Drawer 1219 Rocky Mount, NC 27802 Dear Mr. Esham: [D F= F=1 March 17, 1997 Hyde County WQC 401 Project #970160 You have our approval, in accordance with the attached conditions, to dredge in 0.6 acres of waters for the purpose of dredging an area and constructing a dock, bulkhead and upland spoil area at SR 1328 near Silver Lake, as you described in your application dated 9 January 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specked in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant proposes dredging, dock construction, mooring facilities, a dock house on highground, land disturbance to establish a spoil area for hydraulic dredging, and bulkhead construction. SUGAR CREEK PROPERTIES W.E. and David Esham Ocracoke Island, Hyde County The applicants' property(s) is located on SR 1328, locally referred to as the Lake Road, circling the southeast end of Silver Lake harbor off Pamlico Sound on Ocracoke Island in Hyde County, North Carolina. There are two residential structures on the property, the larger of the two structures is locally known as the "Castle" and the smaller "Whittlers Club". There is an existing pier approximately 200' long with a net shed on the Whittlers Club property. There is an existing bulkhead along a section of the shoreline, while riprap stabilizes the remaining shoreline. There is a small amount of Spartin alterniflora marsh seaward of the existing bulkhead. The upland area consist of sandy soil with upland grasses and red cedar and has been subdivided into six (6) lots with SR 1328 transecting the property. Although shellfish, including oysters, clams and mussels, inhabit this area, Silver Lake is closed to harvest. The applicant proposes to excavate a total square foot area of 27,200 square feet. The average depth of material to be removed is 4' in an effort to establish a consistent 8' water depth for boat mooring. Water depths in the area to be dredged graduate from 8', the finished project depth, to an existing 2' depth at the shallowest end nearest shore. The material to be excavated is coarse sand and shell. The proposed final project depth of 8' will connect to existing water depths equal to or greater than 8' deep in Silver Lake. Excavation is proposed by hydraulic dredge with a spoil disposal area to be constructed on adjacent highground. As previously mentioned, this tract of property has been subdivided into six (6) lots. Lot No. 1 already has an existing pier approximately 200' long and an accompanying net shed with suitable space for mooring 4 boats. The applicant is proposing a 148' long by 6' wide pier with an 8' wide by 35' long "L" to the east on Lot 2 and a 105' long by 6' wide pier with an 8' wide by 40' long "L" to the west on Lot 6. The "A" pier on Lot 2 also has a 15' long by 3' wide finger pier and the "B" pier on Lot 6 has a 45' long by 3' wide finger pier. Each pier will have mooring facilities for 4 boats. One of the mooring facilities on pier "B" is a 14' by 13' boat lift. The applicant is also proposing a 12' by 12' square fish cleaning station over the water on pier "B". Excluding shading from potential use of water craft in the proposed slips, the actual area shaded by piers and platforms is 2,328 sq., ft. Pier "B" also includes a 16' by 16' dock house to be constructed on highground. The proposed piers, both pier "A" and "B", and their associated moorings cross the riparian lines between properties. The applicants have addressed this situation through easements to be attached to the respective deeds. Although the shoreline of this property is stabilized via bulkhead and riprap and consequently not subject to any ongoing erosion, the applicant is proposing approximately 141' of new bulkhead averaging 2' offshore. The new bulkhead is proposed immediately waterward of the existing riprap and connecting to the existing bulkhead such that the entire shoreline along this property will be protected by a continuous bulkhead. The project as proposed will result in the excavation of a 27,200 sq. ft. area (0.6 acres) of bottom within Silver Lake. There are no emergent wetlands to be excavated or filled. Pier, bulkhead, and platform construct ion will shade a total square foot area of 2,328 sq. ft. Excavation and pier construction will result in short term localized turbidity. Construction of the diked disposal area and associated spoil disposal will result in excavation, sloping and seeding (land disturbance) on the adjacent highground. Terry E.
