Dear Mr. Pitts:
The North Carolina Division of Coastal Management has reviewed the
above referenced application for a Nationwide Permit dated may 6,
1994 pursuant to Section 307 of the Coastal Zone Management Act of
1972 as amended. Based upon our review, we have determined that
the proposed activity is consistent with the North Carolina Coastal
Management Program provided the following conditions are met:
1. The activity described in the above referenced
application qualifies to receive one of the Nationwide
Permits described in 33 CFR Part 330 with the exception
of Numbers 17, 21, 24, and 34 which were found inconsis-
tent with the North Carolina Coastal Management Program.
2. A 401 Water Quality Certification is received, where
required, from the North Carolina Division of
Environmental Management.
This letter does not relieve you of the responsibility to insure
that all other State authorization and/or permit requirements are
met prior to implementation of the project. Please feel free to

Dear Mr. Pitts:
You have our approval to place fill material in 0.7 acres of wetlands or waters for the
purpose of substation enlargement at NC 101 near Beaufort, as you described in your
application dated 11 May, 1994. After reviewing your application, we have decided that
this fill is covered by General Water Quality Certification Number 2671. This certification
allows you to use Nationwide Permit Number 26 when it is issued by the Corps of
Engineers.
This approval is only valid for the purpose and design that you described in your
application. If you change your project, you must notify us and you may be required to
send us a new application. For this approval to be valid, you must follow the conditions
listed in the attached certification. In addition, you should get any other federal, state or
local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 30 days of the date that you receive this letter.
To ask for a hearing, send a written petition which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box
27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and
binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under
Section 401 of the Clean Water Act. If you have any questions, please telephone John

The Wilmington Regional Office received the Stormwater Submittal for North River Substation on
April 7, 1994. Based on our review of the project plans and specifications, which limit the built-upon area
to 52,272 square feet, we have determined that the project complies with the Stormwater Regulations set
forth in Title 15A NCAC 2H.1003(a)(2) (3).
Any modification of the plans submitted to this Office or further development of this contiguous
project will require an additional Stormwater Submittal/Modification and approval prior to initiation of
construction, regardless of the fact that such modification may be less than one acre. Modifications include
but are not limited to; project name changes, transfer of ownership, redesign of built-upon surfaces,
addition of built-upon surfaces, redesign or further subdivision of the project area as shown on the
approved plans.
This Certification shall be effective from the date of issuance until rescinded. The project shall be
constructed and maintained in accordance with the plans and specifications approved by the Wilmington
Regional Office. This Certification does not supersede any other permit or approval. The developer is
responsible for obtaining any and all permits and approvals necessary for the development of this project.
This could include the Division of Coastal Management under CAMA requirements, the Division of
Environmental Management under Wetland 401 Water Quality Certification and/or a Dredge and Fill
Permit and/or a Sewer Extension/Collection Permit, U.S. Army Corps of Engineers 404 Wetland Permit,
NPDES stormwater permit if disturbing five acres or more, local County or Town-Agency permits under
their local ordinances, or others that may be required.

Deed restrictions must be recorded with the Office of the Register of Deeds. A copy of the
recorded deed restrictions, including deed book number and page, must be forwarded to this Office within
30 days of the date of the recording. Failure to record and/or submit the deed restrictions to this Office
is considered a violation of this Certification.
An Engineer/Designer/Owner Certification (copy attached) must be received at the time the
recorded Deed Restrictions are submitted. The Certification will verify to this Office that the stormwater
controls and the general layout of the project (amount of impervious area) are in substantial compliance
with the approved Stormwater Plan.

This office has reviewed the subject sedimentation and erosion control Plan. We find the plan to be
acceptable and hereby issue this letter of approval with comments as attached.
Please be advised that Title 15A, of the North Carolina Administrative Code, 413.001 7(a) requires that
a copy of the approved plan be on file at the job site. Also, you should consider this letter to give the Notice
required by GS 1 13A-61(d) approved plan. The last page(s) which lists approval comments should be copied
and attached to the sedimentation and erosion control plan that is maintained on site.
North Carolina's Sedimentation Pollution Control Program is performance oriented, requiring protection
of the natural resources and adjoining properties. If, following the commencement of this project, it is
determined that the erosion and sedimentation control plan is inadequate to meet the requirements of the
Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 1 13A-51 thru 66), this office
may require revisions to the plan and its implementation to insure compliance with the Act.
Recognizing the desirability of early coordination of sedimentation control, we believe that it would
be beneficial if a pre-construction conference could be arranged to discuss the approved plan for this project.
Please contact this office and let us know the date of construction start-up and the date of pre-construction
conference so that we may attend.

The developer is responsible for the control of sediment on-site. If the approved erosion measures
prove insufficient, the developer must take those additional steps necessary to stop erosion from
leaving this site.
2. Any and all existing ditches on this project site are assumed to be left undisturbed by the proposed
development unless otherwise noted. The removal of vegetation within any existing ditch or channel
is prohibited unless the ditch or channel is to be regraded with side slopes of 2 horizontal to 1 vertical
or less steep. Bank slopes may be mowed, but stripping of vegetation is considered new earth work
and is subject to the same erosion control requirements as new ditches.
3. The developer is responsible for obtaining any and all permits and approvals necessary for the
development of this project prior to the commencement of this land disturbing activity. This could
include the Division of Coastal Management under CAMA requirements, the Division of Environmental
Management under stormwater regulations, the U.S. Army Corps of Engineers under Article 404
jurisdiction, local County or Town Agencies under their local ordinances, or others that may be
required. This approval cannot supersede any other permit or approval; however, in the case of a
Cease and Desist Order from the Corps of Engineers, that Order would only apply to wetland areas.
All highland would still have to be in compliance with the Sedimentation Pollution Control Act.
4. If any area on site falls under the jurisdiction of Section 404 of the Clean Water Act, the developer
is responsible to the orders of the U.S. Army Corps of Engineers. Any erosion control measures that
fall within jurisdictional wetland area must be relocated to the transition point between the wetlands
and the highlands to assure that the migration of sediment will not occur. If that relocation presents
a problem or contradicts any requirements of the Corps of Engineers, it is the responsibility of the
developer to inform the Land Quality Section Regional Office so that an adequate contingency plan
can be made to assure sufficient erosion control on site. Failure to do so will be considered a
violation of this approval.
5. Any borrow material brought onto this site must be from a legally operated mine or other approved
source. A single use borrow site or an area to waste material is only permissible if it is operated
under total control of the Financially Responsible person or firm who is developing this site and a plan
modification is submitted to this office that includes the area in question.
6. This permit allows for a land disturbance, as called for on the application plan, not to exceed 1.0
acres. Exceeding that acreage will be a violation of this permit and would require a revised plan and
additional application fee. Any addition in impervious surface, over that already noted on the
approved plan, would also require a revised plan to verify the appropriateness of the erosion control
measures and stormwater retention measures.

EROSION CONTROL PLAN FOR THE CONSTRUCTION OF A SPARE TRANSFORMER BANK
AND TRANSMISSION LINE TAP AT CP&L'S NORTH RIVER 115 kV SUBSTATION
Carolina Power & Light Company will construct a spare 115/33 kV transformer bank and an associated
transmission line tap at its North River 115 kV Substation to increase electric power reliability to the
surrounding area, simplify maintenance and minimize potential outage times. CP&L will extend the
existing fenced area 86 feet east. CP&L anticipates that the grading will begin by July of this year.
CP&L will place the new transformer bank in service by December 31, 1994.
CP&L has operated a substation at the site for approximately 20 years. The site, located immediately east
of NC Highway 101 and approximately three miles north of Beaufort; contains 4.9 acres, including 0.3
acre of highway right of way. Grass covers most of the site except for the gravel-covered substation
fenced area and driveways. Trees and undergrowth cover only a narrow band along the east property
line. The site slopes from both west and east to a south-to-north draining ditch. Surface water drains
from this ditch through a pipe under the soil road along CP&L's north property line, into a east-to-west
flowing ditch just north of this road, through a 5-foot-square box culvert under NC 101, and then, into
a tributary of Russell Creek and the Newport River. The existing ground surface elevations range from
approximately 10.5 to 6.1 feet.
CP&L will expand the graded area dimensions from 150 to 236 feet east-west while maintaining 205 feet
north-south. The substation will have a finished stone grade sloping from the crown of 10.5 feet, at the
center driveway, to 9.3 feet along the existing west fence and 10.0 feet along the new east fence. The
grading will require maximum cut and fill depths of approximately 2.5 and 3.5 feet, respectively, and will
move approximately 1000 cubic yards of soil. The permanent cut and fill surfaces will slope at three to
one, horizontal to vertical or flatter.
The Soil Survey of Carteret County North Carolina indicates that the site soils are primarily Arapahoe
fine sandy loam with a small area of Augusta loamy fine sand in the northwest corner. Arapahoe fine
sandy loam generally has the following characteristics: very poorly drained, moderately rapid
permeability, extremely to strongly acid surface soils and subsoils unless lime has been added, and a
seasonal high water table at or near the surface. The survey indicates that developed areas have "intensive
drainage systems similar to those used for cropland. "
CP&L anticipates the grading for the substation will proceed as follows:
1. The grading contractor will install a temporary gravel construction entrance near the intersection
of the existing substation driveway and NC 101. The contractor will complete this work in
general accordance with Section 6.06 of the North Carolina Erosion and Sediment Control
Planning and Design Manual (hereafter reference as the Manual) and Drawing Number RAC-
24805.
2. The grading contractor will install sediment (silt) fence between the existing north-south ditch and
the proposed ditch DI as shown on the Grading Plan. The contractor will excavate this ditch
relocation Dlb and c as shown on the Grading Plan and enclosed table. The ditch will have a
trapezoidal cross section. The contractor will use a construction sequence which minimizes
surface water runoff into or from the new segments until they are seeded and mulched with straw
held by netting or approved equivalent. The contractor will store the excavated soil between the

new ditch and the downgradient silt fence and later will use it as fill. They will connect the outlet
of segment c to the existing ditch before connecting the inlet of segment b to the new Dla. They
will immediately seed and mulch these connections and D 1 a. The contractor will construct ditch
D2 using similar procedures. They will complete this work in general accordance with Sections
6.03, 6.11 (table v), 6.14, 6.21, 6.30, and 6.62 of the Manual and Drawing Number RAC-24525.
3. When they have completed ditches D1 and D2, the grading contractor will relocate portions of
the silt fence and install additional segments as shown on the Grading Plan. The majority of the
relocation and extension will place silt fence along the west bank of the new ditch Dlb and c and
along both sides of the driveway addition. They will complete this work in general accordance
with Section 6.62 of the Manual and Drawing Number RAC-24525.
4. The grading contractor will strip the topsoil from the expansion areas and use it to construct the
fill slopes.
The grading contractor will rough grade the substation and access road as shown on the Grading
Plan, filling with both on-site cut soils and off-site borrow soils. The contractor will obtain off-
site soil only from legally operated borrow pits. As the grading progresses, the contractor will
install pipe P1 as shown on the Grading Plan and enclosed table. They will install flared-end
sections and riprap protection at the inlet and outlet of pipe P1. They will complete this work
in general accordance with Sections 6.15 and 6.41 of the Manual.
6. The grading contractor will cover the driveways with a six-inch-thick layer of ABC stone
7. CP&L anticipates that the contractor will complete the rough grading by August. At that time,
the landscaping contractor will permanently seed and mulch the disturbed areas which are not to
be covered with stone. They will complete this work in general accordance with Sections 6.11
(table p) and 6.14 of the Manual.
8. The fence contractor will install the new substation perimeter fence. The substation contractor
will excavate and construct the structure and equipment foundations, erect the structures, and
install the equipment. The transmission line contractor will construct the transmission tap.
CP&L anticipates that the contractors will complete all this work by December 31, 1994.
9. Upon completion of the substation, the grading contractor will fine grade the substation with the
surface draining from the center crown to the east and west edges. The contractor will cover the
fenced area with a layer of ABC stone three to four inches thick.
10. Depending on the time of year, the landscaping contractor will either temporarily or permanently
seed, lime, fertilize, and mulch any disturbed areas which are not covered with stone, including
the 20-foot-wide perimeter outside the fence. If the seeding is temporary, then the landscaping
contractor will permanently seed during the next planting season. They will complete this work
as described in general accordance with Sections 6.10 (table a or c), 6.11(table p), and 6.14 of
the Manual.

11. When all the areas are stabilized, the grading contractor will remove the sediment fence.
As referenced above, the following information is enclosed as part of this erosion control plan: tables
presenting the design parameters for the ditches and pipe; standard detail drawings for the temporary
construction entrance and silt fences; the Grading Plan; the Topographic Map; and the applicable sections
of the Erosion and Sediment Control Pla ning and Design Manual.
