On 8/5/97 we identified a suitable replacement site, flagged it, and drew up a tentative mitigation plan. Last week (8/20/97) Ken and I met with the grading contractor (John McArthur) and Stephanie Norris the owners representative to go over the plan details. I have attached a summary of the plan for Eric Fleek And Ken to follow. The contractor hopefully will get started ne,t week with the silt fence work and then the grading. August 21, 1997 Job No. 97-244 PROJECT SUMMARY Introduction: Since the previously chosen .3 acre mitigation site along Rockfish Creek was abandoned, due to access problems through property owners yards, the search for a replacement site was initiated. All of the other candidate sites were either developed, sold, or had worse access problems due to a combination of steep slopes and extensive wetland crossing requirements. Chosen Site Characteristics: The selected mitigation site is located in the conservation zone, downslope of lots #12 - #15 inclusive (200 feet east of Ballentine Street), and consists of a .5 acre oxbow island. It is surrounded by a shallow wetland trough of mostly riverine floodplain species, with a narrow three foot ditch outlet to the river. It lies within a protective remnant meander of the river with existing access down a logging skidder path off lot #13. The knob is irregular in shape, but averages 150 feet across. A) oils: The soils on the island are non-hydric fine loamy sand which appears to be layered up to its average six-foot elevation above the 404 swamp grade. It has no evidence of recent flooding, but last summer's hurricane storms came within two feet of its raised banks, based on drift lines and stained tree trunks. Normal flooding events rarely encircle the island and at present the soils at the skidder trail are dry hydric soils. B) Vegetation: The island was heavily vegetated with loblolly pine, which was clear-cut about three years ago. The access path to the island is still rutted, with a mixture of dog fennel, wool grass, and switchcane volunteering in micro-relief spots. Once you walk to the east and west of lots #13 and #14 the oxbow trough is heavily vegetated with classic riverine swamp forest tree species of bald cypress (T xo i m i tichum), black gum (Nym aquatic), red maple ( Acer rubrum), and a few atlantic white cedars (Chamaecyparis h id s). Upland shrubs which remain on the island consist of typical dry pocosin scrub/shrub patterns including pepper bush, horse sugar, sumac, sassafras, sweet gum, bracken fern, and bitter gall berry. The water table at present is deeper than four feet below the surface and there are no mucky modifiers in the soil. Project Summary_ The project will involve the removal of upland type (non-hydric) soils in the knob of the oxbow and trucking it to the adjacent high ground. The topsoil will be set aside for potential reuse before planting. The far side of the knob will be left intact with an average width of 15 feet, and it will be shaped like a half moon with the open side toward the hillside. In this manner the created wetland area can be used more successfully to dissipate and treat storm water from the subdivision. The finished grade of the created wetland will be pitched slightly toward the uplands away from the river, and its bottom contour will be matched to the adjacent wetland grades which surround the knob like a moat. An even mixture of bald cypress, black gum, and red maple seedlings (2-3 gallon) will be planted on five foot contours and a 70% survival rate is deemed the success criteria. The project site will be monitored for a period of three years with an annual report depicting the project's success or failures. Extra planting will be completed if the 70% survival rate is not met. Note -berm onthe south end will be cut out approximately 40' in width and possibly wider depending on equipment needs; 7)When excavation work is complete some of the topsoil may be spread ontop of subsoils unless they are of a hydric composition; 8)It is desirable to use this constructed wetland "horseshoe" for the disapation and post-treatment of stormwater runoff from Section 8 of the subdivision; 9)If a stormwater pipe is introduced it should be directed towards the center of the horseshoe against rock checkdams; 10)When temperatures are below 40 degrees F. when woody plants are dormant the site will be planted with an even mixture of bald cypress, red maple, and black gum seedlings (2-3 gallon); ll)The planting spacing will be on 5 foot centers and and the site will be monitored for 3 years to ensure at a min. 700 survival. As suggested, the 0.20 acre upland area found within lots 80 and 81 will be used for mitigation purposes. The area is well suited for such usage since it is surrounded on three sides by existing wetlands. This will allow the proposed upland area to be graded down to the same area as the existing wetlands using existing wetland elevations as a guide. The material removed from this area will be stockpiled in an uplands area only and a silt fence surrounding this uplands area shall be put into place before construction begins. All grading and equipment moving will occur in uplands areas only and material should be removed from south to north to allow equipment to remove the spoil in upland areas without disturbance to wetland areas. After the site has been brought to elevation the area should be panned down an additional two inches and filled with topsoil to provide needed organics and nutrients to the freshly exposed soil. The site will be planted with red maple, black gum, water oak, and Atlantic white cedar, many of which are available in suitable sapling form in other wetland areas of the site. The trees will be planted by hand with the above listed facultative or wetter plant species based on market availability and seasonal planting success. A three year monitoring program will document at least a 75% survival rate as seen though tree stem analysis. The three year monitoring program will be initiated at the time successfully stabilized the site in a FAC + or FAC W majority species composition, the monitoring requirements will be satisfied and shall end. Attached are surveys, photos, and drawings depicting the described restoration mitigation activities. In general this plan seems feasible. The 70% survivorship criterion for all plantings is reasonable. Further, the species proposed for planting, the general grading and site plan also seem to be reasonable. However, the Division of Water Quality would request that the monitoring period be extended from 3 years to 5 years, and that deed restrictions be placed on the remaining natural and constructed wetlands in lots #11, #12, #13, #14, and #15 to prevent future impacts. In addition, DWQ would appreciate clarification regarding the following matters: 1) Is the 0.5 acres the total acreage of this site or is it the acreage of wetlands to be created? 2) Will Land Management Group be monitoring the exact elevations on this mitigation site? Without specific data on the existing and proposed elevations in the mitigation area the Division of Water Quality reccomends that close supervision be provided during grading operations to ensure that your mitigation plan is completed successfully as you designed and intended. On September 29,1994 a 401 Water Quality Certification was issued to you authorizing 0.3 acres of additional wetland impacts associated with the development of Fairway Forest Subdivision off SR 1115 near Hope Mills, NC. The 401 Certification authorized additional wetland fill on residential lots along Hedingham Drive and required that compensatory mitigation be done on upland pockets of those same lots. The mitigation plan submitted on January 17, 1995 indicated that a 0.2 acre pocket of upland on lots 80 and 81 would be graded down to the adjacent wetland elevations and mixture of wetland tree species would be planted. On January 16, 1997, Ken Averitte from the DWQ Fayetteville Regional Office and Pete Colwell from this office made a site visit to Fairway Forest to conduct a compliance monitoring inspection of the project. They found no evidence that the compensatory mitigation plan had been carried out. The proposed mitigation site remains as upland. They also found excess fill in wetlands on lot 79 adjacent to Rockfish Creek, and behind lots 15-22 on Haskell Drive. It is hereby requested that you CEASE AND DESIST any further unauthorized activities in waters or wetlands of the State. Continuation of the unauthorized activities may result in civil penalties or other legal action against you. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Additional conditions are that 1) no additional wetland fill is allowed for Trelawney Court, lots 25, 26 or 27 and that 2) mitigation shall be done on one of three locations (lots 80 and 81, 77 and 78 or 76 and 75 by grading upland areas to the elevation of the surrounding wetlands and planting with local tree species such as red maple, black gum and oaks. Deed restrictions to prevent future wetland fill shall be placed on all lots with jurisdictional wetlands. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. Based on this review, we have identified significant uses which would be removed by this project. These uses are water storage, strcambank stabilization, pollutant removal wildlife habitat and aquatic life habitat. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands. Therefore, we are moving toward denial of your 401 Certification as required by 15A NCAC 2B.0109. Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management place your project on administrative hold. Please provide us with information supporting your position that your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can you construct your lots without additional wetland fill by utilizing retaining walls or having small back yards? Additional fill beyond that approved earlier will be very difficult to allow. Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification. Your plan is acceptable with the following changes: 1) the site shall be graded to approximately 6 inches below the final grade (instead of 2 inches) and then back filled with top soil. 2) Planting density shall be about 400 trees per acre to assure a 3- year survival rate of 320 trees per acre. 3) Monitoring wells shall be placed in the created wetland and adjacent natural wetland for the first year after creation to ensure that sufficient hydrology is present in the created wetland. 4) Soils shall be monitored for the development of hydric conditions. 5) As-built plans shall be submitted within 30 days of completion of the grading. All other conditions as outlined in your 16 January 1995 letter are also applicable. Your annual reports should be submitted by the first of February for the first three years after grading.
