This area will be located between Jackson Park Rd. and the proposed ballfield #11 (figure 1). This area will be managed in such a way as to encourage the continued presence of the American Woodcock which uses this area for its' mating ritual and other song birds and animals. The management of this area will involve bush hogging once or twice a year to keep the vegetation as low brush and prevent regeneration. In our original estimate, we figured the wetlands amounted to 1.15 acres. This is an over approximation and in actuality the area is less than one (1) acre. As we discussed, in our original calculation we increased the size of the wetlands area marked by Steve Chapin, U. S. Army Corps of Engineers, in order to square up the sites and so the square footage would be easier to measure. In the process, we over estimated the size of the wetlands areas. Therefore, in re-calculation we have determined the wetlands that would be impacted amounts to approximately. 95 acre. 1 wanted you to have this information before you made your determination of certification for the project. Army Corps of Engineers a DEPARTMENT OF THE ARMY Wilmington District, Corps of Engineers Post Office Box 1890 Wilmington, North Carolina 28402-1890 Action ID No. 199702007 January 16, 1997 PUBLIC NOTICE THE HENDERSON COUNTY PARKS AND RECREATION DEPARTMENT, 801 GLOVER STREET, HENDERSONVILLE, NORTH CAROLINA 28792 has applied for a Department of the Army (DA) permit TO PLACE FILL MATERIAL INTO APPROXIMATELY 1.15 ACRES OF WETLANDS AT JACKSON PARK, OFF OF JACKSON PARK ROAD, IN HENDERSONVILLE, HENDERSON COUNTY, NORTH CAROLINA. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show that the applicant proposes to fill an approximately 3.67 acre area adjacent to Mud Creek in Jackson Park. Of this 3.67 acres, approximately 1.15 acres of the area is jurisdictional wetlands. These wetlands have been impacted by repeated bush hogging and mowing for many years prior to submittal of the permit application. The applicant plans to fill the 3.67 acre area with dirt to raise the elevation to above flood levels. Adding fill will bring the site up to the level of the adjacent access road and existing Ballfield #8. The purpose of the project is to raise the level of the site and construct a new ballfield. The applicant has determined that the ballfield is needed to accomodate increased demand in the county for softball playing areas. In order to offset the loss of the 1.15 acre wetland area, the applicant is proposing to preserve an adjacent 3.65 acre wetland area and enhance and manage the area for the American Woodcock. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (NCDEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is *not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District -2- Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies, 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. V -3- Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Environmental Management (NCDEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army (DA) permit serves as application to the NCDEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management (NCDEM), Salisbury Street, Archdale Building, Raleigh, North Carolina. This area will be located between Jackson Park Rd. and the proposed ballfield #11 (figure 1). This area will be managed in such a way as to encourage the continued presence of the American Woodcock which uses this area for its' mating ritual and other song birds and animals. The management of this area will involve ' bush hogging once or twice a year to keep the vegetation as low brush and prevent regeneration. Winston-Salem HowRlver According to the Public Notice from the Corps of Engineers, the applicant proposes to fill Burlington approximately 3.67 acres adjacent to Mud Creek in Jackson Park, in order to raise the elevation of the site to above flood level, for construction of a new ballfield "to accomodate increased Headwaters Durham demand in the county for softball playing areas." According to the Public Notice, approximately 1.15 acres of the 3.67 acre site is jurisdictional wetlands. Horace Kepsrt Fayetteville The Corps Public Notice states: "In order to offset the loss of the 1.15 acre wetland area, Medoc the applicant is proposing to preserve an adjacent 3.65 acre area and enhance and manage the Rocky Mount area for American woodcock." Research Triangle REASONS FOR DENIAL Chapel Hill sandhills (1) The applicant's proposed mitigation fails to comply with T15A: 02H.0506 (h) (6) of Southern Pines the North Carolina Administrative Code (in Section .0500, Water Quality Certification), which south states: Mountains Morganton "All mitigation proposals shall pmvide for the replacement of wetland acres lost due to tWEHOCA the proposed activity at a minimum of a 1:1 ratio through restoration or creation prior to Asheville utilizing enhancement or preservation to satisfy the mitigation requirements, unless the Director determines that the public good would be better served by other types of mitigation." ilsw To cTfore, enjoy, and protect the wiGf places of the earth; to practice and promote the nsponsib(e use of the earth's ecosystem and resources... s The applicant's proposed mitigation fails to comply with (h)(6). Restoration or creation alternatives have not been analyzed or demonstrated in any way whatsoever, according to material in the Public Notice. (2) The applicant's proposed mitigation fails to comply with TI 5A: 02H .0506 (h)(7) The rule at (h) (7) outlines mitigation ratios based on distance from streams. According to Figure #1 or 4 in materials attached to the Public Notice, 'Wetlands Area #3" is almost entirely within 150 feet of Mud Creek, a perennial creek in the professional opinion of this observer, illustrated as such on the most recent USGS 1:24000 map, and described as such in numerous places by the NCDWQ. All areas of proposed wetland fill illustrated in Figure #1 of 4 appear to be within 1000 feet of Mud Creek. The mitigation ratio proposed for these proposed enhancement and preservation action approximately 3:1 in each category, is significantly less than what is mandated in the Administrative Code. Ratios required by (h)(7) appear to be: for enhancement/ preservation: 8:1/20:1 for areas within 150 feet of Mud Creek; 4:1 /10:1 for areas between 150 and 1000 feet fror Mud Creek. These ratios appear to apply here because: this is not a linear project; and, the applicant has not cited use of any "approved mitigation sites where the state and federal review agencies have approved credit/ debit ratios." Based on the applicant's maps and materials, these actions would require enhancement of between 6 and 7 acres of existing jurisdictional wetland, or preservation of between 14 and 15 acres (acreages are approximate), It is not clear from the applicant's materials if the 3.65 acre "wetland area" to be preserved and enhanced is entirely jurisdictional acreage. (3) In addition, the applicant does not demonstrate how biannual bush-hogging qualifies as habitat enhancement for the American woodcock. No proof is offered that the woodcock occurs in this location, or that 'low brush" is needed as habitat for any woodcock which might possibly occur in this location. (4) Further the preservation activity presented as mitigation simply proposes that no further development beyond bush-hogging (which is defined as "preservation") would occur or the fill site. This preservation activity is completely without regulatory significance if the land i already in ownership of Henderson County Parks and Recreation, which it appears to be (Map analysis, and personal observation). If you change your project, you must notify us and you may be required to submit a revised application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed below. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion control, Coastal Stormwater, Non-discharge and Water Supply watershed regulations. Condition(s) of Certification: 1. That appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the DEHNR Regional or Central Offices) are utilized to prevent exceedances of the appropriate turbidity water quality standard (50 NTUs) in all saltwater classes, and all lakes and reservoirs; and 10 NTUs in trout waters); 2. If total wetland fill exceeds one acre, compensatory mitigation at a 1:1 acreage ratio of restoration or creation will be required. Violations of any condition herein set forth shall result in revocation of this Certification and may result in criminal and/or civil penalties.
