Dear Mr. Somma and Mr. Taylor:
You have our approval to place fill material in 0.05 acres of wetlands or waters for the purpose
of boat access and bulkhead construction at SR 1358 and Lake Gaston, as you described in your
application dated 7 September 1994. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2733. This certification allows you to use
Nationwide Permit Number 18 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification.
Dredge spoil shall be disposed of in an upland site. In addition, you should get any other federal,
state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

SUBJECT: 401 Certification for Joseph Somma and Mike Taylor,
Lake Gaston, Warren County NC, Project No. 94831
Biologists on the North Carolina Wildlife Resources
commission staff have reviewed the subject project. A site visit
was conducted on September 20, 1994. our comments are provided
in accordance with certain provisions of the Clean Water Act of
1977 (33 U.S.C. 466 et seq.) and the Fish and Wildlife
Cony•di-nation Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d)
and North Carolina General Statutes (G. S. 113--131 et seq.).
The proposed project involves excavating a boat channel. to
connect the applicants' properties with Lake Gaston to provide
boating acceSS, Approximately 2000 square feat of wetland area
in a shallow cove of Lake Gaston will be impacted. A bulkhead
will also be installed as part of this project. The impacts have
been minimized to allow only for a boat access.
The project area is a shallow backwater cove at the
confluence of a small creek and a hardwood drain. The hardwood
drain is vegetated with grasses, jewel-weed, and picker-lweed.
The creek flows through a mesophytic: hardwood area over rock
until it reaches the backwater of the lake. There is less
wetland vegetation than the drain area, but there are scattered
clumps of peltandra and button bush. The bank at the confluence
is vegetated primarily with smartweed.
