APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Andrews:
You have our approval to place fill material in 0.8 acres of wetlands or waters for the purpose of
parking lot construction at SR 1616 and SR 1544, as you described in your application dated 23
November 1994 and 20 January 1995. After reviewing your application, we have decided that this fill
is covered by General Water Quality Certification Number 2671. This certification allows you to use
Nationwide Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose. and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed: in the attached certification.
Stormwater must be directed to sheetflow into the. remaining• wetlands . as shown on the letter from
Appian Engineering dated 20 January 1995. Wetland fill for Phase II is not allowed by this
certification. In addition, you should get any other federal, state, or local permits before you go ahead
with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

401 Water Quality Certification
Dear John:
As discussed, we are requesting that a 4101 Water Quality Certification be issued for the proposed
fill activity. The following notes and attached map will address the proposed activity. As
discussed in our on-site meeting Friday, January 13, 1995, all of the newly paved parking lot
drainage will be directed to the undisturbed wetland towards the northeast.
General Notes:
1. The drop inlets on the existing triple 18" FRCP drainage pipe crossing the parking lot area will
be modified into junction boxes. No parking lot drainage will enter the system at this point.
2. A new drainage structure will be constructed that will collect the new parking lot drainage and
discharge the drainage to the northeast into the undisturbed wetland area. This pipe will be
laid at 0.3% and the invert of the pipe will match the existing ground at the point of discharge.
3. A now drainage pipe that will be used to "drain" the high flows being discharged into the
undisturbed wetland will be installed The invert in of the proposed pipe at point 3 will be 6" to
9" higher than the invert discharge at point 2. A permanent pool of water will be left standing,
especially during the wetter months.
4. This area is approximately TV' above point 2 and 2'6" above point 3. Water will be made to
stand approximately 1' 9" at point 3 and 6" at point 2.
In addition to the above notes, we are withdrawing our request, at this time for the WQ
Certification required for Phase ll, the future parking to the northeast of the proposed parking will
be addressed at the time of construction. We will leave the area in its natural vegetated state
with all of the parking lot drainage directed to the undisturbed wetland.
