After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2665. This certification allows you to use Nationwide Permit Number 13 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Anderson, Piedmont Region Coordinator Habitat Conservation Program DATE: September 6, 1994 SUBJECT: Mecklenburg County request for 401 Water Quality Certification to line streambank with rip rap, Mecklenburg County, North Carolina. DEM ID # 94717. Biologists on the North Carolina Wildlife Resources Commission staff have reviewed the subject project. Our comments are provided in accordance with certain provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and North Carolina General Statutes (G.S. 113-131 et seq.). The applicant proposes to place 870 linear feet of rip rap along both sides of streambank along Edward's Branch in Charlotte. The riprap will extend from below the waterline to the top of the bank and fill 0.12 acres of wetlands. The applicant states that the purpose of the work is to prevent further stream bank erosion. According to the applicant, the activity must be carried out in wetlands to prevent continued bank erosion. The applicant does not plan to disturb large growth at the top of the banks. We do not encourage placing riprap or other artificial structure to contain streambanks over extensive stream segments. Bank erosion is a natural function of water movement in streams. Intensive development in urban areas adds to the problem when runoff flows swiftly to stream channels. We encourage watershed management practices and sedimentation control plans that slow watershed runoff. 401 Certification 2 September 6, 1994 Project No 94717 We are not opposed to riprap where there are active erosion or safety problems. However, we recommend the following modifications for this project: 1. Confine riprap segments where causing safety placement only to those stream the stream banks are sloughing or problems. 2. Maintain systems of natural buffers along streams and drainages and vegetation on stream banks. Other stormwater control technology (such as retention ponds and detention ponds) should be used to help dissipate stormwater energy and reduce volume input to these streams. 3. Implement and maintain a strict, state approved sedimentation control plan to prevent silt from entering wetlands and other undeveloped areas.
