Based on this review, we have determined that the proposed fill is covered by General Water Quality Certification No. 2664. A copy of the General Certification is attached. This Certification is necessary for coverage under Corps of Engineers' Nationwide Permit No. 12. This action completes DEM's review under Section 401 of the Clean Water Act. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. The Charlotte-Mecklenburg Utility Department (CMUD) retained Woolpert to provide wetlands and permitting services for this project. The project area is located southwest of Charlotte in the town of Pineville. An overview of the project location is presented on the attached Figure 1. The project, as designed by CMUD, consists of the following: • A new pump station with a capacity of < 1 MGD located along McCullough Branch - a tributary of Sugar Creek • Approximately 5,000 LF of force main; the force main will terminate at an existing manhole with wastewater being ultimately conveyed to the McAlpine Treatment Plant • Approximately 8,000 LF of sanitary sewer gravity trunk lines largely paralleling McCullough Branch • A gravel access road to the proposed pump station. Project elements are depicted on Figures 2, 3, and 4. The purpose and need of the project is to provide and/or improve sanitary sewer service to western Pineville. ". 8""') Mr. John Dorney February 10, 1994 Page 2 park, thereby allowing the abandonment of a small(.= 5,000 gpd), private wastewater treatment plant (WWTP) and it's associated discharge into McCullough Branch. The existing WWTP is reported to have had recurrent discharge violations. The project will also allow the abandonment of an existing pump station in Pineville. This aging pump station has had a history of problems, including odor, overflows, backups, etc. The town has repeatedly requested the removal of this pump station in light of these problems as well as it's location within the town's recreational complex at Jack D. Hughes Memorial Park. This project calls for the abandonment of this pump station with the site being restored to a grassed area. New right-of--way has been acquired for the project. Permanent right-of-way widths for the installation of the sanitary sewer or the force main are 15'. In the area between the proposed pump station and the existing pump station (to be abandoned) the trench will contain a force main and sewer trunk with a resultant permanent right-of-way width of 20'. Right-of-way for the gravel access road will be 30'. The entire 30' will be graded, with gravel being placed on the interior 15'. Temporary construction easements of variable widths will be necessary to facilitate construction. The proposed pump station and gravel access road have been cited in an open pasture, thereby minimizing potential impacts to wetlands and/or wildlife habitat. Similarly, over one-half of the sewer trunk has also been cited in open pasture. The project will result in six stream crossings, the locations of which are indicated on Figures 2 thru 4. The utility lines will be completely buried, with all crossings occurring at a minimum of 1' below the bottom of the channel. At each of these crossings bank stabilization measures will result in rprap being placed in the stream channel, corresponding to the permanent right-of-way width. Riprap placement will result in approximately 0.1 acre of fill being placed in these waters of the U.S. The largest of the stream crossings will occur at Sugar Creek. This crossing is unavoidable given the project's goal of taking the existing pump station off-line. Figure 5 depicts the Sugar Creek crossing while Figure 6 presents a typical section for the remaining stream crossings. Utility placement between the existing Pineville pump station and Sugar Creek will occur in a palustrine forested wetlands. Approximately 450' of wetlands will be excavated and temporarily disturbed for the placement of the sanitary sewer and force main. The wetland area to be disturbed will be limited to the minimum necessary to construct the utility line. Utilizing the maximum allowable construction corridor width of 40' would result in the disturbance of approximately 0.4 acre of wetlands. In accordance with the permit conditions of NWP #12, the preconstruction contours in the wetlands area will be reestablished. Restoration plans will include seeding of disturbed wetlands areas with a commercially available wetland plant seed mix (rye grass and fescues prohibited) immediately upon completion of the installation. All nationwide and regional conditions for NWP #12 and the 401 General Certification will be met by CMUD's design and adhered to by CMUD's contractors. Mr. John Dorney February 10, 1994 Page 3 Records kept at the Office of State Archaeology and at the Survey and Planning Branch of the State Historic Preservation Office in Raleigh were reviewed to determine whether any recorded archaeological sites or historic properties may be impacted by the project.
