After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: The applicant proposes to enlarge an existing amusement park by constructing a 1,600' long go-cart track, a 32' x 44' canopy, a 20' x 20' sales building, restroom and septic system within a highground area and to install and cover 306 linear feet of 36" culvert within an existing 12' wide drainage ditch. JoMel, Incorporated Bio Report Page Two Site Description JoMel, Incorporated, the applicant, owns a 23.6 acre tract which lies west of U.S. Highway 158 at the 16 Milepost in Nags Head, Dare County. The tract is 750 wide by approximately 1,400 feet deep and fronts Roanoke Sound, which has been classified as SA waters by the North Carolina Division of Environmental Management. The northern property line coincides with the southern edge of the right-of-way of Forbes Street, a 50' wide unimproved town street. About 250 feet south of and parallel Forbes Street there is a 12' wide drainage ditch which extends from the U.S. 158 Bypass right-of-way to Roanoke Sound. The 250' by 1,400' long area north of the ditch has been developed as an amusement park in accordance with CAMA Major Development Permit #115-94, issued on September 29, 1994. The existing amusement park consists of a figure-eight, an oval track, ticket building, two open-sided canopy buildings, septic tank and drainfield, and approximately one acre of paved parking. The 500' x 1,400' long tract lying south of the ditch contains seven acres of uplands located within two areas approximately 5 acres and 2 acres in size. The smaller area of highground abuts the western edge of U.S. Highway 158. The larger highground area is located 300' to 600' west of the highway. Elevation within the highground areas ranges T to T above mean sea level. The entire tract was selectively bush-hogged within the past three years. Dominant vegetation varies with elevation and hydrology. Trees and bushes remaining intact include cedar, loblolly pine (Pinus taeda), yaupon (Ilex vomitoria) and wax myrtle (Myrica cerifera). Cut-over vegetation consist of groundsel tree (Baccharis halimifolia), bulrush (Scirpus spp.), salt meadow grass (Spartina patens) and bullbriar. The U.S. Army Corps of Engineers, on March 31, 1994, delineated approximately nine acres of wetlands on this site. The freshwater wetlands portion (approximately 5 acres) is vegetated with bulrush (Scirpus spp.), groundsel tree (Baccharis halimifolia), yaupon (Ilex vomitoria) and salt meadow grass (Spartina patens). The coastal wetlands portion (approximately 4 acres) is vegetated with black needlerush (Juncus roemerianus), cordgrass (Spartina alterniora), bulrush (Scirpus spp.), saw grass (Cladium jamaicence), salt reed grass (Spartina cynosuroides) and salt meadow grass (Spartina patens). Proposed Development The applicant proposes to construct the following within the five-acre highground site described above: 1) A curvilinear go-cart track approximately 1,600 feet in length. The track would be banked such that run-off would be collected in the infield area, then routed to a holding basin and ultimately sheeted across a vegetative filter if exceptional rainfall occurs. JoMel, Incorporated Bio Report Page Three 2) An open-sided canopy 32'x 44', a 20'x 20' ticket sales building and a restroom with septic tank and drainfield. 3) A 12' wide concrete emergency access aisle and connecting sidewalks to accommodate pedestrian and emergency vehicle traffic. 4) And within the easternmost 306' of the 12' wide drainage ditch install and cover 306 linear feet of 36" smooth-wall culvert. 5) Construct landscape buffers from the ditch to the southeast property line and from the southeast property corner to a point even with the existing Penguin Isle Restaurant located 10' south of the property line and 500' west of U.S. Highway 158. Anticipated Impacts The installation and covering of the 306' long 36" culvert will result in the filling of 1,530 square feet of Public Trust Waters and the loss of approximately 1,225 square feet of non-coastal wetlands. Construction of the 1,608' long go-cart track, canopy, sales building and accessway will result in 18,800 square feet of impervious surface within the 135,000 square feet of estuarine shoreline located within the undeveloped southern tract. Resultant lot coverage will be 14%. The installation of all proposed improvements will result in the disturbance of 33,950 square feet of uplands located outside the Estuarine Shoreline AEC. The installation of culvert within the easternmost 306' of the 12' wide drainage ditch should have minimal impact upon the hydrology affecting the wetlands located north and south of the ditch. No archeological/historical significance has been associated with this site. No unique remnant species or geological formations are known to exist within the project area. Submitted by: M.
