'A V )A Nikki ?EHNR September 9, 1997 Mecklenburg County DWQ Project # 9702A APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Mr. Eric Kenny Altman Development Corp. 2201 Corporate Blvd. NW Suite 200 Boca Raton, FL. 33431 Dear Mr. Kenny: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in about 0.33 acres of wetlands or waters for the purpose of constructing a road crossing and apartment building and parking lot at Mallard Church Road and Prosperity Church Road, as you described in your revised application dated August 25, 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwatgr, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Deed restrictions, conservation easements or similar mechanisms shall be placed in all lots with remaining jurisdictional wetlands and waters to restrict future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds (T 15A:04B .0024). Stormwater shall be directed to flow at non-erosive velocities into the remaining wetlands onsite. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Wetlands observed by the writer consisted of a mixture of intermittent stream channels accompanied by a series of braided stormwater channels. The immediate area surrounding the wetlands appears to have been left undisturbed for at least 50+ years based on the size of the trees and understory. A very diverse plant community was observed, including an excellent population of what appeared to be pitcher plants. The existing wetlands are performing very valuable functions based on its location in the landscape, and should be preserved to the extent considered practical. It should also be pointed out that land grading equipment has disturbed a section of the intermittent tributary (and associate wetland) on the southwest portion of the site. The disturbance has somewhat hindered stream flow in the tributary. This area should be returned to natural grade and any felled trees removed from the existing intermittent stream channel. Altman Development Corp. 401 Page Two Although the original 401 Certification submittal received by this Office for this project did not identify the specific wetland impacts on the site map, a preliminary site plan was faxed to the writer on June 5, 1997. Based on our review of the preliminary site plan, we concluded that the applicant has not taken sufficient precautions to minimize wetland impacts in the layout of this project. Therefore, it is recommended that the Central Office inform the applicant that the current project layout is insufficient in its attempt to minimize wetland impacts. Specifically, the location of the site entrance and the thoroughfare which travels around the proposed clubhouse does not even attempt to avoid wetland impacts. The applicant has also indicated to the writer that if forced to move the proposed site entrance northeast, it will eliminate one (1) of the proposed commercial buildings planned for the site. Such being the case, the applicant should be informed that it is our intent to deny the project, pending receipt of a site plan which shows a concerted effort on the part of the applicant to avoid/minimize impacts to the existing wetlands. ED FE F1 June 11, 1997 The Division of Water Quality has reviewed your plans for the discharge of fill material into 0.93 acres of waters and/or wetlands located at Mall and Creek Church Road and Prosperity Church Road in Mecklenburg County for apartment and commercial development. Based on this review, we have identified significant uses which would be removed by this project. These uses are water storage, pollutant removal and wildlife habitat. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, we are moving toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e). Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold. We will also place the project on hold due to incomplete information. Please provide us with information supporting your position that your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can you construct your project with only road crossings of the two smaller wetlands and no lot (building) fill? The clubhouse would also have to be moved to avoid wetland fill. Stormwater management could be done by constructing smaller dry detention basins and then utilizing the remaining wetlands on-site to filter the runoff from the basins. Finally our Regional Office staff observed some impact to the wetlands. You are hereby reminded that wetland fill should not occur until DWQ issues the 401 Certification and the Corps of Engineers issues the 404 Permit for this project. Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification. Please respond within two weeks of the date of this letter by sending a copy of this information to me and one copy to Mr. Mike Parker at the Mooresville Regional Office at 919 North Main Street, Mooresville, NC 28115. Any final approval will need to be coordinated with the DWQ Central and Regional Office. If we do not hear from you in two weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. (Trigon) is submitting a request for permission to alter a wetland under a Nationwide Permit Section 401 of the Clean Water Act. This letter documents the procedures Trigon followed to locate and delineate potential wetlands located on two wooded tracts in totaling 29 acres in Mecklenburg County that Altman Development Corporation intends to develop. Potential wetland areas on the site were identified based on Trigon's visual observations, , USDA-SCS soils mapping, and the 1991 National Wetlands Inventory Map (US Fish and Wildlife Service) of the area. One potential wetland area of approximately local on the site was identified in the southeastern portion of the site. A second area, less than 0.05 acres insize, was identical in the eastern portion, adjacent to the golf course. Due to the small size, not applications are being submitted for this area. The potential wetlands identification was conducted according to the January 1987 Corps of Engineers Wetlands Delineation Manual. Vegetation types were identified using the documents Southern Wetlands Flora (1988, USDA-Soil Conservation Service, Southern National Technical Center), and the National List of Plant Species That Occur in Wetlands: 1988 (May 1988, National Wetlands Inventory/US Fish and Wildlife Inventory). The Routine Wetland Determination Form included in the 1987 COE Wetlands Delineation Manual was used to record data and field observations. A copy of the form completed by Trigon for the potential wetland area is attached. An area in the eastern portion of the site was determined by Trigon to met the criteria for wetlands, as defined by the Corps of Engineers. In accordance with Trigon's agreement with Altman Development Corporation, the perimeter of the area was flagged in preparation for surveying by ESP Associates. The identified potential wetland area extends onto the adjacent property. Trigon delineated the perimeter of a portion of the wetland that extended beyond the site boundary however, this area is not included in this permit application. The potential wetland area on the Altman Development Corporation property encompasses 0.93 (calculated) acres. The area of the entire wetland was not determined. Trigon requests that a written response to this request for permission to alter wetlands be submitted to the address below and that a copy of the response be submitted to Trigon for our files. (Trigon) is submitting a request for permission to alter a wetland under a Nationwide Permit Section 401 of the Clean Water Act. This letter documents the procedures Trigon followed to locate and delineate potential wetlands located on two wooded tracts in totaling 29 acres in Mecklenburg County that Altman Development Corporation intends to develop. Potential wetland areas on the site were identified based on Trigon's visual observations, USDA-SCS soils mapping, and the 1991 National Wetlands Inventory Map (US Fish and Wildlife Service) of the area. One potential wetland area of approximately local on the site was identified in the southeastern portion of the site. A second area, less than 0.05 acres insize, was identical in the eastern portion, adjacent to the golf course. Due to the small size, not applications are being submitted for this area. The potential wetlands identification was conducted according to the January 1987 Corps of Engineers Wetlands Delineation Manual. Vegetation types were identified using the documents Southern Wetlands Flora (1988, USDA-Soil Conservation Service, Southern National Technical Center), and the National List of Plant Species That Occur in Wetlands: 1988 (May 1988, National Wetlands Inventory/US Fish and Wildlife Inventory). Soil colors y Mr. Greg Price April 29, 1997 Page Two were determined using the 1990 Munsell Soil Color Chart. The Routine Wetland Determination Form included in the 1987 COE Wetlands Delineation Manual was used to record data and field observations. A copy of the form completed by Trigon for the potential wetland area is attached. An area in the eastern portion of the site was determined by Trigon to met the criteria for wetlands, as defined by the Corps of Engineers. In accordance with Trigon's agreement with Altman Development Corporation, the perimeter of the area was flagged in preparation for surveying by ESP Associates. The identified potential wetland area extends onto the adjacent property. Trigon delineated the perimeter of a portion of the wetland that extended beyond the site boundary however, this area is not included in this permit application. The potential wetland area on the Altman Development Corporation property encompasses 0.93 (calculated) acres. The area of the entire wetland was not determined. Trigon requests that a written response to this request for permission to alter wetlands be submitted to the address below and that a copy of the response be submitted to Trigon for our files.
