You have our approval, in accordance with the attached conditions, to place fill material in waters for the
purpose of installing a sewer line at East Lincoln County Water & Sewer District Contract 3, as you
described in your application dated 4 April 1997. After reviewing your application, we have decided that this
fill is covered by General Water Quality Certification Number 3101. This Certification allows you to use
Nationwide Permit Number 12 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
• If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Application Summary
To alleviate septic tank failure due to topographical constraints around the Lake
Norman Area in East Lincoln County, the Water and Sewer District was
established in 1992.
A myriad of gravity, low pressure, force main, residential grinder pumps, and
major lift stations were designed to convey sewer to the newly expanded Forney
Creek Wastewater Treatment Plant.
Residents of Governor's Island have requested access to this system. To meet this
request, a three-inch low pressure line crossing the existing bridge connecting
Burton Lane (SR 1376) and Governor's Island Drive is required.
Lincoln County proposes to directionally bore this three-inch low pressure line
underneath the bridge as shown on the enclosed project plans.

Gentlemen:
Attached is approved Right of-Way Encroachment Agreement cover-
ing ins to lla tion of a sanitary sewer force main and gravity sewer along
various routes in the East Lincoln County Water & Sewer District Contract #3
and #4. No open cuts of the pavement for road crossings are approved in this
contract. All road crossings are to be accomplished by a method of boring or
boring and jacking, as shown on the attached map and plan sketch in
Lincoln County.
The encroaching party will be responsible for installation of
all necessary erosion control devices.
Approval is given subject to provisions in the Agreement and
attachments thereto which are made a part of the Agreement.
It would be appreciated if you would advise our District Office
at Shelby prior to the date of beginning work on this installation.
The Department of Transportation does guarantee the right of
way on this road, but will not be responsible for any claim for dam-
ages brought by any property owner by reason of the installation.
The encroaching party will be responsible for notifying the
Department of Transportation when work is completed.
Please advise, in writing, when this work has been completed.

In accordance with your appl16?_?'ceived April 6, 1995, we are forwarding herewith Permit
No. WQ0010866, dated June 13, 1995, to the County of Lincoln ("County") for the construction and
operation of the subject wastewater collection extension. The pump stations associated with the force
mains included in this permit (Pump Station Nos. 3, 4, 5, 6 and 10) are covered under Permit No.
WQ0010918.
In accordance with condition 16 and the project summary provided by Lincoln County, the County
shall be responsible for the overall operation of the system. By providing properly trained plumbing
contractors and the appropriate grinder pumps for the system, the County shall ensure, to the best of its
ability, proper set-up, operation and maintenance.
This permit shall be effective from the date of issuance until rescinded, and shall be subject to the
conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within 30 days following receipt of this
permit. This request must be in the form of a written petition, conforming to Chapter 150B of North
Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447,
Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding.
One set of approved plans and specifications is being forwarded to you. If you need additional
information concerning this matter, please contact Mr. Ray Cox at (919) 733-5083, ext. 549.

sedimentation control plan- We find the plan to be acceptable
and hereby issue this letter of approval.
please be advised that Title 15 NCAC 4B .0017(a) requires
that a copy of the approved erosion control plan be on file at
the job site;:' Also,;you should consider this letter to give the
Notice regaired-by•G.S. 113A-61(d) of our right of periodic
inspection to insure:oompliance with the approved plan.
North Carolina's Sedimentation Pollution Control Program is
performance oriented, kequiring protection of the natural
resources and adjoining properties. If following the
00=encement of this project it is determined that the erosion
and sedimentation control plan is inadequate to meet the
requirements of the Sedimentation Pollution Control Actoofi1973
(North Carolina General Statute 113A-51 thru 66), this ce may

The City of Lincolnton has annexed approximately 1,600 acres, and we have
recently completed the design of water and sewer improvements necessary to
serve the area.
Mr. Steve Chapin with the Corps of Engineers in Asheville has reviewed the
planned improvements and has determined that there are 0.10 acres of wetlands
affected by this project.
Mr. Greg Price with your office stated that a formal 401 submittal would not be
necessary as long as your General Conditions for Nationwide Permit 12 were met.
We will follow the General Conditions, including anti-seep collars, in the wetland
area.
