Box 64218 Fayetteville, N.C. 28306 FILE CUtiAl Dear Mr. Ray: You have our approval to place fill material in 0.5 acres of wetlands or waters for the purpose of road access at Fayetteville Regional Airport, as you described in your application dated 18 October 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Box 92 Columbia, South Carolina 2.9202 Dear Mr. Damon: This is in response to your letter dated June 8, 1992, requesting the U.S. Fish and Wildlife Service (Service) to review the Environmental Assessment for the Fayetteville Airport Connector, Cumberland County, North Carolina. These comments are provided in accordance with provisions of section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C 1531-1543) (Act). Based upon our review of the information provided, the Service concurs with the preferred alternative and we believe that no Federally-listed endangered or threatened species are likely to be adversely impacted by the proposed project. Therefore, the requirements of Section 7 of the Act are fulfilled. However, obligations under Section 7 of the Act must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner which was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action.
