You have our approval to place fill material in 0.60 acres of wetlands or waters for the purpose
of road and utility crossings and stormwater pond construction at AMP, Inc. site, as you described in
your application dated 22 September and 30 November 1994. After reviewing your application, we
have decided that this fill is covered by General Water Quality Certification Number 2671. This
certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of
Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. Pond
design shall follow that shown in the 30 November submittal on your behalf from D S Atlantic.In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Dear Mr. Baker:
Please reference my letter dated August 17, 1994, that
confirmed Department of the Army permit authorization to impact
0.02 acre of jurisdictional waters of an unnamed tributary to
East Fork Deep River on the AMP Incorporated property located off
of Pegg Road (S.R. 1840) and National Service Road (S.R. 1883),
Greensboro, Guilford County, North Carolina. Reference is also
made to your permit request and plans dated September 13, 1994,
provided by Mr. Gene Mustin of the DSA Group (consultant for the
site).
Our review of the submitted plans indicates that you propose
additional construction of new facilities at the subject site.
Further review shows that this proposed construction will result
in approximately 0.58 acre (total approximate 0.60 acre impact
for site) of impacts to unvegetated waters of the United States
located above the headwaters of the aforementioned, unnamed
tributary of East Fork Deep River.
For the purposes of the Corps of Engineers, Regulatory
Program, Title 33, Code of Federal Regulations (CFR), Part 330.6,
published in the Federal Register on November 22, 1991, lists
nationwide permits. Authorization was provided, pursuant to
Section 404 of the Clean Water Act, for discharges of dredged or
fill material into headwaters and isolated waters.
Your work is authorized by this nationwide permit provided
it is accomplished in strict accordance with the enclosed
conditions and provided you receive a Section 401 water quality
certification from the North Carolina Division of Environmental
Management (NCDEM.) You should contact Mr. John Dorney,
telephone (919) 733-1786, regarding water quality certification.
This nationwide permit does not relieve you of the responsibility
to obtain other required State or local approval.

This verification will be valid for two years from the date
of this letter unless the nationwide authorization is modified,
reissued or revoked. This verification will remain valid for the
two years if, during that period, the nationwide permit
authorization is reissued without modification or the activity
complies with any subsequent modification. If during the two
years, the nationwide permit authorization expires or is
suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the
nationwide permit, activities which have commenced or are under
contract to commence, in reliance upon the nationwide permit,
will remain authorized. This is provided the activity is
completed within twelve months of the date of the nationwide
permit's expiration, modification or revocation.

GENERAL CONDITIONS
1. Navigation. No activity may cause more than a minimal adverse effect on
navigation.
2. Proper Maintenance. Any structure or fill authorized shall be properly"
maintained, including maintenance to ensure public safety.
3. trosion and Siltation Controls. Appropriate erosion and siltation controls
must be used and maintained in effective operating condition during '
construction, and all exposed soil and other fills must be permanently
stabilized at the earliest practicable date.
4. Aquatic Life X vements. No activity may substantially disrupt the movement
of those species of aquatic life indigenous to the waterbody, including those
species which normally migrate through the area, unless the activity's primary
purpose is to impound water.
5. $quipmant. Heavy equipment working in wetlands must be placed on mats or
other measures must be taken to maze soil disturbance.
6. Regional and Case-by-case Conditions. The activity must comply with any
regional conditions which may have been added by the Division Engineer and any
case specific conditions added by the Corps.
7. Wild and Scenic Rivers. No activity may occur in a component of the
National Wild and Scenic River System; or in a river officially designated by
Congress as a *study river" for possible inclusion in the system, while the
river is in an official study status. Information on Wild and Scenic Rivers may
be obtained from the National Park Service and the II.S. Forest Service.
9. Tribal Rights. No activity or its operation may impair reserved tribal
rights, including, but act limited to, reserved water rights and treaty fishing
and hunting rights.

quality certification must be obtained or waived.
10. Coastal Zone Yanagen=t. In certain states, an individual state coastal
zone maaagemeat consistency concurrence must be obtained or waived.
12. Ind" *red species. No activity is authorized under any NWP which is
likely to jeopardize the continued existence of a threatened or endangered
species or a species proposed for such designation, as identified under the
Feral ffiidangered Species Act, or which is likely to destroy or adversely
modify the critical habitat of such species. Non-Federal, permittees shall i•

affected or is in the vicinity of the project and shall not ,,

the Endangered Species Act have been satisfied and that the activity is
authorized. information on the location of threatened and endangered species
can be obtained from the U.S. Fish and Wildlife Service and National Marine
Fisheries Service.
12. Historic Properties. No activity which may affect Historic Properties
listed, or eligible for listing, in the National Register of Historic Places is
authorized, until the District Engineer has complied with the provisions of 33
CFR 325, Appendix C. The prospective permittes must notify the District
Engineer if the authorized activity may affect any historic properties listed,
determined to be eligible, or which the prospective permittee has reason to
believe may be eligible for listing on the National Register of Historic Places,
and shall not begin the activity until notified by the District Engineer that
the requirements of the National Historic Preservation Act have been satisfied
and that the activity is authorized. Information on the location and existence
of historic resources can be obtained from the State Historic Preservation
Office and the National Register of Historic Places (see 33 CPR 330.4(8)).

a. Where required by the terms of the NWP, the prospective permittee must
notify the District Engineer as early as possible and shall not begin the
activity:
(1) until notified by the District Engineer that the activity may proceed
under the Mm with any special conditions imposed by the District or Division
Engineer; or
(2) if notified by the District or Division Engineer that an individual
permit is required; or
(3) Unless 30 days have passed from the District Engineers receipt of the
notification and the prospective puttee has not received notice from the
District or Division Engineer, Subsequently, the permittee's right to proceed
under the NWP may be modified, suspended or revoked only in accordance with the
procedure set forth is 33 CYR 330.5(d)(2).
b. The notification mast be in writing and include the following
information and any required fans:
(1) Name, address and telephone number of the'prospectivs permittee;
(2) Location of the proposed project;

(3) Srief description of the proposed project; the project's purpose;
direct and indirect adverse environmental effects the project would cause; any
other NWP(s), regional general permit (s) or individual permit (s) used or Y
intended to be used to authorize any part of the proposed project or related
activity;
(4) where required by the terms of the NWP, a delineation of affected
special aquatic sites, including wetlands; and
(5) A statement that the prospective permittee has contacted;
(a) The QSFWS/NMFS regarding the presence of any Federally listed (or
proposed for listing) endangered or threatened species or critical habitat in
the permit area that may be affected by the proposed project; and any available
information provided by those agencies. (The prospective permittee may contact
Corps District Offices for QSFWS/NMFS agency contacts and list of critical
habitat.)
(b) The SEPO regarding the presence of any historic properties in the
permit area that may be affected by the proposed project; and the available
information, if any provided by that agency.
14. Water Supply Intakes. No discharge of dredged or fill material may occur
in the proximity of a public water supply intake except where the discharge is
repair of the public water supply intake structures or adjacent bank
stabilization.
1S. Shellfish production. No discharge of dredged or fill material may occur
in areas of concentrated shellfish production, unless the discharge is directly
related to a shellfish harvest activity authorized by nationwide permit.
16. Suitable Katerial. No discharge of dredged or fill material may consist of
unsuitable material (e.g., trash, debris, car bodies, etc.) and material
discharged must be free from toxic pollutants in toxic amounts.
17. Mitigation. Discharges of dredged or fill material into waters of the
M ited States must be minimized or avoided to the maximum extent practicable at
the project site (i.e., on-site), unless the District Sagineer has approved a
compensation mitigation plan for the specific regulated activity.
19. Spawning Areas. Discharges in spawning areas duria

NATIONWIDE CONDITIONS
a. The discharge does not cause the loss of more than 10 acres of waters of
the U.S. For the purpose of this nationwide permit, the acreage of loss of
waters of the U.S. includes the filled area plus waters of the,.U.S. that are
adversely affected by flooding, excavation, or drainage as a result of the
project.
b. A 30-day notification to the District Engineer (DE) is required if the
discharge would cause the loss of water of the U.S. greater than one acre. t
For discharges in special aquatic sites, including wetlands, the notification f
must include a delineation of affected special aquatic sites including
wetlands. '
c. .The discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project.
STATE CONSISTENCY CONDITIONS
a. All fill material authorized by this permit must be obtained from an
upland source.
b. Use of this nationwide permit for waste disposal facilities is not
authorized.
c. If the proposed activity is within the North Carolina Coastal Area and
the activity will result in the loss of waters of the United States greater
than 1/3 of an acre, the applicant must receive written concurrence from the
North Carolina Division of Coastal Management (NCDCM) that the activity is
consistent with the North Carolina Coastal Management Program.
d. Should all or part of a proposed activity be located within an Area of
Environmental Concern (AEC) as designated by the North Carolina Coastal
Resources Commission, a Coastal Area Management Act (CAMA) permit is required
from the North Carolina Division of Coastal Management (NCDCM). Should an
activity within or potentially affecting an AEC be proposed by a Federal
agency, a consistency determination pursuant to 15 CFR 930 must be provided to
the NCDC.4 at least 90 days before the onset of the proposed activity.
GENERAL CERTIFICATION CONDITIONS
a. General Certification is denied for fills greater than one area in SA,
trout, HQW, OR1i, WS-I and WS-II watersheds. General certification is issued
for all other waters for fills of not more than 10 acres and in those
watersheds specified above for•fills of not more that one acre.
b. Proposed fill or substantial modification of greater than one-third of an
acre of such waters, including wetlands, requires a written concurrence from
the North Carolina Division of Environmental Management (NCDEM).

c. Established sediment and erosion control practices will be utilized to
prevent violations of the appropriate turbidity water quality standard (50
NTU's in streams and rivers not designated as trout waters by the North r,
Carolina Division of Environmental Management (NCDEM), 25 NTU's in all
saltwater classes and all lakes and reservoirs and 10 NTU's in trout watez;).
d. Measures shall be taken to prevent live or fresh concrete from coming
into contact with waters of the State until the concrete has hardened.
e. Additional site-specific conditions may be added to this Certification in
order to ensure compliance with all applicable water quality and effluent
standards.
f. Concurrence from the North Carolina Division of Environmental Management
(NCDEM) that this Certification applies to an individual project shall expire
three years from the date of the cover letter from the NCDEM.

Certain nationwide permits require notification to the Corps of Engineers
before work can proceed. They are as follows: •
NW? 5 (only for discharges of 10 to 25 cubic yards)
NWP 7
NWP 13 (only for stabilization activities in excess of 500 feet in length
or greater than an average of one cubic yard per running foot)
NWP 14 (only for fills in special aquatic sites, including wetlands, and
must include a delineation of affected special aquatic sites)
NWP 17
NW? 18 (required when discharge exceeds 10 cubic yards or the discharge is
in a special aquatic site and must include a delineation of the affected
special.aquatic site, including wetlands)
NWP 21 (must include a delineation of affected special aquatic sites,
including wetlands)
NWP 26 (only for greater than 1 acre total impacts and must include a
delineation of affected special aquatic sites, including wetlands)

For activities that may be authorized by the above listed nationwide permits
that.require notification, the applicant shall not begin work
,•'a.. Until notified that the work may proceed under the nationwide permit
jith any special conditions imposed by the District Engineer, or
b-. If notified that an individual permit may be required, or
c. Unless 30 days (calendar) have passed from the time a complete
notification is received by the District Engineer and no notice has been
received from the District Engineer, and required state approvals have been
obtained. Required state approvals include: 1) a Section 401 water quality
certification if authorization is requested for a discharge of dredged or fill
.material, and 2) an approved coastal zone management consistency determination
if the activity will affect the coastal area.

Use of NWP 12 also requires notification to the District Engineer, but work
may not begin until written concurrence is received from the District
Engineer. The time periods described above do not apply. Furthermore,
requirements to notify the U.S. Fish and Wildlife Service (USFWS), the
National Marine Fisheries Service (NMFS), and the State Historic Preservation
Office (SHPO), as indicated below and on the notification form, do not apply.
B. REQUEST TO DEM FOR NATIONWIDE PERMIT SECTION 401 GENERAL CERTIFICATION
CONCURRENCE OR INDIVIDUAL SECTION 401 CERTIFICATION.
Certain nationwide permits were denied general 401 certification by the State
of North Carolina and, thus, require individual Section 401 water quality
certifications. They are NWP 6, NWP 17, NWP 21, and NWP 34.
Certain nationwide permits have general certifications, but require
concurrence from the N.C. Division of Environmental Management that the
general certification applies to a proposed action. They are NWP 7, NWP 12,
NWP 13, NWP 14, NWP 15, NWP 16, NW? 18, NWP 26 (if greater than 1/3 acre total
impact), NWP 33, NWP 38, and NWP 40. NWP 23 requires only that the applicant
notify DEM.
C. APPLICATION PROCEDURES.
The attached form should be used to obtain approval from the Corps of
Engineers and/or the N.C. Division of Environmental Management as specified
above. The applicant should make sure that all necessary information is
provided in order to avoid delays. One copy of the application is required by
the Corps of Engineers and seven copies are required by DEM. Plans must be on
8 1/2 x 11 inch paper.
Endangered species requirement: Applicant must notify the U.S. Fish and
Wildlife Service and/or the National Marine Fisheries Service regarding the

I am pleased to present to you the Wetlands Delineation Map and Conceptual Master Plan for the subject
project. The purpose of this letter is to present you with the pertinent information for review.
Please find enclosed two (2) copies of the Wetlands Delineation Map and two (2) copies of the Conceptual
Master Plan. I am currently submitting this plan to the U.S. Army Corps of Engineers for permitting. John
Thomas of the U.S. Army Corps of Engineers has already issued a Nationwide Permit No. 26 (Action I.D.
199401487) for less than one-third (1/3) of an acre for the initial development of the NCDC II building on 5
this site. However, the Owners wish to expand the development, and the water quality pond in the
wetlands area will be required by Guilford County. This development will cause the total disturbed Q 2,/
wetlands to exceed one-third (1/3) of an acre.

A. NOTIFICATION TO THE CORPS OF ENGINEERS DISTRICT ENGINEER. (REFER TO

Certain nationwide permits require notification to the Corps of Engineers
before work can proceed. They are as follows: -
NWP 5 (only for discharges of 10 to 25 cubic yards)

or greater than an average of one cubic yard per running foot) .
NWP 14 (only for fills in special aquatic sites, including wetlands, and
must include a delineation of affected special aquatic sites)

NWP 18 (required when discharge exceeds 10 cubic yards or the discharge is
in a special aquatic site and must include a delineation of the affected
special•aquatic site, including wetlands)
NWP 21 (must include a delineation of affected special aquatic sites,
including wetlands)
NWP 26 (only for greater than 1 acre total impacts and must include a
delineation of affected special aquatic sites, including wetlands)

For activities that may be authorized by the above listed nationwide permits
that require notification, the applicant shall not begin work

Use of NWP 12 also requires notification to the District Engineer, but work
may not begin until written concurrence is received from the District
Engineer. The time periods described above do not apply. Furthermore,
requirements to notify the U.S. Fish and Wildlife Service (USFWS), the
National Marine Fisheries Service (NMFS), and the State Historic Preservation
Office (SHPO), as indicated below and on the notification form, do not apply.
B. REQUEST TO DEM FOR NATIONWIDE PERMIT SECTION 401 GENERAL CERTIFICATION
CONCURRENCE OR INDIVIDUAL SECTION 401 CERTIFICATION.
Certain nationwide permits were denied general 401 certification by the State
of North Carolina and, thus, require individual Section 401 water quality
certifications. They are NWP 6, NWP 17, NWP 21, and NWP 34.
Certain nationwide permits have general certifications, but require
concurrence from the N.C. Division of Environmental Management that the
general certification applies to a proposed action. They are NWP 7, NWP 12,
NWP 13, NWP 14, NWP 15, NWP 16, NWP 18, NWP 26 (if greater than 1/3 acre total
impact), NWP 33, NWP 38, and NWP 40. NWP 23 requires only that the applicant
notify DEM.
C. APPLICATION PROCEDURES.
The attached form should be used to obtain approval from the Corps of
Engineers and/or the N.C. Division of Environmental Management as specified
above. The applicant should make sure that all necessary information is
provided in order to avoid delays. One copy of the application is required by
the Corps of Engineers and seven copies are required by DEM. Plans must be on
8 1/2 x 11 inch paper.
Endangered species requirement: Applicant must notify the U.S. Fish and
Wildlife Service and/or the National Marine Fisheries Service regarding the

Use of NWP 12 also requires notification to the District Engineer, but work
may not begin until written concurrence is received from the District
Engineer. The time periods described above do not apply. Furthermore,
requirements to notify the U.S. Fish and Wildlife Service (USFWS), the
National Marine Fisheries Service (NMFS), and the State Historic Preservation
Office (SHPO), as indicated below and on the notification form, do not apply.

CONCURRENCE OR INDIVIDUAL SECTION 401 CERTIFICATION.
Certain nationwide permits were denied general 401 certification by the State
of North Carolina and, thus, require individual Section 401 water quality
certifications. They are NWP 61 NWP 17, NWP 21, and NWP 34.
Certain nationwide permits have general certifications, but require
concurrence from the N.C. Division of Environmental Management that the
general certification applies to a proposed action. They are NWP 7, NWP 12,
NWP 13, NWP 14, NWP 15, NWP 16, NWP 18, NWP 26 (if greater than 1/3 acre total
impact), NWP 33, NWP 38, and NWP 40. NWP 23 requires only that the applicant
notify DEM.
C. APPLICATION PROCEDURES.
The attached form should be used to obtain approval from the Corps of
Engineers and/or the N.C. Division of Environmental Management as specified
above. The applicant should make sure that all necessary information is
provided in order to avoid delays. One copy of the application is required by
the Corps of Engineers and seven copies are required by DEM. Plans must be on
8 1/2 x 11 inch paper.
Endangered species requirement: Applicant must notify the U.S. Fish and
Wildlife Service and/or the National Marine Fisheries Service regarding the

PURPOSE OF MEETING: Inspect and review on-site wetlands.
CORRECTIONS AND OMISSIONS:
These minutes are the writer's interpretation of the events, discussions, and transactions that took place
during the meeting. If there are any additions and/or corrections to these minutes, please inform the
writer within seven (7) days.
ITEMS OF DISCUSSION:
1. The attendees first inspected the existing on-site farm pond along with its inlet and discharge creeks.
The creek above the farm pond was dry during the inspection. However, the creek below the pond
was dry with some standing water in the lower, flat sump area of the creek bed.
2. This creek below the pond did not really portray perennial stream characteristics until about 175' east
of the point where the creek flows off of the site.
3. Ron stated that although he offered no guarantees, he would advise that we pursue our design of the
large permanent wet detention pond to be located on this creek described in items 1 and 2 as
follows:
a. Drain the existing farm pond using precautionary measures to protect the down stream water.
It would be helpful to drain the pond by breaching the dam on the side instead of directly into
the middle of the creek.

b. Design the dam in a manner which minimizes the disturbance of the 175' length of creek
which had perennial stream characteristics. This would entail setting the toe of the proposed
dam as far off the westerly property line as possible. If the toe cannot be set the full 175' off
of the property line, the plan may still be acceptable.
C. Create some wetland areas in the upper reaches of the pond. This may entail grading a
shallow (±2') ledge at the waters edge with some planted vegetation such at cattails.
4. The pond which potentially will be located to the far western portion of the property will probably not
be located within the existing creek or natural seeps within the area. The pond will have to discharge
into the creek. This scenario should be acceptable.
SUMMARY.
A wetland disturbance/mitigation plan should be prepared and submitted for permitting.
