DEM# 94783. Staff biologists with the North Carolina Wildlife Resources Commission have reviewed the subject 401 certification and are familiar with the subject area. An onsite investigation was conducted on September 12, 1994 for the purpose of assessing impacts to wildlife and fisheries resources resulting from the proposed project. This correspondence is provided with certain provisions of the Fish and Wildlife Coordination Act (48 stat. 401, as amended; 16 U.S.C. 661 et seq.), and section 401.b of the Clean Water Act of 1977 (as amended), and North Carolina General Statutes (G. S. 113 -13 1 et seq.).. sd The applicant, Ms. Martha Howe, is proposing to fill 0.54 acres of wetlands associated with a dune and swale maritime forest on Bogue Banks in the town of Emerald Isle. The purpose of the filling is to promote commercial development on the property. The property is long and narrow and parallels NC 58 from Bogue Sound to Coast Guard road. As proposed, the Wildlife Resources Commission has concerns with this project, in that valuable wetland will be altered or lost. The WRC considers wetland areas to be significant for wildlife and fish habitat and opposes their destruction or alteration. Maritime forest wetlands have been especially hard hit by development. We feel that the project should be altered to prevent wetland fill and request that a 401 Water Quality Certification not be issued unless plans are modified. F Pn; tl TV You have our approval to place fill material in 0.24 acres of wetlands or waters for the purpose of commercial lot fill at Hwy 58 on Bogue Banks near bridge to Emerald Isle, as you described in your application dated 14 August 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. The central, larger wetland site shall not be filled. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
