Dear Mr. Futrell:
You have our approval to place fill material in 2.03 acres of wetlands or waters (1.53 acres
approved on 12/5/94) for the purpose of construction of sewer lines, road crossings and lot fill at
Oakhall, as you described in your application dated 25 January 1994. After reviewing your application,
we have decided that this fill is covered by General Water Quality Certification Numbers 2664, 2732
and 2671. These certifications allow you to use Nationwide Permit Numbers 12, 14 and 26 when they
are issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. Deed
restriction shall be placed on lots and open space with remaining jurisdictional wetlands to prevent
future fill. In addition, you should get any other federal, state or local permits before you go ahead
with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

RE: Revision to N.C. DEM Project #941015 (Approval enclosed.)
The purpose of this letter is to request revisions to a previous application for
Nationwide Permits 12,14 and 26, and a Section 401 Water Quality Certification
for the project known as Oakhall. The project is located near Holly Springs, N.C.
(Wake County), and is bordered by NC 55 on the eastern boundary, and NC SR
1152 on the southern boundary; as shown on the enclosed plans and Apex, N.C.,
USGS Topo Quad vicinity map.
The Corps approved wetland delineation is shown on the attached map. The
delineations of impact areas have been approved by Mr. Eric Alsmeyer of the
U.S. Army Corps of Engineers.
Impacts to wetlands will be required to construct private residences, roads and
utility lines.
It will be necessary to impact a total of 2.03 acres (see enclosed map) of
jurisdictional wetlands above headwaters for the entire nrorct (Previous request
for 1.53 acres was for the initial phases of the project.). Overall impacts have
increased 0.50 acres from the original request; utility impacts increased 0.54
acres, other impacts decreased slightly. A total of 0.27 acres (see map) will be
filled for road crossings under Nationwide Permit 14. Road crossings are
perpendicular to wetland alignments, in order to minimize impacts. Utility line
impacts total 0.81 acres of wetlands under Nationwide Permit 12; excavated
areas will be returned to grade. A total of 0.95 acres will be filled for the
placement of lots under Nationwide 26.
To expedite the permitting process and to make "life easier" on everyone
involved, the following individuals/ agencies have been provided with a

The wetlands circled on the attached map indicate pockets of
headwater wetlands (rating score 36). ThgsP,wetlands are avoidable;
however, they do not offer significant site specific water quality
function to the drainage. (note: the additive impacts to headwater
wetlands of this drainage coupled with change to an urbanized basin
will likely alter downstream water quality)
The town of Apex requires a certain amount of "open spaces" which
are noted in the attached map. I recommend requiring deed
restrictions for both lots containing wetlands that are not
proposed to be impacted and the respective open spaces noted on the
attached map.

The purpose of this letter is to request revisions to a previous application for
Nationwide Permits 12,14 and 26, and a Section 401 Water Quality Certification
for the project known as Oakhall. The project is located near Holly Springs, N.C.
(Wake County), and is bordered by NC 55 on the eastern boundary, and NC SR
1152 on the southern boundary; as shown on the enclosed plans and Apex, N.C.,
USGS Topo Quad vicinity map.
The Corps approved wetland delineation is shown on the attached map. The
delineations of impact areas have been approved by Mr. Eric Alsmeyer of the
U.S. Army Corps of Engineers.
Impacts to wetlands will be required to construct private residences, roads and
utility lines.
It will be necessary to impact a total of 2.03 acres (see enclosed map) of
jurisdictional wetlands above headwaters for the entire project (Previous request
for 1.53 acres was for the initial phases of the project.). Overall impacts have
increased 0.50 acres from the original request; utility impacts increased 0.54
acres, other impacts decreased slightly. A total of 0.27 acres (see map) will be
filled for road crossings under Nationwide Permit 14. Road crossings are
perpendicular to wetland alignments, in order to minimize impacts. Utility line
impacts total 0.81 acres of wetlands under Nationwide Permit 12; excavated
areas will be returned to grade. A total of 0.95 acres will be filled for the
placement of lots under Nationwide 26.
To expedite the permitting process and to make "life easier" on everyone
involved, the following individuals/ agencies have been provided with a

You have our approval to place fill material in 1.53 acres of wetlands or waters for the purpose
of residential development (lot fill, roads and utilities) at Oakhall subdivision, as you described in your
application dated 26 October 1994. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2671. This certification allows you to use
Nationwide Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
