Dear Mr. Rhein:
You have our approval to place fill material in 0.70 acres of wetlands or waters for the purpose
of lot fill and road crossing at Steeplechase Phase II, as you described in your application dated
28 December 1994. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 2671. This certification allows you to use Nationwide
Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application.- If
you change your project, you must notify us and you may be required to send_us a new application.
For this approval to be valid, you must follow the conditions. listed in the attached certification: In
addition, you should get any other federal, state or local permits before you go ahead with your .
project.
If you do not accept any of the conditions of this certification;. you may ask for an adjudicatory.
hearing. You must act within 30 days of the date that you. receive this letter. To ask for a hearing,,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes 'to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

SUBJECT: Robert C. Rhein Interests Inc. Request for 401 Water
Quality Certification to fill wetlands at Sandy Porter
Road (SR 1142), Mecklenburg County, North Carolina.
DEM ID # 941082.
Staff biologists with the North Carolina Wildlife Resources
Commission (NCWRC) has reviewed the subject application for 401
Water Quality Certification with respect to anticipated project
impacts on aquatic habitats. A site inspection was conducted on
December 19, 1994. Our comments are provided in accordance with
Fish and Wildlife Coordination Act (48 stat. 401, as amended; 16
U.S.C. 661 et seq.), and section 401(b) of the Clean Water Act of
1977 (as amended), and North Carolina General Statutes (G.S. 113-
131 et seq.).
The development consists of approximately 121 residential
lots which may impact a total of 2.8 acres of wetlands. The
applicant proposes to fill 0.53 acres of wetlands for road and
lot construction.
A small intermittent stream with associated wetlands exists
on the project site. Wetland vegetation found included dense
stands of sycamore, oak, and cedar trees. Although street and
lot construction was incomplete, some gravel, rock, dirt, and
concrete had been placed in the stream at the location of one
proposed wetland crossing.
These wetlands retain and purify stormwater runoff for the
adjacent Steele Creek. They also provide valuable habitat for
numerous wildlife species.

As proposed, this project is inconsistent with our Policies
and Guidelines for Conservation of Wetlands and Aquatic Habitats.
It is the policy of this agency to oppose projects which
"displace, damage, or modify wetland values and function." In
addition, we believe that this project is inconsistent with the
Environmental Protection Agency's section 404(b)(1) guidelines in
that the proposed project does not constitute a water dependent
activity. Therefore, we requests that the 401 Water Quality
Certification be conditioned as follows:
1. Deed restrictions should be placed on lots with
wetlands prohibiting perspective owners from
impacting the wetlands.
2. Wetland fill at street crossings should be minimized.
Disturbed wetland areas should be reseeded with
annual, seasonal vegetation (millet in spring and
summer, wheat or rye in fall) then allowed to
revegetate with natural wetland plant species.
3. Implement and maintain a strict, State Approved
Sedimentation Control Plan to prevent silt from
entering streams and wetlands areas.
