You propose to construct a driveway/road which impacts 0.23 acres (Nationwide Permit No. 14) J,S © QC_ and construct two house pads which impact 0.36 acres (Nationwide Permit No. 18) in wetlands adjacent to Grissett Swamp Run. Additionally, you propose to widen an existing road and create residential house pads impacting 1.21 acres of wetlands either isolated or above the head waters of Grissett Swame-"Run (Nationwide Permit No. 26). For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization under Nationwide Permit No. 14 pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for fills for roads crossing waters of the United States (including wetlands and other special aquatic sites) provided: a. The width of the fill is limited to the minimum necessary for the actual crossing; b. The fill placed in waters of the United States is limited to a filled area of no more than one-third acre. Furthermore, no more than a total of 200 linear feet of the fill for the roadway can occur in special aquatic sites, including wetlands; C. The crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand, expected highflows and the movement of aquatic organisms; d. The crossing, including all attendant features, both temporary and permanent, is part of a single and complete project for crossing of a water of the United States; and a. For fills in special aquatic sites, including wetlands, the permittee notifies the District Engineer (DE) in accordance with the "Notification" general condition. Additionally, authorization under Nationwide Permit No. 18, pursuant to Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act, was provided for discharges of dredged or fill material into all waters of the United States provided: -2- a. The discharge does not exceed 25 cubic yards; b. The discharge will not cause the loss of more than 1/10 acre of a special aquatic site, including wetlands. For the purposes of this nationwide permit, the acreage limitation includes the filled area plus special aquatic sites that are adversely affected by flooding and special aquatic sites that are drained so that they would no longer be a water of the United States as a result of the project; Finally, authorization under Nationwide Permit No. 26, pursuant to Section 404 of the Clean Water Act, was provided for discharges of dredged or fill material into headwaters and isolated waters. Your work is authorized by these nationwide permits provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM). You should contact Mr. John Dorney, telephone (919) 733-1786, regarding water quality certification. These nationwide permits do not relieve you of the responsibility to obtain other required State or local approval. These verifications will be valid for two years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. Also, these verifications will remain valid for the two years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the two years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend or revoke the authorization. Box 6 Tabor City, N.C. 28463 Dear Mr. Phipps: Subject: Proposed fill in Wetlands or Waters Lake Tabor Estate Columbus County DEM Project #94062 We have reviewed your request for 401 Water Quality Certification to place fill material in 1.7 acres of wetlands or waters which are tributary to Grissett Swamp Run Creek for residential development located at Lake Tabor Estates in Columbus County as described in your submittal dated 14 February 1994. Based on this review, we have determined that the proposed fill is covered by General Water Quality Certification Numbers 2732 and 2671. Copies of the General Certifications are attached. These Certifications are necessary for coverage under Corps of Engineers' Nationwide Permit Numbers 14 and 26. This action completes DEM's review under Section 401 of the Clean Water Act. An additional condition is that fill shall not occur on lot 17. Deed restrictions shall be placed on all lots with jurisdictional wetlands to prevent additional fill. Stormwater shall be directed to sheetflow into the wetland rather than piped to the lake or stream. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. The revised proposal includes the necessary changes to the NWP 18 request to bring the total fill to less than a tenth of an acre. Lot 17 also has a revised NWP 14 for .04 acre fill for driveway access. This now brings total fill area from 1.8 acres down to 1.578 acres. Changes have also been made to the original subdivision layout to minimize road impacts. The southern-most cul-de-sac has been pulled back to lots 97 and 95 instead of terminating in lot 96. An individual driveway with a 30 ft. right-of-way will connect to lot 96 for private access.
