permit for lot fill on Lot 15, 23rd Street, in Onslow County. Thank you for your response to
our 12 April letter. However our objections to your proposed wetland fill still remain
particularly since our questions about avoiding or minimizing wetland fill were not answered
in your 29 April letter.
I can be reached at 733-1786 if you have any questions. Until our questions about
alternative designs to avoid or minimize wetland fill are answered, I will keep this project on
a "hold" status.

Your letter of April 12, 1994 has been sent to me for reply along
with other documents furnished by Mr. and Mrs. Minshew.
It is my understanding that Mr. and Mrs. Minshew have applied for
a permit to fill a portion of lot 15 Old Settlers Beach in order
that they may construct a residential dwelling. I am further
advised that you have received a package from Charles Riggs,
Registered Surveyor who was engaged by Mr. and Mrs. Minshew to
investigate the site and submit the application which you
apparently have received.
For your information this Subdivision was originally subdivided in
the early 1960's and the revision of Block 15 of Section I of Old
Settlers Beach was made in August 1975. Your package identifies a
copy of the 1975 map. This lot is located on a designated City
street for the Town of North Topsail Beach as 23rd Street. This is
a street maintained by the Town of North Topsail Beach and upon
which is located several residences including mobile home
residences. In fact, one mobile home residence is located
diagonally across the street from the lot in question. The lot
immediately adjacent to lot 15 has a septic tank and the owner has
a building permit to place a residence on this lot. I am advised
by Mr. Riggs that Jeff Richter of the U.S. Army Corps of Engineers
has identified this lot as total 404 wetlands. Mr. and Mrs.
Minshew do not own another lot in this subdivision upon which to
construct a residence.
Sewer is available through North Topsail Water and Sewer who will
provide service to this lot. The other lots are served by septic
tanks. The County provides water to the site. In other words, all
the services are available for this site for residential uses. It
is further my understanding that the package submitted by Mr. Riggs
Y
provides you with map documentation as to the site in question.
This particular lot is located on 23rd Street, a public street of
the Town of North Topsail Beach. This street is not the "road
crossing" referred to in your letter of April 12, 1994. I do not
understand your "bank stabilization" concerns. I am sure that
appropriate measures of erosion control, if that is what you
referred to, that apply to all residential construction can be made
to apply in the case of this particular lot. The Corps of
Engineers has already issued their approval of Nationwide Permit
#18 for this particular site.
This site is appropriately zoned for the building of a residential
structure by the Town of North Topsail Beach and of course is a
platted residential lot subject to the same restrictive covenants
as all the lots in that subdivision. Mr. and Mrs. Minshew acquired
this property with the intention of constructing a residential
structure on the lot and have expended considerable funds in
applying for appropriate permits to do this. To find that this lot
is not suitable for residential construction and is not appropriate
for the limited fill requested to allow residential construction
renders the lot totally unusable, if your conclusions are correctly
applied to this lot.
The purpose of my letter is to respond to your April 12, 1994
letter which in fact was not received by Mr. Minshew on April 12,
1994 and to request that your office furnish me with any specific
determination that you have made or any specific information that
you need to make such determination and to request that you forward
a letter of denial or approval and the reason therefore. We will
request Mr. and Mrs. Minshew to cooperate in any way to the end
that they may have the reasonable use of their property.
Thank you for your concern in this matter and I look forward to
your early reply.

North Topsail Reach.
The lot will be served by Onslow County Water and the sewer will
be handled by North Topsail Water and Sewer Company.
A Nationwide Permit # 18 has been requested from the U. S. Army
Corps of Engineers and hag been granted as shown on tha

The Division of Environmental Management, Water Quality Section has
reviewed your plans for wetland fill for 1800 square feet of wetlands at Lot
15, 23rd Street,North Topsail Beach in Onslow County for residential lot.
Based on this review, we have identified significant uses which would be
removed by this project. These uses are pollutant removal, water storage and
bank stabilization. Furthermore, insufficient evidence is present in our
files to conclude that your project must be built as planned in wetlands.
Therefore, we are moving toward denial of your 401 Certification. Until we
receive additional information, we are requesting (by copy of this letter)
that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal
Management place your project on administrative hold.
Please provide us with information supporting your position that your
project must be constructed as planned and that you have no practicable
alternative to fill of these wetlands. Specifically can you construct your
house on nearby uplands? Any documentation such as maps and narrative which
you can supply to address upland alternatives may be helpful in our review of
your 401 Certification. Also please inform us of your recent application for
a road crossing (Nationwide Permit #14) is for this project or a different
project. Please respond within two weeks of the date of this letter by
sending a copy of this information to me and one copy to our Mr. Jim Gregson
at the Wilmington Regional Office at 127 Cardinal St., Extension, Wilmington,
N.C. 28405-3045.

was accepted for processing February 18, 1994: Specifically, your` proposal was to fill
approximately 1800 square feed. of coastal "marsh and 404 wetlands for the purpose of building
a residence for resale.
Based on a coordinated., state and federal agency review, this Division has made the
following findings:

6) The proposed work has been determined to be inconsistent with the following
partial listing of rules of the Coastal Resources Commission (CRC):
• 15A NCAC 7H.0205(c), the management objective of the coastal wetland AEC
which requires that coastal wetlands be conserved and managed so as to safeguard
and perpetuate their biological, social, economic, and aesthetic values and to
coordinate and establish a management system capable of conserving and utilizing
coastal wetlands as a natural resource essential to the functioning of the entire
estuarine system;
• 15A NCAC 7H.0205(d), the use standard of the coastal wetland AEC which
states that suitable land uses shall be those consistent with the management
objective of this rule, and also states that a residence is an unacceptable land use;
• 15A NCAC 7H.0208(a)(1), a use standard of the estuarine system AEC which
prohibits uses that are not water dependent;
• 15A NCAC 7H.0208(a)(2)(A), a use standard of the estuarine system AEC which
requires that the location, design, and need for development, as well as the
construction activities involved, be consistent with the management objective;
• 15A NCAC 7H.0208(e)(9), a use standard of the estuarine shoreline AEC which
states that, within the AEC for estuarine shorelines contiguous to waters classified
as ORW by the EMC, no CAMA permit will be approved for any project that
would be inconsistent with applicable use standards adopted by the CRC, EMC,
or MFC for coastal wetlands;
• 15A NCAC 7H.0601, which prohibits development in any AEC that would result
in a contravention or violation of any rules, regulations, or laws of the State of
North Carolina or of the local government in which the development takes place;
and,
• 15A NCAC 7J.0402(a)(8), which requires denial of a CAMA permit in any case
that the development is inconsistent with the local land use plan.
Given the preceding findings, it is necessary that your request for a permit under the
CAMA be denied. This denial is wade in accordance with NCGS 113A-120(a)(8), which
requires denial of the requested permit in any case that the development is determined to be
inconsistent with State guidelines, and with NCGS 113-229(e)(5), which requires the denial of
the dredge and fill permit upon finding that the proposed development would have an adverse
effect on estuarine and marine fisheries.

If you wish to appeal thi"s is dialyou are entitled to a hearing. The hearing will involve
appearing before an Administrative X;aw Judge who listens to the evidence and arguments of both
parties and then makes a recomuaendation to the Coastal Resources Commission. Your request
for a hearing must be in the forth oI a written petition and in compliance with the requirements
of Chapter 150B of the General!Statotes of North Carolina. This petition must be filed with the
Office of Administrative Hearings, V ."O. Box 27447, Raleigh, NC 27611-7447, (919) 733-2698,
within twenty days of the date of this letter. A copy of the petition should also be filed with this
office.
Also, you should be advisedthat as long as this permit denial stands, your project must
be deemed inconsistent with the N.C. Coastal Management Program, thereby precluding
issuance of federal permits for this project. The Federal Coastal Zone Management Act of 1972
(CZMA) authorizes the applicant to appeal this fording to the U.S. Secretary of Commerce
within thirty days of receipt of.-this; letter. Your appeal must be based on the grounds that the
proposed activity is (1) consistent :with "the objectives or purposes of the CZMA, or (2) is
necessary in the interest of national' security, and thus, may be federally approved.

The applicant is proposing to fill lot 15 on the left side of the road. at the end of 23rd Street in
North Topsail Beach. Twenty-Third Street would have to be extended across the width of the
lot to accommodate this development.
The U. S. Army Corps of Engineers has determined the entire 8040 square foot lot to be
jurisdictional wetlands. A Nationwide Permit #18 has been issued by the Corps: The applicant
is proposing to fill between 1500 and 1800 square feet of wetlands (404 and coastal) for
construction of a "spec" house that will be for sale. The lot is currently vegetated and has no
man-made features on it. Coastal species present in the area to be filled include S artina
cynosuroides, T pfy la spp., Spartina patens, and J>mcus roemerianus. This lot is separated from
several acres of rank marsh bordering Stump Sound by approximately 12-18" of remnant fill
from an old driveway. However, the lot is subject to occasional flooding as evidenced by its
close proximity to mean high water of Stump Sound.
Lot 15 is located in the Outstanding Resource Water Area of Environmental Concern of Stump
Sound south of Permuda Island within North Topsail Beach's town limits. The waters of the
Sound are open to the taking of shellfish and have been designated as a Primary Nursery Area
by the Division Of Marine Fisheries. The lot is classified as Vacant/Undeveloped by the Land
Use Plan.
The house that the applicant plans to build is proposed as a two-story residence with a footprint
of 24' by 32' with a 8' by 28' wrap-around deck with stairs leading to the ground level. The
driveway which will be approximately 24' by 30' will be concrete and will extend under the
deck and underneath the house as shown on the cross-sectional drawing submitted with the
application. The concreted area will result in approximately 21 % of this lot becoming
impervious. A maxllnUill of 25% impervious is allowed in the ORW Area of Environmental
Concern. According to the applicant's agent at least 32 cubic yards of fill is.required on this
lot.
10. ANTICIPATED IMPACTS
Approximately 1800 square feet of 404 wetlands and coastal marsh would be filled within the
Outstanding Resource Water Area Of Environmental Concern. Because of this lot's proximity
to Stump Sound and other undeveloped land bordering the water, cumulative impact to the water
quality is of utmost concern. The amount of area available for pollutant removal and wildlife
habitat would continue to be reduced within this sensitive watershed.
This project appears to be inconsistent with the Management Objective as outlined in T15A:
07H.0203.

RECOMMENDED CONDITIONS OR PERMIT RESTRICTIONS:
It is recommended that the project as proposed be denied. The applicants are proposing to
fill approximately 1800 sq. ft. of coastal marsh and 404 wetlands on a lot that is entirely
jurisdictional wetlands. The purpose or the proposed fill is to provide for the construction of
a "spec" house. This lot is adjacent to the SA ORW Waters of Stump Sound directly accross
from the Purmuda Island Coastal Reserve. It is the opinion of this Office that to fill a lot that
is entirely wetlands for the construction of a residence is not a "Minor Discharge" and NWP 18
should not be applicable. As past experience with NWP 18 has shown, impacts to individual
lots usually far exceed the house footprint alone. These wetlands are currently functioning as
a valuable buffer for the adjacent Outstanding Resource Waters. The incrimental destruction of
this valuable buffer from multiple NWP 18s would result in a severe loss of wetland use in this
area. This loss of wetland use as well as the increase runoff associated with development no
doubt would have an impact on the adjacent open shellfishing and PNA waters of Stump Sound.

PERMIT AND WATER QUALITY CERTIFICATION
The Department of Environment, Health and Natural Resources hereby gives public
notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that Mary Nell Minshew of
Onslow County, filed an application on February 18, 1994, for a permit from the Division of
Coastal Management to develop in an Area of Environmental Concern and for certification
from the Division of Environmental Management that a discharge of fill material in project
wetlands will not violate applicable water quality standards.
According to said application the applicant is proposing to fill approximately 1800
square feet of coastal marsh and 404 wetlands to build a house on Lot 15, 23rd Street, North
Topsail Beach, Onslow County.
A copy of the entire application and additional information may be examined (or
copies furnished upon request and payment of reproduction costs) during normal business
hours at the office of Environment, Health and Natural Resources, Division of Coastal
Management, and Division of Environmental Management, located at 127 Cardinal Drive
Extension, Wilmington, North Carolina 28405, 919/395-3900.
The Division of Environmental Management proposes to take final action on this
water quality certification on or before April 17, 1994. The issuance of the CAMA Major
Development permit and the Section 401 Certification may deviate from this projected date
depending upon the nature of the comments submitted and subsequent hearings that may
result.
All persons desiring to make comments should do so in writing to Roger N. Schecter,
Director, Division of Coastal Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
April 12, 1994 for consideration in the CAMA permit decision, and to Mr. John Dorney,

9. PROJECT DESCRIPTION March 14, 1994
The applicant is proposing to fill lot 15 on the left side of the road at the end of 23rd Street in
North Topsail Beach. Twenty-Third Street would have to be extended across the width of the
lot to accommodate this development.
The U. S. Army Corps of Engineers has determined the entire 8040 square foot lot to be
jurisdictional wetlands. A Nationwide Permit #18 has been issued by the Corps. The applicant
is proposing to fill between 1500 and 1800 square feet of wetlands (404 and coastal) for
construction of a "spec" house that will be for sale. The lot is currently vegetated and has no
man-made features on it. Coastal species present in the area to be filled include S artina
cynosuroides, Tynha spp., Spartina patens, and Juncus roemerianus. This lot is separated from
several acres of rank marsh bordering Stump Sound by approximately 12-18" of remnant fill
from an old driveway. However, the lot is subject to occasional flooding as evidenced by its
close proximity to mean high water of Stump Sound.
Lot 15 is located in the .Outstanding Resource Water Area of Environmental Concern of Stump
Sound south of Permuda Island within North Topsail Beach's town limits. The waters of the
Sound are open to the taking of shellfish and have been designated as a Primary Nursery Area
by the Division Of Marine Fisheries. The lot is classified as Vacant/Undeveloped by the Land
Use Plan.
The house that the applicant plans to build is proposed as a two-story residence with a footprint
of 24' by 32' with a 8' by 28' wrap-around deck with stairs leading to the ground level. The
driveway which will be approximately 24' by 30' will be concrete and will extend under the
deck and underneath the house as shown on the cross-sectional drawing submitted with the
application. The concreted area will result in approximately 21 % of this lot becoming
impervious. A maximum of 25% impervious is allowed in the ORW Area of Environmental
Concern. According to the applicant's agent at least 32 cubic yards of fill is required on this
lot.
10. ANTICIPATED IMPACTS
Approximately 1800 square feet of 404 wetlands and coastal marsh would be filled within the
Outstanding Resource Water Area Of Environmental Concern. Because of this lot's proximity
to Stump Sound and other undeveloped land bordering the water, cumulative impact to the water
quality is of utmost concern. The amount of area available for pollutant removal and wildlife
habitat would continue to be reduced within this sensitive watershed.
This project appears to be inconsistent with the Management Objective as outlined in T15A:
07H.0203.

only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 23 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the

On 2 March 1993 you wrote to the Division of Environmental
Management requesting a 401 Water Quality Certification for your
project to construct a house and driveway at Lot 15, Block 14 old
Settler's Beach in Onslow County. We have been informed by the N.C.
Division of Coastal Management that this project will require a Permit
from the N.C. Division of Coastal Management: We cannot continue to
process your application until the Division of Coastal Management
(DCM) begins the permitting process. Therefore I must hereby place
this project on indefinite hold until you and the Division of Coastal
Management gather the necessary information to develop an acceptable
DCM permit application. Also by copy of this letter, I am also
notifying the U.S. Army Corps of Engineers that this project will need
processing by the Division of Coastal Management.

be affected or is in the vicinity of the project and shall not begin work on
the activity until notified by the District Engineer that the requirements of
the Endangered Species Act have been satisfied and that the activity is
authorized. Information on the location of threatened and endangered species
can be obtained from the U.S. Fish and Wildlife Service and National Marine
Fisheries Service.
12. Historic Properties. No activity which may affect.Historic Properties
listed, or eligible for listing, in the National Register of Historic Places
is authorized, until the District Engineer has complied with the provisions of
33 CFR 325, Appendix C. The prospective permittee must notify the District
Engineer if the authorized activity may affect any historic properties listed,
determined to be eligible, or which the prospective permittee has reason to
believe may be eligible for listing on the National Register of Historic
Places, and shall not begin the activity until notified by the District
Engineer that the requirements of the National Historic Preservation Act have
been satisfied and that the activity is authorized. Information on the
location and existence of historic resources can be obtained from the State
Historic Preservation office and the National Register of Historic Places (see
33 CFR 330.4(g)).
13. Notification (if the discharge exceeds 10 cubic yards or the discharge is
in a special aquatic site, including wetlands).
a. Where required by the terms of the NWP, the prospective permittee must
notify the District Engineer as early as possible and shall not begin the
activity:
(1) until notified by the District Engineer that the activity may proceed
under the NWP with any special conditions imposed by the District or Division
Engineer; or
(2) if notified by the District or Division Engineer that an individual
permit is required; or
(3) Unless 30 days have passed from the District Engineer's receipt of
the notification and the prospective permittee has not received notice from
the District or Division Engineer. Subsequently, the permittee's right to
proceed under the NWP may be modified, suspended or revoked only in accordance
with the procedure set forth in 33 CFR 330.5(d)(2).
b. The notification must be in writing and include the following
information and any required fees:

The Federal review has benn completed for your proposal to discharge fill
0.03 acre of fill material into wetlands adjacent to Stump Sound on your
property located on 23rd Street in North Topsail Beach, Onslow County, North
Carolina.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CPR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization, pu r,;want to Section 10 of the Rivers and Harbors Act and
Section 404 of the Clean Water Act, was provided for discharges of dredged or
fill material into all waters of the United States. provided,.;..
a. The discharge does riot exceed 25 cubic yards;.
b. The discharge will riot cause the loss of more than 1/10 acre of a
special aquatic site, including wetlands. For the purposes of this nationwide
permit, the acreage' limitation includes the filled area plus special aquatic
sites that are adversely affected by flooding and special aquatic sites that
are drained so-thet they would no longer be a water of the United States as a
result of the project;
C. The discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project and is not placed for the
purpose of stream diversion.
Your !cork is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions. This
nationwide permit does not relieve you of the responsibility to obtain any
required State or local approval. If you have not-already done so, you should.
contact the following State agencies to obtain the required state

This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified; reia9ued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of--the nationwide permit
authorisation. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, auch thAt the Activity
would no longer comply with the terms and conditions of tha nationwide permit,
activities which have commenced (i.e., ate under construction) or Are under

(b) The SHPO regarding the presence of any histbric properties ih the
permit area that may be affected by the proposed project; and the available
information, if any provided by that agency.
14. Water Supply intakes. No discharge of dredged or fill material may occur
in the proximity of a public water supply intake except where the discharge is
repair of the public water supply'intake structures or adjacent bank
stabilization.
15. Shellfish Production. No discharge of dredged or fill material may occur
in areas of concentrated shellfish production, unless the discharge is
directly related to a shellfish harvest activity authorized by nationwide
permit.
16. Suitable Material. No discharge of dredged or fill material may consist
of unsuitable material (e.g., trash, debris, car bodies; etc.) and material
discharged must be free from toxic pollutants in toxic amounts.
17. Mitigation. Discharges of dredged or fill material into waters of the
United States must be minimized or avoided to the maximum extent practicable
at the project site (i.e., on-site), unless the District Engineer has approved
a compensation mitigation plan for the specific regulated activity.
18. Spawning Areas. Discharges in spawning areas during spawning seasons
must be avoided to the maximum extent practicable.

19. Obstructions of High Flows. To the maximum extent practicable,
discharges must not permanently restrict or impede the passage of normal or
expected high flows or cause the relocation of the water (unless the primary
purpose of the fill is to impound waters).
20. Adverse impacts from impoundments. If the discharge creates an
impoundment of water, adverse impacts on the aquatic system caused by the
accelerated passage of water and/or the restriction of its flow shall be
minimized to the maximum extent practicable.
21. Waterfowl Breeding Areas. Discharges into breeding areas for migratory
waterfowl must be avoided to the maximum extent practicable.
22. Removal of Temporary Fills. Any temporary fills must be removed in their
entirety and the affected areas returned to their preexisting elevation.
NOTES:
1. Qualification for and issuance of a nationwide permit does not relieve the
applicant of the need to obtain any other required State or local permits.
2. Should all or part of a proposed activity be located within an Area of
Environmental Concern (AEC) as designated by the North Carolina Coastal
Resources Commission, a CAMA permit is required from the North Carolina
Division of Coastal Management. Should an activity within or potentially
affecting an AEC be proposed by a Federal agency, a consistency determination
pursuant to 15 CFR 930 must be provided to the North Carolina Division of
Coastal Management at least 90 days before the onset of the proposed activity.

STATE CONSISTENCY CONDITIONS
1. Established erosion control practices shall be utilized to prevent
violations of the appropriate turbidity water quality standard (50 NTU's in
streams and rivers not designated as trout waters by the North Carolina
Division of Environmental Management; 25 NTU's in all saltwater classes and
all lakes and reservoirs and 10 NTU's in trout waters).
2. The applicant must receive written concurrence from the North Carolina
Division of Environmental Management that the proposal is certified under the
Section 401 Water Quality Certification Program.
3. If the proposed activity is within the North Carolina Coastal Area, the
applicant must receive written concurrence from the North Carolina Division of
Coastal Management that the activity is consistent with the North Carolina
Coastal Management Program.
GENERAL CERTIFICATION CONDITIONS
1. Proposed fill or substantial modification of waters or wetlands for this
General Certification requires written concurrence from the North Carolina
Division of Environmental Management.
2. If written concurrence is not issued by the North Carolina Division of
Environmental Management within 45 days from receipt of a complete application
by the Division's Section 401 Certification office in Raleigh, then Section
401 Certification is waived for this Nationwide Permit unless additional
information is requested in writing by the Director.
3. Established sediment and erosion control practices will be utilized to
prevent violations of the appropriate turbidity water quality standard (50
NTU's in streams and rivers not designated as trout waters by the North
Carolina Division of Environmental Management, 25 NTU's in all saltwater
classes and all lakes and reservoirs and 10 NTU's in trout waters).
4. Additional site-specific conditions may be added to this Certification in
r,rder to ensure compliance with all applicable water quality and effluent
standards.
5. Concurrence from the North Carolina Division of Environmental Management
that this Certification applies to an individual project shall expire three
years from the date of the cover letter from the North Carolina Division of
Environmental Management.

REFERENCE: DEM93-176 Nationwide Permit Application for an activity located in
Onslow County, NC
Dear Ms. Minshew:
The NC Division of Coastal Management has reviewed the above referenced application for a
Nationwide Permit dated 02/26/93, pursuant to Section 307 of the Coastal Zone Management Act of 1972
as amended. Based upon our review, we have detennined that the proposed activity is consistent with
the North Carolina Coastal Management Program provided the following conditions are met.
1. The activity described in the above application qualifies to receive one of the Nationwide Permits
described in 33 CFR Part 330 with the exception of numbers 17, 21, 24, and 34 which were found
inconsistent with the North Carolina Coastal Management Program.
2. A 401 Water Quality Certification is received, where required, from the NC Division of
Environmental Management.
This letter does not relieve you of the responsibility to insure that all other State
and/or permit requirements are met prior to implementation of the project. Please feel free to contact M.
