For the purposes of the Corps of Engineers' Regulatory Program, the "December 13, 1996 Federal Register, Final Notice of Issuance, Reissuance, and Modification of Nationwide Permits (61 FR 65874)" listed nationwide permits. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for fills for roads crossing waters of the United States (including wetlands and other special aquatic sites) provided: a. The width of the fill is limited to the minimum necessary for the actual crossing; b. The fill placed in waters of the United States is limited to a filled area of no more than one-third acre. Furthermore, no more than a total of 200 linear feet of the fill for the roadway can occur in special aquatic sites, including wetlands; C. The crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand, expected highflows and tidal flows, and to prevent the restriction of low flows and the movement of aquatic organisms; d. The crossing, including all attendant features, both temporary and permanent, is part of a single and complete project for crossing of a water of the United States; and e. For fills in special aquatic sites, including wetlands, the permittee notifies the District Engineer (DE) according to the "Notification" general condition. This notification must include a delineation of affected special aquatic sites, including wetlands. 2 Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEHNR). You should contact Mr.John Dorney, telephone (919) 733-1786, regarding water quality certification. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. It is incumbent upon you to remain informed of changes to the nationwide permits, which will be announced by public notice when they occur. If you commence, or are under contract to commence, this activity before the date the nationwide permit is modified or revoked, you will have twelve months from the date of the modification or revocation to complete the activity under the present terms and conditions of this nationwide permit. We have evaluated potential impacts of your activity, and we have determined that your proposal will not affect any endangered species. When you have completed your work and any required mitigation, please sign and return the enclosed certification form. It is my understanding that you conducted a site inspection of the proposed work area, earlier this month. I am also enclosing a copy of March 21, 1997 letter from Robert W. Johnson, Office Manager, Asheville Regulatory Field Office, US Army Corps of Engineers (COE), advising Vulcan Materials Company (Vulcan) of the COE's authorization of this proposed creek crossing under Nationwide Permit No. 14 (NWP14). As you are aware, the COE authorization is conditional upon receipt of a Section 401 water quality certification from your office. Hence, the submittal of the enclosed application for Section 401 Certification. It was our understanding that because the proposed creek crossing would impact such a small area (approximately 75 square feet) that no permit nor was any prior notice required to be given to state agencies or the COE to conduct such activity. However, because of our desire to keep the regulatory agencies informed, we did notify both your office and the COE of the proposed creek crossing. We are uncertain why the COE subsequently issued a NWP14; nevertheless, we wish to complete the permitting process with your concurrence. Box 4195 Winston-Salem, NC 27115-4195 Dear Mr. Poplin: You have our approval, in accordance with the attached conditions, to place fill material in acres of wetlands or waters for the purpose of constructing a road crossing at potential rock quarry, as you described in your application dated 27 March 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3103. This Certification allows you to use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow "the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The purpose of this visit was to examine the proposed road crossing as well as streams and wetlands on the property. As you have discussed with the Corps of Engineers, temporary access roads for quarries are exempt from needing 404 Permits (and thereby exempt from needing a 401 Water Quality Certification from the State). If this access road construction did require a 404 Permit and 401 Certification, we would have no objection to its construction due to its location in the disturbed powerline corridor. We understand that mining plans are unclear at this time and therefore it is not clear whether any streams or wetlands would be proposed to be mined. The crossing is being proposed by Vulcan Materials Company on asite which they are leasing with the intent of developing a rock quarry. The crossing will be placed across the upper reaches of one minor un-named intermittent tributary stream to provide access to the site for exploratory drilling. The crossing is located at the edge of an existing Duke Power powerline and will cross the channel at the narrowest point in the channel which has no sidestream wetlands. The width of the channel at the point of crossing is approximately 4'- 5' wide and 6" deep with a rock bottom. Vulcan Materials proposes to place geotechnlcal fabric and large rip-rap across the channel in order to stabilize the soil surface in order to protect and preserve water quality. The large rip-rap will allow stream flow to occur unimpeded. The crossing is intended to occupy approximately 15 feet of upland on either side of the channel and to be less than 15 feet wide. The total temporary impact to waters is expected to be less than 100 square feet. It is my understanding that this activity does not require a specific authorization since it is temporary and very minor in nature. Every effort will be made to avoid and minimize impacts to wetlands by crossing at a narrow point in the stream and to stabilize the point of crossing. If possible could you provide a brief letter (even aform letter) to confirm this or please advise us otherwise if some type of authorization is needed. I am also sending a letter to Steve Lund, U.S. Army Corps, to notify him of the proposed crossin. If Vulcan Materials Company should determine thatthe site has the potential to become a rock quarry, they will have a complete delineation of all wetlands on the property performed and will secure all necessary authorizations as a part of the design process. I performed a cursory wetland determination on the entire site so that the extent of wetland would be known to Vulcan Materials before they considered exploration of the site. Dr. Jim Matthews has already conducted a review of the site for endangered species and has located none in the vicinity of the proposed crossing. OCT 4 1996 DIRECfCp'.,,3 0# F I C E b Dear Preston; WATER QUALITY A highly secret (and highly suspect) session of the Mecklenburg Co mission has granted Vulcan Materials Corporation a preliminary permit to build a rock quarry (i.e. STRIP and future asphalt and concrete plants in a well populated residential area (R3) of NW Charlotte. This is an environmental outrage!! The 280 acre tract of land is one of the last pristine areas of old growth forest and wetlands in the county. It is completely surrounded by hundreds of homes that will be rendered virtually worthless if Vulcan is allowed to blast a hole hundreds of feet deep - literally - into their backyards! This ecological catastrophe will surely dry up or permanently pollute hundreds of wells throughout the area with the free flow of particles back into what's left of the water table. The site is extremely close to the intake for the Charlotte Mecklenburg water supply and only a half mile from the 75 year old Mountain Island Dam (circa 1921) which will surely be effected by the hundreds of mini-earthquakes it will have to endure each year. The FACTS: 1. Vulcan Materials is the 7th largest polluter in the United States (latest government data published 1992). 2. Well over 100 years of rock is left in the nine (9) already existing quarries surrounding the Charlotte area (recently declared industry data), 3. Vulcan's only reason for developing this site is to gain a slight economic advantage over it's competitors supplying materials for the future outer belt (source - Vulcan Materia?s!o. 4. In doing so, they will destroy the quality of life and the life savings of hundreds of families in the immediate area and potentially thousands down-stream on Lake Wylie.
