Box 97 Frisco, NC 27936 Dear Mr. Lang: LT.8?FAIT A&4 ?EHNR March 17, 1997 Dare County WQC 401 Project #97063 You have our approval, in accordance with the attached conditions, to place fill material in 0.1 acres of wetlands or waters for the purpose of future development at NC 12 and Timber Trail at Indiantown Shores in Frisco, as you described in your application dated 25 February 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specked in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: The applicant, Donald Lang, would like to fill 4,356 square feet of vegetated 404 wetlands adjacent to Peter's Ditch, near the entrance to Indiantown Shores. i Indiantown Offices Bio Report Page 2 SITE DESCRIPTION Approximately 15,687 square feet of 404 (fresh water) wetland extends from NC 12 into the center of the applicant's property. A five-foot strip of the wetland extends south to Peter's Ditch and runs along the bank. The property is currently vacant and virtually undisturbed. PROJECT DESCRIPTION The applicant would like to fill 1/10 of an acre (4,356 square feet) of wetlands on the north side facing Timber Trail, of which 720 square feet is located within the Estuarine Shoreline Area of Environmental Concern (AEC). Approximately 322 cubic yards of material will be placed in the wetlands. The fill will be sloped at 2:1 or greater and stabilized with vegetation. A filter cloth barrier will be place along the bottom edge of the slope to prevent siltation in the remaining wetland. The applicant's property is situated on the corner of NC 12 and Timber Trail, at the entrance of Indiantown Shores, Frisco, Dare County. The lot is more specifically situated on the north side of NC 12, west of Timber Trail. To the south of the property is Peter's Ditch, and-to the west is 1A of Indiantown Shores Subdivision. Vegetation on the property includes, but is not limited to the following, Red-cedar (Juniperus virginiana), Loblolly Pine (Pinus taeda), Live Oak (Quercus mrginiana), Wax. Myrtle (Myrica cerifera), Black Needle Rush. (Juncus roemerianus), Saw-grass (Cladium jamaicence), Pennywort (Hydrocotyle umbellata), and a variety of lawn grasses. The permit request does not include any other activity at this time. Plans for the property will include the construction of two story building that will house (2) apartments, offices and retail space. Also on the property will be associated parking and a septic system. Currently there is insufficient area on the property to maintain the minimum 100' separation from the proposed septic system and repair area and the existing wetlands. The fill activity being proposed will allow the installation of necessary septic lines to meet Health Department standards. The plans will also include placing part of the building over the fill site. A separate Minor Permit Application will be submitted later if this permit request is approved. ANTICIPATED IMPACTS 1] The loss of 4,350 square feet of 404 (fresh water) wetlands. 2] Future development of the property will include residential, commercial and office space. No archeological sites, remnant species or geological formations are known to be associated with this particular property. Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorizing the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification is required under the provisions of Section 401 of the same law.' A Department of the Army permit will not be granted until the certification has been obtained or waived. According to our administrative regulations, 60 days is reasonable for State action.
