Eakins Pale 2 PROJECT DESCRIPTION: The project site is located at 8032 Bald Eagle Lane, adjacent to the Atlantic Intracoastal Waterway (AIWW) and Middle Sound, in New Hanover County. To locate the property from Market Street (NC Highwayl7), turn onto Porter's Neck Road and travel east approximately 2 miles. At the stop sign, turn right onto Bald Eagle Lane and travel approximately 0.5 miles until you reach the property of interest on the left. The lot is approximately 0.44 acres with approximately 200' of shoreline frontage and averages 5-10 feet above mean sea level. There is an existing highground peninsula that extends beyond a section of the shoreline. The applicant has recently constructed a new bulkhead along the shoreline under CAMA General Permit No. 45996, which includes the peninsula. The applicant has also recently demolished a residential building and is currently constructing a retaining wall along the southern boundary of the property under a CAMA Minor Permit through New Hanover County. Upland vegetation consists of woody species, which include Oak and Pine. Other present upland vegetation consists of lawn grasses, which transitions into the high marsh of mixed coastal wetland and "404 type" vegetation including Marsh Elder (Iva frutescens), Grounsel-bush (Baccharus halimifolia), Sea Ox-eye (Borrichia frutescens), and Salt Meadow Grass (Spartina patens). Low marsh consists primarily of Smooth Cordgrass (Spartina alterniflora), which covers an area approximately 100 feet in width to the AIWW and Middle Sound. The New Hanover County Land Use Plan classifies adjacent waters as Conservation. and the adja~~nt i~~_~i~~ .r,+un~i portion of the project area as Resource Protection. The waters of the AIWW and Middle Sound are elassitied ~,-~,- ORW by the Division of Water Quality. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes the construction of a private pier that would terminate in a gazebo with a floating dock and boatlift into the AIWW. The pier would extend from the existing highground bulkhead off the peninsula approximately 80' and would place the structure approximately 40' waterward of the outer edge of coastal wetlands. The pier would then terminate into a covered "L-head" platform (20' ~ ?0') over open water, which would be oriented on the northern side of the terminal end of the pier. The covered platform would then lead onto a floating dock measuring 40' long by 6' wide, which would run perpendicular to the AIWW. A boatlift (12'x 12') would be installed on the waterward end of the north side of the floating dock. The application states that the structures would be located in approximately -3.4' of water @Normal Low Water (NLW). The structures would also provide docking space for four (4) slips as indicated by numbering on the submitted plans. 10. ANTICIPATED IlVIPACTS: The proposed pier system construction would incorporate 784 sq. ft. of Estuarine Waters and Pubic Trust Area and would shade approximately 270 sq. ft. of coastal wetlands, vegetated primarily with Smooth Cordgrass (Spartina alterniflora). Minor increases in turbidity should be expected during construction. The proposed pier and floating dock would extend approximately 110 feet into a waterbody, which measures approximately 500 feet across. This distance would conform with the 1/4 width rule and the established pier lengths. As proposed, the applicant's proposal would not encroach into the 80-foot setback from the AIWW.
