After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2733. This certification allows you to use Nationwide Permit Number 18 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. NARRATIVE DESCRIPTION: The applicant owns an approximately 2.3 acre tract of land located off NCSR 1377 and adjacent to Core Sound in the community of Sea Level, Carteret County. Approx. 1/2 of the property has been classified as "404" wetlands by the US Army Corps of Engineers (COE) and a wetlands delineations has been approved by the COE. In order to gain access to this property from the state road, a 25' wide access easement was provided to the applicant at the time of lot purchase. The majority of the easement follows an existing dirt drive which is surrounded by "404" wetlands except for the last approx. 200', where the easement is located entirely in Coastal Wetlands or in a tidal ditch. The adjacent property owner will not allow the applicant to use the remaining driveway to gain access to his property. A civil lawsuit has been filed against the realtor and the purpose of this permit application is to provide another means of access to the property. The applicant has received a septic tank permit from Carteret County but there are no immediate plans to build a residence at the present time. This area of Core Sound has been designated Outstanding Resource Waters by the Environmental Management Commission and is classified as "SA" waters. The waters adjacent to this site are open to the harvesting of shellfish. The applicant is requesting a permit to fill an approx. 225' long X 10' wide area of "404" wetlands (vegetated primarily with red cedar, iva frutescens, baccharis halimifolia, juncus effusus and spartina patens) with sand and marl for the purpose of gaining vehicular access to the his high ground property. This filling would occur within 575' of the waters of Core Sound. 10. ANTICIPATED IMPACTS: The project as proposed will result in the filling in of approx. 2,225 sq. ft. of "404" wetlands within the Estuarine Shoreline AEC. Approx. 80 cu. yds. of sand and marl material would be placed in the wetlands to provide a suitable base for vehicular traffic. It appears that the applicant is eligible for a Nationwide Permit from the COE for this fill. It can also be anticipated that sometime in the future, a residence will be constructed on the property.
