Preston Howard, Jr., P.E., Director APPROVAL of 401 Water Quality Certification and Mr. Roland Dale Route 1, Box 205 Englehard, NC 27824 Dear Mr. Dale: A4 FE October 27, 1997 Hyyde County DWQ Project #970019 ADDITIONAL CONDITIONS You have our approval, in accordance with the attached conditions and those listed below, to conduct maintenance excavation in waters at your operty along gray ditch (lake Landing Canal) at SR 1116 near Nebraska, as you described in your revise application dated February 3, 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This a val is only valid for the purpose and design that you described in your application except as modified below. If you change your protect, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A 14CAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Dredging shall not exceed original width (70 feet) and depth (-6 NWL) in the canal. 2. Future 401 Certifications will not be granted for additional canal widening. 3. An "as built" dredge plan shall be sent to the Washington Regional office once the project is completed. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. John Dorney FROM: Eric Fleck SUBJECT: Roland Dale 401 WQ Modification/ HYDE DWQ#970019 The original 401 contained the following specific conditions: "dredging shall not exceed original width and death (-6 NWLI in the canal" During a 10/17/97 site visit Mr. Eric Fleek and Mrs. Deborah Sawyer met with the agent Mr. Joe Lassiter. Based on this meeting and the updated plats provided, DWQ believes that the applicant should be able to widen the channel to 70' from the bridge at SR 1116 and SR 1110 (Watson's Corner) for an approximate length of 2,600' (see Platt). Based on information gathered by Mr. Lassiter and by CAMA (as is represented on the newest plat) the existing width of the canal seaward (i.e. south towards Wysocking Bay) is greater on average than the 70'proposed width in and around Watson's Corner (i.e. landward). Therefore, the 401 should be modified and contain the following conditions: MODIFICATION 1) The width of canal extending from the bridge at the intersection of SR 1116 and SR 1110 (near Watson's Corner) for approximately 2,600 linear feet (see DETAIL figure on attached Platt) be widened to NO GREATER THAN 70'. CONDITIONS 2) No other 401 WQ Certifications be granted at this site for additional canal widening. Routine maintenance dredging of existing (including the new aforementioned widened portion) widths and depths of canals on this site will be allowed so long as they comply with all conditions of the General Permit. 3) An "as built" dredge Platt should be sent to the Ceal Office once the project is completed. Therefore, this work, undertaken without the prior approval from this office in the form of a Department of the Army (DA) permit, or a modification of the DA permit previously issued to you for maintenance excavation of the Lake Landing Canal, is a violation of Section 301 of the Clean Water Act (33 USC 1311). I understand that you have verbally agreed to cease and desist from any further unauthorized work within waters of the United States, and further agreed to perform all requested restoration work. The Division of Coastal Management cannot issue the CAMA Permit unless the our Division certifies that there no violation of water quality standards will occur from this project. We have no objection to dredging the canal to restore its original depth and width. However we are concerned that widening the uppermost end of the canal will create poor water quality circulation problems and thereby violate our dissolved oxygen water quality standard (5 ppm). In order to address this concern, you or your consultant will need to monitor and model the dissolved oxygen in the canal in its present condition and then model the widened canal at its proposed dimensions. We believe that the existing DO model for marinas can be modified by your consultant to be appropriate in this case. Until this information is supplied, we hereby inform the Division of Coastal Management that the project should be placed on hold due to incomplete information. DEHNR Fax:9199753716 Roland Dale Hyde County Project Setting Jan 15 '97 1125 P.04/16 The project site is a section of Gray Ditch (Lake Landing Canal) beginning at the SR 1116 and SR 1117 split, at the bridge crossing, and running downstream ±6.417' to the intersection with Nebraska Canal near Nebraska in Hyde County, North Carolina. Gray Ditch (Lake Landing Canal) connects into Wysoeking Bay which is a part of Pamlico Sound, Wysoeking Bay is a notable water body in terms of finish and waterfowl productivity and habitat. Six Individual property owners are involved in the project and the total project site is +60.36 acres. The canal is bordered by an ±75' wide spoil berm which runs along the entire project site. The land adjacent the upper half (upstream) of the project area is agricultural fields and the area adjacent the lower (downstream) half is wooded wetland landward of the spoil berm. On the opposite bank of the existing canal, the upper half (upstream) is bordered by SR 1117 and the lower half (downstream) is bordered by coastal wetlands. The elevation of the tract is ±4' above the normal water level. The water depth of the canal at the project site varies in depth and has a maximum of -6' below the normal water level. The water deptYi at the intersection, of Gray Ditch (Lake Landing Canal) with Nebraska Canal is -6'. Gray Ditch (Lake Landing Canal) is classified as SC by the Environmental Management Commission. Gray Ditch (Lake Landing Canal) at the project site is a primary nursery area as defined by the Division of Marine Fisheries but is not open to shellfishing. Project description The appliamt proposes to undextal e, maintenance excavation of an existing X60' wide (top width) by ±6,417 ft long section of a manmade canal to a finished project depth of -6' below the normal water level. Along the upper half of the project area, the applicant proposes to widen the existing canal by ±30' for a linear distance of +3,013 ft. The resulting spoil will be placed on the existing ±75' wide spoil berm that runs the length of the project site. Anticipated impacts The project as proposed will result in the maintenance excavation of +320,850 fL2 of canal bottom, and the excavation of ±90,390 ftz of high ground. Dale, to submit for your review a Major CAMA Permit Application. The subject property is an approximately 60.36 acre tract of land located near Nebraska, in Hyde County, North Carolina. The work proposed in this application is the waintmanlce excavation of Lake Landing Canal as it runs along NC State Road 1116. Also proposed is a 30' expansion of the canal on property owned by Mr. Dale and Bon-Ric, lnc. All resulting spoils will be sidecast on an existing 75' upland spoil disposal area (see attached plat). The purpose of the proposed excavation is to return Lake Landing Canal to a consistent G of depth from WaWn's Corner to tho junction of Nebraska Canal. The canal is currently clogged in certain areas by wooden debris (tree tops, etc.) and is shoaled in at various locations along the project length. The purpose of the excavation is to remove those obstructions.
