You have our approval to place fill material in 1.25 acres of wetlands or waters for the purpose
of constructing a church and parking lot at US 17 and SR 1563, as you described in your application
dated 24 October 1994. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 2671. This certification allows you to use Nationwide
Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Dear Mr. Schiener:
The purpose of this letter is an explanation of intended usage of the
property discussed per our conversation on June 22,1994 and to generate
communication, so that we may achieve such intended goals. Enclosed you will
find a property locator and a recent survey of said property.
The property is accordingly zoned and will be used for the construction
of Livingstones Tabernacle of Hampstead, North Carolina. This organization
is North Carolina chartered and currently meeting in the Hampstead Community
Center.
The size of the property consists of approximately three acres and is
located between Waterworks Spa Factory and Liquid Dynamics Incorporated on
N.C.S.R. 1563 - Sloop Point Road; approximately 1,000 feet eastward of U.S.
Highway #17. The nearest headwaters or estuarine area is approximately one
and three quarters miles away. Surface drainage will be via existing ditch-
es on the eastern and southern sides, and ponds on the northern and western
sides. All created effluents will be pumped to adjacent environmentally
approved properties for disposal in an approved manner as determined by the
Pender County Board of Environmental Health. As adjacent businesses are
built at ground level.; construction should require only marginal fill to be
brought in for the purpose of drainage control.

filling of wetlands associated with church
construction, off US 17 on SR 1563 near Hampstead,

The Wildlife Resources Commission has reviewed the subject
permit application,. A rite visit was made on November 21, 1994.
Our comments are provided in accordance with provisions of the
Fish and Wildlife Coordination Act (4r Stat., 401, as amended; 1(;
U.S.C. 661 et. seq.).
The applicant haq applied for Water Quality Certification to
construct a church and parking lot by f:i_l.iing 1.2E acres of
wetlands in t::he, Virginia Creek watorshed, Site wetlands are
partly mown, but still contain loblolly piny:, sweet bay, and
blueberry. Ditches alongside the tract may provide a hydraulic

connection between project: wetlands and area surface waters.
Remaining vegetated portions of the site provi_de habitat suitable
for use by a variety of wildlife species. These wetlands aloo
appear to provide a filtration function for runoff reaching th(:,,
Virginia Creek estuary. We recommend the following project
modifications to reduce they extent: of wetland impacts-
1. Relocate the sanctuary roadward acrd toward the
southeastern corner of the tract; to avoid wetlands in
the northeastern corner.
2. Move the parking area to the mostly high ground,
wr5t:ern third of the tract to reduce wetland filling
to no more, than 0.33 acre.
