineering techniques for channel stabilization were considered but not selected
for the following reasons:
• The existing channels pass through sideyards and backyards in close
proximity to existing homes. The higher Manning's n values of a
bioengineered solution vs. riprap channels would require larger channel

sections and take away even more of the property owners' yards than the
current design. In addition, the "overgrown" appearance of a mature
bioengineered channel may not be acceptable to the property owners.
• Proposed Channel C along the northeastern boundary of 6914 Olde Savannah
Road is a storm water channel (flows only during storm events) and drains
a small watershed. Therefore, it is not subject to any mitigation
requirements.
• The existing channel upstream of Olde Savannah Road is mostly grass-lined
with erosion and siltation present. It has minimal tree cover. Therefore, we
do not believe the channel will be adversely impacted by the proposed
improvements.
• No aquatic life has been observed within these channels during numerous site
visits.
• The additional design and specialized construction cost for bioengineered
channel stabilization do not seem warranted for this project because of its
rather limited scope and impact.
The property owner at 6914 Olde Savannah Road (upstream) has experienced three house flooding
events within the past two years. The proposed improvements were designed to eliminate the house,
street, and yard flooding that occurs with almost each heavy rainfall. The attached pictures were
taken after the significant rainfall event that occurred in Charlotte on July 23, 1997.
