As we discussed, the water quality standard for turbidity (50 NTUs) is considered to be met as long as all required sediment and erosion control measures as outlined in the most recent edition of the "North Carolina Sediment and Erosion Control Manual) are designed, installed and maintained properly. The turbidity water quality standard is described in 15A NCAC 26 .0211(3)(k) (attached). Water quality sampling is not a requirement of this Certification and should not be needed as long as BMP's are properly installed and maintained. In reviewing the Conditions of Certification, out attention was drawn to Condition No. 6, regarding sediment and erosion control. We understand that it will be necessary to obtain the required Sediment and Erosion Control Permit for this construction, and that we must comply with all provisions of that performance based permit. However, we did not think that that the performance was based upon a turbidity water quality standard such as 25 NTUs, as Condition No. 6 implies. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This Certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Proposed fill or substantial modification of any amount of wetlands classified in accordance with 15A NCAC 2B .0101(e)(7) as Unique Wetlands (UWL) shall require written concurrence from the Division of Water Quality in accordance with 15A NCAC 2H .0506(e); 4. For the purpose of this Certification, streams are defined as blue or purple lines for permanent or-intermittent streams as shown on the most recent version of the USGS 1:24,000 topographic map or other site-specific data; 6. That appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent edition of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Ca olina Surface Mining Manual" (available from the Division f Land Resources in the DEHNR Regional or Central O fices) must be utilized to prevent exceedances of the appro riate turbidity water quality standard (50 NTUs in streams a d rivers not designated as trout waters by DWQ; 25 NTUs i all saltwater classes, and all lakes and reservoirs; 10 N s in trout waters); 7. All sediment and erosion control measures pl ced in wetlands and waters shall be removed and the natural rade restored after the Division of Land Resources has rel ased the project; 8. Additional site-specific conditions may be a ded to projects with greater than one-third acre impact to w tlands or 150 of ^treams which are proposed un er this *a,_r r ?r to ensure compliance c ir_n all applicable water quality and effluent standarcxs; 9. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 10. If an environmental document is required, this Certification is not valid until a FONSI or ROD is issued by the State Clearinghouse; 11. Concurrence from DWQ that this Certification applies to an individual project shall expire on 13 December 1998 to coincide with the expiration date of Nationwide Permit 26. Non-compliance with or violation of the conditions herein set forth by a specific fill project shall result in revocation of this Certification for the project and may also result in criminal and/or civil penalties. The Director of the North Carolina Division of Water Quality may require submission of a formal application for individual certification for any project in this category of activity, if it is determined that the project is likely to have a significant adverse effect upon water quality or degrade the waters so that existing uses of the wetland or downstream waters are precluded. Public hearings may be held for specific applications or group of applications prior to a Certification decision if deemed in the public's best interest by the Director of the North Carolina Division of F;nvironmental Management. The purpose of this mitigation plan is to compensate for the filling of wetlands and waters of the US from the expansion of the landfill. This plan is included as part of the submittal of a Pre-Construction Notification (PCN) application for a Nationwide Permit # 26. PROJECT DESCRIPTION The Piedmont Landfill & Recycling Center is located on the Guilford/Forsyth County line approximately ten miles north of Kernersville, North Carolina. A 255-acre expansion of the landfill is proposed to include an area northeast of the existing facility in Guilford County. Construction of this project will require the filling of three intermittent streams and associated jurisdictional wetlands. The total acreage of impacts to the intermittent streams and adjacent wetlands is 0.38 acres. PROPOSED MITIGATION Along the northern edge of the existing landfill and adjacent to the floodplain is an area currently used for storage of gravel and has in the past been used to store shredded tires. This upland area consists of approximately 3 acres and currently has an elevational range of 750 to 765 feet above msl. A portion (approximately 1.0 acres) of this area will be converted to wetlands by grading to an elevation slightly lower than that of the existing adjacent floodplain (740 feet). By grading to an elevation lower than the existing floodplain, a depressional area will be created. This will reduce surface runoff from the mitigation area and create wetland conditions. Grading would involve removal of 10 to 15 feet of soil in this area. The adjacent upland areas (to the south) will be graded to a slope of 10 %from the uplands to the created wetland. An existing wetland area is located immediately northwest of this mitigation area. Dominant canopy vegetation in this wetland includes black willow, sycamore, red maple, sweet gum, alder, and green ash. The understory contains elderberry, and Vibernums. Common herbs include jewel weed, soft rush, sedges, cattails, arrowhead, and lizards tail. This wetland will be used as a reference for both hydrology and elevation. The created wetlands will be contiguous with these existing wetlands and will serve as an additional buffer area to potentially reduce sediment runoff from upland areas to the adjacent creek. Surface water from the landfill currently collects in drainage ditches around the perimeter of the landfill. Several of these ditches empty into a small sediment basin located immediately to the west of the proposed mitigation area. The overflow of this sediment basin currently drains to the existing wetland area to the north. This water will be partially diverted to flow into both wetland areas (existing and created). Additional surface runoff occurs from an adjacent upland area to the south of the mitigation area which is at a higher elevation (760 to 790 feet). 11:\200749\MCrPLAN.nrr July 1997 Mitigation Plan Piedmont Landfill Expansion A floodway study has also been conducted which indicates that the 25-year floodway elevation at this point of the stream is 741.4 feet msl. Although the annual flood elevation was not determined, if necessary, additional water from the stream should be available to augment surface runoff from the landfill area to increase the wetness of the area. PLANTING Once grading within the mitigation area is complete, all disturbed areas within the mitigation site will be seeded with a wetland/wildlife grass mixture. Three or four tree species will be planted in these areas. Tree species (dependent upon availability) may include water oak, swamp chestnut oak, willow oak, green ash, and sycamore.
