Development Co., Inc. 1045 Burke St. Winston-Salem, NC 27101 Dear Sirs: You have our approval, in accordance with the attached conditions and those listed below, to culvert in 235 feet of streams for the purpose of constructing an apartment complex (Barington Place Apartments) at Harris Blvd. at Old Concord Road in Charlotte, N.C., as you described in your application dated 6 June 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Deed restrictions, conservation easements or similar mechanisms shall be placed in all lots with remaining jurisdictional wetlands and waters to prevent future fill. These mechanisms shall be put in place within 30 days of the date of this letter or the COE permit whichever is later. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory heating. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Project G-1494 Dear Mr. Dorney: Enclosed please find seven copies of the Pre-Construction Notification Application for the above referenced site. C.B. Development Company is planning to develop an apartment complex at the site. The proposed development will impact approximately 275 linear feet of stream channel and approximately 0.1902 acres of wetlands. The proposed development is shown on the attached Site Development Plan. We have contacted the United States Fish and Wildlife Service (USFWS) regarding the presence of endangered and threatened species in the vicinity of the site. The USFWS recommended that a survey be performed to determine if the following species are present on the site: Aster georgianus, Delphinium exaltatum, Echinacea laevigata, Helianthus schweinitzii, Isoetes virginica, Lotus helleri, and Rhus michauxii. A survey conducted by Dr. James F. Matthews of HARP determined that the species of concern are not present on the site. Based on the results of this survey, Mr. Mark Cantrell with the USFWS has stated that no further action is required. We have also contacted the North Carolina Department of Cultural Resources regarding the presence of historic properties in the vicinity of the site. The North Carolina Department of Cultural Resources stated that the proposed development should not affect historic properties in the vicinity of the site. The North Carolina Department of Cultural Resources response is attached. We are requesting a Section 401 Certification for the proposed impact to approximately 0.1902 acres of wetlands and 275 linear feet of a tributary of Back Creek. Crow, Director Thank you for your letter of May 8, 1997, forwarding additional information concerning the above project. Your map indicates the proposed apartment complex is across SR 2939 from the McDonald House (MK 1276). Therefore, the project as proposed should not affect the historic property. There are no known archaeological sites within the proposed project area. Based on our present knowledge of the area, it is unlikely that any archaeological resources which may be eligible for inclusion in the National Register of Historic Places will be affected by the project construction. The above comments are made pursuant to Section 106 of the National Historic Preservation Act and the Advisory Council on Historic Preservation's Regulations for Compliance with Section 106 codified at 36 CFR Part 800.
