Based upon our review, we have determined that the proposed activity is consistent with the North Carolina Coastal Management Program provided the following conditions are met: The activity described in the above-referenced application qualifies to receive one of the Nation- wide Permits described in 33 CFR Part 330 with the exception of Numbers 17, 21, 24, and 34 which were found inconsistent with the North Carolina Coastal Management Program. 2. A 401 Water Quality Certification is received, where required, from the North Carolina Division of Environmental Management. This letter does not relieve you of the responsibility to insure that all other State authorization and/or permit requirements are met prior to implementation of the project. Grathwol Coastal Carolina Utilities P.O. Box 3403 Wilmington, N.C. 28406 Dear Mr. Grathwol: You have our approval to place fill material in 2.0 acres of wetlands or waters for the purpose of sanitary sewer construction along upper Smith Creek, as you described in your application dated 28 June, 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2664. This certification allows you to use Nationwide Permit Number 12 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. An additional conditions is that antiseep collars shall be placed at no less than 150 foot intervals as the line passes thru wetlands. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Dear Mr. Winefordner: As discussed I am making this application to your office in order to be in compliance with NWP #12 utility crossing requirements for the installation of a Gravity Sewerline along Smith Creek. The purpose of this request is to abandon two private package sewer treatment plants, 5 lift stations and a point source discharge in Smith Creek by connection to the public sewerline in Gordon Woods subdivision. This work is in compliance with the 201 facility plan of New Hanover County. The following NWP #12 conditions will be met: (1) All excavated material shall be returned to the sewerline trench and will be put back to natural grade; (2) Excess spoil will be hauled out of wetlands and be stabilized; (3) All exposed slopes and stream-banks will be immediately stabilized. (4) The construction corridor will be less than 40 ft. in width. (5) Any temporary haul-out road beds will be immediately removed down to grade once the sewerline is installed. As is required a copy of this letter and seven copies of this application will be handed to the DEM office in Raleigh for their required 401 concurrence. Should you have any questions, please advise. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Tittle 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1.991, lists nationwide permits (NWP). Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters acid isolated waters. Your work is authorized by this NWP provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM). This NWP does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. Also, this verification will remain valid for the 2 yearn if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the NWP, activities which have commenced (i.e., are under -2- construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization.
