Syracuse, UT 84075 Dear Mr. and Ms. Willis: [D EHNF1 February 13, 1997 Hydy County DWQ Project # 970037 You have our approval, in accordance with the attached conditions, to dredge in 11,050 square feet of waters for the purpose of excavating an area to construct a pier, gazebo and pilings at your property on Silver Lake, as you described in your application dated 6 January 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3112 and 3105. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: Applicant proposes to excavate ±2,455 cu. yd. of material to provide deep water access to a proposed a pier, "T", platform with a gazebo, decked access over coastal wetlands and 8 mooring pilings. Willis Ocracoke Island, Hyde County Project setting The project site is located adjacent SR 1328 on Ocracoke Island on the south side of Silver Lake, off the Pamlico Sound, in Hyde County, North Carolina. The average water depth at proposed project site is ±2' below the normal water level (NWL). Coastal Wetlands, consisting of Snartina alterniflora, Spartina patens, Distichlis i? cata, Juncus roemerianus, and Limonium spp. borders the high ground area of the Willis property. The high ground portion of the Willis property is vegetated by upland grass. There are other piers constructed on neighboring properties surrounding Silver Lake. Some of these piers were constructed prior to the CAMA, while others were permitted by the Division. Silver Lake is an Estuarine Water classified as SC waters by the Environmental Management Commission. Silver Lake is not designated as a Primary Nursery Area. Although shellfish (oysters, clams and mussels) inhabit Silver Lake, the lake is closed to harvest. Project description The applicant proposes to excavate an average depth of -5 ft. of material in an area ±130 ft. long by ±85 ft. wide for a total of ±2,455 cubic yards. The proposed area to be excavated is ±30 ft. waterward of the Coastal Wetland area. The material to be excavated is coarse sand. The proposed project depth is -8 ft. NWL which will establish a consistent ±8 ft. water depth around the proposed pier and connection to waters of equal or deeper depth in Silver Lake. The excavation will be conducted using a hydraulic dredge and the dredged material will be pumped into a diked disposal area owned by Mr. Edward Wrobleski. The proposed high ground dredge spoil area has been permitted under CAMA/D&F Permit #22-62 issued to Mr. Daniel Wrobleski. Mr. Wrobleski's property is located ±500' northeast of the proposed project site. The applicant is also proposing to construct a ±150 ft. long by 6 ft. wide pier with a ±30 ft. by ±16 ft. platform, a ±10 ft. by ±10 ft. gazebo on the platform, a 45 ft. by 6 ft. "T" at the waterward end of the pier and 8 mooring pilings. 6 ft. of the platform will be constructed over the Spartin alterniflora. In addition, access to the proposed pier from the high ground will be via a 45 ft. long by 6 ft. wide decked access over coastal wetlands. The 150 ft. pier length is the maximum allowed under the Ocracoke Section of the Hyde County Land Use Plan under paragraph (f) on page IV-10. Anticipated impacts The project proposed will result in the excavation of±11,050 ft' of sound bottom as well as the shading of ±1,002 ft2 of sound bottom and ±738 ft2 of coastal wetlands. The excavation and pier construction activities associated with this project will result in short term, localized turbidity. The associated spoils are to be pumped into a high ground, diked disposal area. Jeffrey R.
