Box 31528 Raleigh, NC 27622 Dear Mr. Weintraub: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.683 acres of wetlands or waters for the purpose of constructing the Bryarton subdivision at Jones Franklin and Dillard Road, as you described in your application dated 21 July 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3101, 3103 and 3108. These certifications allow you to use Nationwide Permit Numbers 12, 14 and 26 when they are issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non- Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and an y additional conditions listed below. Deed restrictions, conservation easements or similar mechanisms shall be placed in all lots with remaining jurisdictional wetlands and waters to restrict future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later)(see condition 3). Stormwater from the subdivision shall be directed to flow at nonerosive velocities into remaining wetlands. No direct stormwater discharge to channels is allowed in accordance with 15A NCAC 2B .0233. Applicant is reminded that DWQ rules (15A NCAC 2B .0233) require that existing wooded buffers not be disturbed for a width of 50 feet on each side of all streams on the property. All deeds for lots which are affected by this rule must note this restriction on the deed. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. Z7611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Wetland and channel impacts total 0.683 acres. As designed impacts to intermittent channels (field confirmed) total 110 linear feet. The project, which is managed by Centex Homes, is located in Raleigh, NC (Wake County) south of Jones Franklin Road and west of Dillard Road (see vicinity map). Surveyed jurisdictional wetland areas were reviewed by Mr. Eric Alsmeyer from the Raleigh Regulatory Field Office of the USACOE. Channels are intermittent and no significant loss of functions will result. Impacts to intermittent channels do not exceed 150 linear feet. Typically no wetland mitigation is required for projects that impact intermittent channels. In order to minimize impact, the orientation of the road crossing will be perpendicular to the channel and at the narrowest possible location of the surrounding wetland area. Road crossing side- slope stabilization will account for the balance of impacts. Please call if you have questions or require further information. The subject wetland (area indicated on attached map) is located at the back of a beaver swamp and is adjacent to a small stream. It was observed that this wetland receives, as sources of saturation and inundation, water form both overbank flooding and from episodic impediments of flow from downstream beaver activities (likely seasonally inundated). Acer rubrum, Arundinaria gigantea, Smilax spp., Peltandra virginica, woodwardia areolata, Leucothoe racemosa were prominent. Note: This early successional beaver swamp had a largely closed canopy but some trees were down from Fran.... The project proposes to totally impact 0.683 acres. Because impacts under NW 26 are wwW 0.32 and NW 14 and NW 12 follow General Conditions it is unclear if minimization requirements can be pursued. However, if under the new rules it can be determined the Division can require minimization the RRO recommends the following conditions: 1) Shift the road crossing toward the cul-de-sac. This would result in the road crossing not being a perpendicular crossing but would reduce impacts under NW 26 and the lots currently proposed would have to be rearranged (one possibly lost). The end result would be more impact under NW 14, less impact under NW 26 and total reduction of wetland impacts by approximately 0.2 ac (my estimate). Please note: This is not a bad project. The issue is the notable function observed by evidence of overbank flooding and water storage.... 2) deed restriction language....
